HomeMy WebLinkAboutG72-02 (2) Ordinance No. G72-02 AN ORDINANCE AMENDING CHAPTER. 6 . 54 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED "SCAVENGERS" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Section 6 . 54 . 020 of the Elgin Municipal Code, 1976, as amended, entitled "License; Application" be and is hereby further amended to read as follows : "6 . 54 . 020 LICENSE; APPLICATION Applications for a license as required by Section 6 . 54 . 010 of this Chapter shall be made in writing on the scavenger license application form provided for such purpose and submitted to the city' s code administration and development services director. License applications must be completed in full . No license shall be issued except where the application conforms to the ordinances of the city and other applicable requirements of law and upon the approval of the city' s code administration and development services director. " Section 2 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 3 . TO: Mayor and Members of the City Council FINANCIALLY STABLE CITYGOVEFNMENT EFFICIENT SERVICES, AND OUALIT Y INFRASTRUCTURE FROM: Olufemi Folarin, Interim City Manager SUBJECT: Scavenger Ordinance Amendment PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information amending the scavenger ordinance regarding issuance of scavenger licenses . BACKGROUND The current scavenger ordinance states that it is unlawful to carry on the business of trash removal without first obtaining a license for that purpose . Applications must be submitted to the City Clerk for referral to the Council . Licenses may only be issued by subsequent to approval by the City Council . The investigatory work regarding the scavenger license applications is currently done by the Public Health Officer. Upon meeting all applicable rules and regulations, a recommendation by the health officer to the City Clerk is made to issue an annual license. Approximately 30 scavenger licenses are issued annually. The City Council considers these applications approximately twice a year. Since the City Clerk and Council follow the recommendation of the Public Health Officer, the process could be shortened by allowing the City' s Code Administration and Development Services Director to issue scavenger licenses (see attached draft copy of amendment) . Scavenger Ordinance Amendment September 20, 2002 Page 2 kINANCIAL IMPACT The fee amount for a scavenger license is $30 . 00 for a single waste hauling vehicle and $15 . 00 for each additional vehicle. No change in the fee is being recommended at this time . A total of $1, 090 . 00 has been collected in 2002 compared to the budget of $1, 000 . 00 . AL IMPACT None . ALTERNATIVES 1 . Do not amend licensing application portion of ordinance . RECOMMENDATION It is recommended that the City Council approve the proposed amendments as presented.
