AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A PLANNED DEVELOPMENT TO PERMIT
THE EXPANSION OF THE PERMITTED USE LIST AND THE CONDITIONAL USE
LIST FOR PROPERTY IN THE CC1 CENTER CITY DISTRICT
(18 NORTH STATE STREET)
WHEREAS, written application has been made for a conditional use
for a planned development which will allow for the expansion of the
permitted use list and conditional use list in the CC1 Center City
District at 18 North State Street ; and
WHEREAS, the Zoning and Subdivision Hearing Board conducted a
public hearing after due notice by publication and has submitted its
findings of fact .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS :
Section 1 . That a conditional use for a planned development
which will allow for the expansion of the permitted use list and
conditional use list for property located at 18 North State Street
and legally described as follows :

LOTS 9 AND 10 AND PART OF LOTS 7 & 8 IN BLOCK 29 OF
WILLIAM C . KIMBALL' S PLAT OF ELGIN, DESCRIBED AS FOLLOWS :
COMMENCING AT THE NORTHEAST CORNER OF SAID BLCOK: THENCE
SOUTHERLY ALONG THE EAST LINE OF SAID BLOCK, 132 FEET TO
THE SOUTHEAST CORNER OF LOT 10 ; THENCE WESTERLY ALONG THE
SOUTH LINE OF LOTS 10 AND 7 TO THE FORMERLY EASTERLY LINE

I . SUPPLEMENTARY REGULATIONS
Any word or phrase contained within this ordinance followed by
the symbol " [SR] " shall be subject to the definitions and the
additional interpretive requirements provided in Chapter 19 . 90,
Supplementary Regulations, of the EMC. The exclusion of such
symbol shall not exempt such word or phrase from the applicable
supplementary regulation.
II . LAND USE
For this conditional use established by this ordinance, the only
land uses allowed shall be those permitted and conditional land
uses allowed in the CC1 Center City District, and the following
additional land uses upon review and approval by the Development
Administrator. The Development Administrator shall review the
uses on a case-by-case basis to determine the adequacy of the
existing or proposed facilities on the subject property relative
to the characteristics of the intended land use . The
characteristics of the intended land use shall include, but are
not limited to, the function and operation of the land use, and
the anticipated impact on the traffic and parking in the area
immediately surrounding the subject property.
If the Development Administrator determines that the
characteristics of the intended land use are incompatible with
the existing or proposed facilities, or that the existing
facilities are inadequate for establishment of the use on the
subject property pursuant to the review process outlined above,
the property owner can seek conditional use approval for the
intended use pursuant to Section 19 . 65 of the Elgin Municipal
Code .
A. The following enumerated land uses shall be the only
additional land uses allowed as a permitted use subject
to the review and approval by the Development
Administrator:

1 . Substantial conformance to the Statement of Purpose and
Conformance submitted by Kurt Kresmery, dated
September 27th, 2002 .
2 . Substantial conformance to the Site Plan, prepared by the
Community Development Group, dated October 30 , 2002 .
3 . No more than one employee for every 2 , 000 square feet of
floor area. All employee parking to be contained entirely
on site on an improved off-street parking space .
4 . No more than one truck dock will be allowed on the subject
site . No truck stacking will be allowed. No more than
five deliveries by semi trailer or other delivery truck
will be allowed per day. No deliveries will be allowed
between 7 : 00 am to 9 : 00 am and 3 : 00 pm to 6 : 00 pm.
5 . Compliance with all other applicable codes and ordinances .
Section 2 . That the conditional use granted herein shall expire
if not established within one year from the date of passage of this
ordinance .
Section 3 . That this ordinance shall be in full force and
effect immediately after its passage in the manner provided by law.
