HomeMy WebLinkAboutG41-02 (2) Ordinance No. G41-02 AN ORDINANCE AMENDING CHAPTER 2 . 56 ENTITLED "PART-TIME POLICE OFFICER" AND CHAPTER 2 . 57 ENTITLED "AUXILIARY POLICE OFFICER" OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Section 2 . 56 . 010 entitled "Offices ; Established" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows : "2 . 56 . 010 : OFFICES; ESTABLISHED: There is established the office of part-time police officer. Part-time police officers shall be appointed by the City Manager in such numbers as the corporate authorities shall from time to time deem necessary, which office shall be subject to the provisions of 65 Illinois Compiled Statutes 5/3 . 1-30-21 , and 50 Illinois Compiled Statutes 705/8 . 2 , as amended, except as otherwise provided herein. " Section 2 . That Section 2 . 56 . 020 entitled "Offices; Term" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows : "2 . 56 . 020 : OFFICES; TERM: Part-time police officers shall serve at the discretion of the City Manager and may be removed from office at the will of the City Manager. Part-time police officers shall receive such hourly compensation for their services as shall be determined by the corporate authorities . " Section 3 . That Section 2 . 57 . 010 entitled "Offices ; Established" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows : "2 . 57 . 010 : OFFICES; ESTABLISHED: There is established the office of auxiliary police officer. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 6 . BACKGROUND The Police Department utilizes part-time and auxiliary officers to assist with operations . They are used to provide security at City rHall, the Hemmens, the Library, and in situations to supplement other resources related to traffic matters for some special events . They are not used to permanently replace full time officers for regular duty or to reduce overtime opportunities for full time officers as this is prohibited in the PB PA Unit 54 contract . There are currently 15 positions authorized in the City of Elgin Police Department budget . The training standards are established under State Law for part-time officers, and are similar to the standards for full time officers . The Police Department has applied for accreditation with the Commission on Accreditation for Law Enforcement Agencies (CALEA) . The process is ongoing with policy development . The Police Department is reviewing and updating all policies to include the hiring standards related to any part-time or auxiliary officers . The standard requires that part time members be filled through a selection process based on skills, knowledge and ability for the assignment to include education, experience and special skills . The existing ordinance provides for these positions to be filled through a Mayoral appointment, not including a selection process similar to that for full time officers . The amendment has been requested to comply with the CALEA standard and utilize the same standards for hiring part-time and auxiliary officers that are used for full time officers . eft. The bulk of this time will be incurred by the Police Department using existing personnel to handle the background investigations and interviews . Part-time and auxiliary positions are budgeted in account 090-2311-731 . 01-04 with sufficient funding existing. tooliLEGAL IMPACT None ALTERNATIVES 1 . The City Council could reject the amendment and keep the current ordinance . em. 2 . Discontinue hiring any new part-time and auxiliary officers. RECOMMENDATION It is recommended that the City Council approve the proposed ordinance change regarding Part-time and Auxiliary Police Officers .
