I further certify that on August 14, 2002, the Corporate Authorities of such municipality passed and approved Ordinance No. G55-02, which provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. G55-02, including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the municipal building commencing on August 16, 2002, and continuing for at least ten days thereafter. G55-02 AN ORDINANCE AMENDING CHAPTER 2 . 20 OF THE ELGIN MUNICIPAL CODE, 1976 , AS AMENDED, ENTITLED "RESIDENCY REQUIREMENTS FOR CITY OFFICERS" WHEREAS, the City of Elgin, Illinois, is a home rule unit pursuant to the Constitution of the State of Illinois; and WHEREAS, as a home rule unit the City of Elgin may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, residency requirements for appointed City of Elgin officers and employees pertains to the government and affairs of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Chapter 2 . 20 of the Elgin Municipal Code, 1976 , as amended, entitled "Residency Requirements for City Officers" , be and is hereby further amended in its entirety to read as follows : III "Chapter 2 . 20 RESIDENCY REQUIREMENTS FOR CITY OFFICERS 2 . 20 . 010 DEFINITIONS : For the purposes of interpreting and construing this Chapter the following definitions shall be applied: BONA FIDE RESIDENCE : A permanent domicile which has not been adopted with the intention of again taking up or claiming a previous residence outside the corporate city limits of the City of Elgin. 2 . 20 . 020 RESIDENCY REQUIRED: The following listing of full time officers and employees, employed now or hereinafter by the City, shall be required as a condition of their continued employment to maintain their bona fide residence and their principal place of abode within the corporate city limits of the City of Elgin: City Manager, Corporation Counsel , Fire Chief, Police Chief, Assistant City Managers, Community Development Manager, Fiscal Services Manager, General Services Manager, Finance Director, Planning and Neighborhood Services Director, Human Resources Director, Code Administration and Development Services Director, Economic Development and Business Services Director, tow Parks and Recreation Director, Public Works Director, Water Director, MIS Manager, Police Deputy Chiefs, Fire Deputy Chiefs, Purchasing/Risk Management Director, Building Maintenance Director and City Clerk. 2 . 20 . 030 ESTABLISHMENT: All full-time officers and employees of the City named in this Chapter shall establish residency within eighteen (18) months following original appointment whether or not probationary, or employment or promotion to an office or position for which a different residence is required by this Chapter. Extensions of time in which to establish residency, or temporary exceptions to residency as required by this Chapter, may be granted in the discretion of the City Manager for a period not to exceed an additional six (6) months, upon written application and a hearing, where there are practical difficulties or particular hardship, in establishing residency within the time provided or in maintaining residency as otherwise provided. 2 . 20 . 040 GENERAL PROVISIONS : rThe provisions of this Chapter shall be in lieu of and shall supersede the provisions of 65 ILCS 5/3 . 1-10-6, as amended. " Section 2 . That all ordinances or parts of ordinance in conflict with the provisions of this ordinance be and are hereby repealed. Section 3 .
