AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A PLANNED DEVELOPMENT
TO PERMIT THE CONSTRUCTION OF A ROWHOME BUILDING CONTAINING EIGHT
DWELLING UNITS IN THE CC2 CENTER CITY DISTRICT AND THE
ARC ARTERIAL ROAD CORRIDOR OVERLAY DISTRICT
(252 Douglas Avenue)
WHEREAS, written application has been made for a conditional
use for a planned development which will permit the construction of
a bank with a drive through window in the RB Residence Business
District and the ARC Arterial Road Corridor Overlay District at
252 Douglas Avenue; and
WHEREAS, the Zoning and Subdivision Hearing Board conducted a
public hearing after due notice by publication and has submitted
its findings of fact .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS :
Section 1 . That a conditional use for a planned development
which will allow for the construction of a rowhome building
containing eight dwelling units within the CC2 Center City District
and the ARC Arterial Road Corridor Overlay District at 252 Douglas
Avenue and legally described as follows :
THAT PART OF LOT 52 OF P.J. KIMBALL, JR' S . SECOND
ADDITION TO ELGIN, DESCRIBED AS FOLLOWS : BEGINNING AT
THE INTERSECTION OF THE WEST LINE OF DOUGLAS AVENUE WITH
THE NORTH LINE OF KIMBALL STREET; THENCE NORTH ALONG SAID
WEST LINE OF DOUGLAS AVENUE 77 FEET; THENCE WEST PARALLEL
WITH THE NORTH LINE OF KIMBALL STREET 134 FEET; THENCE
NORTH PARALLEL WITH SAID WEST LINE OF DOUGLAS AVENUE 40
FEET; THENCE WEST PARALLEL WITH SAID NORTH LINE OF
KIMBALL STREET 66 .4 FEET TO THE WEST LINE OF SAID LOT 52;
THENCE SOUTH ALONG SAID WEST LINE 117 FEET TO THE NORTH
LINE OF KIMBALL STREET; THENCE EAST ALONG SAID NORTH LINE
OF KIMBALL STREET 200 FEET TO THE POINT OF BEGINNING, IN
THE CITY OF ELGIN, KANE COUNTY, ILLINOIS (PROPERTY
COMMONLY KNOWN AS 252 DOUGLAS AVENUE) .
be and is hereby granted subject to the following conditions :
1 . Substantial conformance with the Statement of
Purpose and Conformance, previously prepared by Centre
Rowhomes, L.L.C. , no date .
2 . Substantial conformance to the document
entitled "Kimball & Douglas Rowhomes of Elgin, Illinois, "
presented by Kimball-Elgin, L.L.C. , and dated May 2003 ,
encompassing floor plans, typical front elevations, and a
�• letter from Mr. James Rapier, to Ms . Lauren M. Kieck,
dated May 20 , 2003 .
3 . Submittal of a separate landscape plan
indicating types, quantities, and size of proposed
materials and typical foundation plantings .
Additionally, the plans shall be revised to provide
landscaping along the perimeter of the rear parking lot,
which shall exceed the standard requirements of the
zoning ordinance. All landscaping on site shall be
subject to the review and approval of the Community
Development Group.
4 . The developer shall work with the Northeast
Neighborhood Association for the location of an entryway
sign and/or a landscape feature on the subject property,
the design of which is to be mutually agreed upon by the
developer, NENA, and the City of Elgin.
5 . The landscape islands located at the entrances
to the garage shall be curbed or provided with a
protective barrier constructed of a durable material
other than wood.
e'' 6 . The developer shall work with the Engineering
Division to adequately address stormwater management .
7 . Compliance with all applicable codes and
ordinances .
Section 2 . That the conditional use granted herein shall
expire if not established within one year from the date of passage
of this ordinance .
Section 3 . That this ordinance shall be in full force and
effect immediately after its passage in the manner provided by law.
