HomeMy WebLinkAboutG66-02 w Ordinance No. G66-02 AN ORDINANCE GRANTING A CONDITIONAL USE FOR A NIGHTCLUB AND AN OUTDOOR EATING AND DRINKING FACILITY (231 Douglas Avenue) WHEREAS, written application has been made for a conditional use for a nightclub and an outdoor eating and drinking facility in the CC2 Center City District and the ARC Arterial Road Corridor District at 231 Douglas Avenue; and WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after due notice by publication and has submitted its Findings of Fact and recommended approval ; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Zoning and Subdivision Hearing Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That the City Council of the City of Elgin hereby adopts the Findings of Fact made by the Zoning and Subdivision He.x -ng Board, a copy of which is attached hereto and made a part hereof—by reference as Exhibit A. Section 2 . That a conditional use for a nightclub and an outdoor eating and drinking facility in the CC2 Center City District and the ARC Arterial Road Corridor District at 231 Douglas Avenue and legally described as follows : LOTS 27, 28, AND 29 AND THE NORTHERLY HALF OF THE VACATED ALLEY LYING SOUTHERLY OF THE ADJOINING SAID LOT, EXCEPT THE NORTH 60 FEET THEREOF, IN PHINEAS J. KIMBALL JR.'S SECOND ADDITION TO ELGIN, IN THE CITY OF ELGIN, KANE COUNTY, ILLINOIS . be and is hereby granted subject to the following conditions : 1 . Substantial conformance to the Statement of Purpose and Conformance submitted by Anthony L. Nance, undated. 2 . Substantial conformance to the site plan and floor plan, undated. 3 . The outdoor eating and drinking facility shall be enclosed by a fence, 3 feet in height . The fence shall be located in substantial conformance with the Landscape Plan, and shall be designed in substantial conformance with the Fence Elevation featuring the "Orleans" style fence . 4 . The easterly side of the outdoor eating and drinking facility shall be finished with a retaining wall and landscaping as indicated on the 231 Douglas Landscaping Plan, submitted by John Haight . 5 . All gravel on site shall be removed and landscaped with either seed or sod. 6 . Substantial conformance with the Sign Plan, submitted by Anthony Nance, and dated September 16, 2002 . 7 . Substantial conformance with the Building Elevations for Petition 35-02 , prepared by the Community Development Group. 8 . Compliance with all other applicable codes and ordinances . Section 3 . Draft Conditional Use Ordinance (see attached) Exhibit A Findings of Fact Zoning and Subdivision Hearing Board Petition 35-02 August 21, 2002 BACKGROUND An application has been filed by Anthony Nance, requesting conditional use approval for a nightclub and an outdoor eating and drinking facility in the CC2 Center City District and the ARC Arterial Road Corridor Overlay District. The subject property is located at 231 Douglas Avenue (reference Exhibits A, B, C, D and E). The applicant proposes to establish a nightclub featuring live R&B, blues, and jazz music performed by local artists. The applicant also proposes to provide seating on an outdoor patio which currently exists at the rear of the building. In addition to music, a menu would be provided featuring ribs and a variety of sandwiches and appetizers. Initial hours of operation would be Wednesday through Saturday from 5:00 p.m. to 1:00 a.m.; however, the applicant would like the option of serving lunch in the future as well (reference Exhibits F and G). GENERAL FINDINGS After due notice, as required by law, the Zoning and Subdivision Hearing Board conducted a public hearing in consideration of Petition 35-02 on August 21, 2002. The applicant testified at the public hearing and presented documentary evidence in support of the application. No objectors spoke at the public hearing. No written correspondence was submitted. The Community Development Group submitted a Conditional Use Review dated August 12, 2002. The Zoning and Subdivision Hearing Board has made the following general findings: A. Zoning History Findings. The subject property was zoned as follows for the years listed: 1927 E Commercial District 1950 D Commercial District 1960 E Commercial District 1962 B3 Service Business District 1992 B4 General Service District 1993 CC2 Center City District Present CC2 Center City District ARC Arterial Road Corridor Overlay District B. Surrounding Land Use and Zoning Findings. The subject property is located within the CC2 Center City District. The area to the north of the subject property is developed with a multiple family dwelling. The property to the south is of the subject property is developed ed with an automobile repair training facility. 2 Findings of Fact Zoning and Subdivision Hearing Board Petition 35-02 August 21, 2002 The property to the east of the subject property is developed with a parking lot. The property to the west of the subject property is being developed with The Centre. C. Trend of Development Findings. The subject property is located on the edge of the traditional downtown, which is developed with a mix of business, residential and institutional uses. D. Zoning District Findings. The purpose of the CC2 Center City District is to facilitate the implementation of the official comprehensive plan for the center city, as focused on a distinctive subarea of the city with a common urban fabric. The CC2 zoning district provides for a concentration of finance, service, retail, civic, office, and cultural uses, in addition to complementary uses such as hotels, entertainment and housing. The development standards are intended to encourage a mix of activity in the area while providing for quality development that maintains a sense of history, human scale and pedestrian-oriented character. The development standards are intended to promote a transition between the more intense development in the CC 1 zoning district and the residential neighborhoods surrounding the center city. E. Site Characteristics Standard. The suitability of the subject property for the intended conditional use with respect to its size, shape, significant features including topography, watercourses, vegetation, and existing improvements. Findings. The subject property is suitable for the intended conditional use with respect to the site characteristics standard. The subject property is a regularly shaped parcel containing approximately 17,500 square feet of lot area. The property is improved with a commercial building and a patio area located at the rear of the building. F. Sewer and Water Standard. The suitability of the subject property for the intended conditional use with respect to the availability of adequate municipal water, wastewater treatment, and storm water control facilities. Findings. The subject property is suitable for the intended conditional use with respect to the sewer and water standard. The subject property is served by municipal water, sanitary sewer and storm water control services. G. Traffic and Parking Standard. The availability of the subject property for the intended conditional use with respect to the provision of safe and efficient on-site and off-site vehicular circulation designed to minimize traffic congestion. 3 Findings of Fact Zoning and Subdivision Hearing Board Petition 35-02 August 21, 2002 Findings. The subject property is suitable for the intended conditional use with respect to the traffic and parking standard. The subject property is located at the southeast corner of Kimball Street and Douglas Avenue. Kimball Street is an arterial street serving the east side of Elgin. Douglas Avenue is a local street serving the downtown and the adjoining residential neighborhoods. Parking will be provided in conformance with the requirements of the zoning ordinance. Within the CC2 Zoning District, land uses located within 800 feet of a municipal off street parking facility are not required to provide off street parking. The new city-owned parking garage is located 400 feet from the subject property. H. Location, Design, and Operation Standard. The suitability of the subject property for the intended conditional use with respect to it being located, designed, and operated so as to promote the purpose and intent of this title and chapter. Findings. The subject property is suitable for the intended conditional use with respect to it being located, designed, and operated so as to promote the purpose and intent of the zoning ordinance. No evidence has been submitted or found that the proposed conditional use will be located, designed, or operated in a manner that will exercise undue detrimental influence on itself or surrounding property. Additionally, entertainment uses such as the one proposed have been identified as desirable land uses within the downtown area. SUMMARY OF FINDINGS,UNRESOLVED ISSUES, AND ALTERNATIVES The Zoning and Subdivision Hearing Board has developed or identified the following findings, unresolved issues, and alternatives: A. Summary of Findings. 1. Positive Attributes. The proposed nightclub would help expand the variety of entertainment options available within the downtown. 2. Location, Design, and Operation. No evidence has been submitted or found that the proposed conditional use will be located, designed, or operated in a manner that will exercise undue detrimental influence on itself or surrounding property. Additionally, entertainment uses such as the one proposed have been identified as desirable land uses within the downtown area. 4 Findings of Fact Zoning and Subdivision Hearing Board Petition 35-02 August 21, 2002 B. Summary of Unresolved Issues. There are no unresolved issues. C. Summary of Alternatives. Other than approval, denial, or an approval with some combination of conditions, there are no substantive alternatives. RECOMMENDATION The Zoning and Subdivision Hearing Board hereby recommends the approval of Petition 35-02. On a motion to approve the requested variation, subject to the following conditions, the vote was five (5) yes and zero (0) no: 1. Substantial conformance to the Statement of Purpose and Conformance submitted by Anthony L. Nance, undated. 2. Substantial conformance to the site plan and floor plan, undated. 3. The outdoor eating and drinking facility shall be enclosed by a fence subject to approval by the Community Development Group. 4. The easterly side of the outdoor eating and drinking facility shall be finished with a retaining wall and landscaping as approved by the Community Development Group. 5. All gravel on site shall be removed and landscaped with either seed or sod. 6. Compliance with all other applicable codes and ordinances. We would like to open a classy Jazz,Blues, restaurant at 231 Douglas Ave,Elgin. The Business would be operated by the husband and wife team of Anthony and Bettie Nance. Our plan is to bring cultural diversity to downtown Elgin by catering to mature adults in a classy atmosphere in a professionally run establishment. This will help attract more business to the downtown area and also give those professionals working in the downtown area a place to socialize after work. We plan to have a strictly enforced dress code. Neat dress required no jeans, no athletic wear,no tennis shoes. We are planning to serve a ratio of 50/50 food and drinks. Food served would consist a variety of sandwiches and finger foods, with a specialty of Anthony's famous rib's, sample menu attached. Alcoholic beverages would be served consisting of Wine,Mixed Drinks, and Beer. Entertainment would consist of a mixture of local area artist performing Jazz,Blues and R &B music and recorded music. Hours of operation to start would be Wednesday through Saturday from 5:00 pm to 1:00 am. We plan on a 50/50 ratio of food and beverage sales. The kitchen hours will be from open to 12:00 am closing one hour before restaurant closes. We are also considering a lunch schedule. Lunch to be available from 11:00 am to 2:00 pm Monday through Friday. We plan on staffing the restaurant with a staff of bartenders, wait staff, security, cooks, and helpers. HI A. Site Characteristics The building is located in an area that is currently being renovated as part of the city master plan. Additionally, it is across the street from the upcoming Elgin Sports complex. B. Sewer and Water The building currently has sewer and water connections. C. Traffic and Parking -currently there are approximately 60 parking spaces around the building,the building is about 50 yards from the new parking garage at Symphony Way and Douglas Ave. -231 Douglas is on the corner of Douglas and Kimball ave.
