HomeMy WebLinkAboutG28-02 (2) Ordinance No. G28-02 AN ORDINANCE AMENDING CHAPTER 6 . 66 ENTITLED "TAXICABS" OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6 . 66 . 010 thereof entitled "Definitions" to read as follows : "6 . 66 . 010 DEFINITIONS Unless otherwise stated, the following terms shall, for the purpose of this Chapter be construed as defined in this section. "Inspection Station" shall mean a facility approved by the Chief of Police to conduct inspections as required by this Article . "Person" includes individuals, firms, partnerships and corporations having an individual or common ownership of vehicles, equipment and facilities used in the operation of a taxicab business. "Taxicab" shall mean all motor propelled vehicles, carrying passengers for hire, indiscriminately accepting and discharging all such persons as may offer themselves for transportation. "Taxicab Stand" shall mean any place, public or private, where taxicabs are placed on display and presented for hire to prospective customers . "Taximeter" shall mean a mechanical, electro-mechanical, or electronic device which records or indicates a charge or fare measured by distance traveled, waiting time, and extra passengers . "Waiting Time" shall mean time when the taxicab is not in motion, beginning with the arrival at the place to which it has been called, or the time consumed while standing at the direction of the passenger. No charge shall be made for time lost due to inefficiency of the taxicab or 1 its operator or time consumed by a premature response to a call . " Section 2 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Subsection B of Section 6 . 66 . 020 thereof entitled "Owners' and Operations' Licenses Required" to read as follows : "B. No person shall operate or drive a taxicab in the city unless such taxicab is registered under a city owner' s license as herein required; and such person has first obtained an appropriate license to transport persons for compensation from the State; a certification of inspection as required by this Chapter; and bond as required by this Chapter, and registered such license, certification and bond with the Finance Department, and obtained a city license sticker. Such license stickers shall be issued by the Fiscal Services Manager for each calendar year on application therefor, upon payment of an annual registration fee of ten dollars ($10 . 00) . " Section 3 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6 . 66 . 040 thereof entitled "Rates of Fare; Filing" to read as follows : "6 . 66 . 040 RATES OF FARE; FILING Rates of fare for taxicabs shall be filed with the Fiscal Services Manager prior to January 15 of each calendar year. Such rates shall be available for inspection and copying at the office of the Fiscal Services Manager. No rates shall be charged expect in conformance with this section. " Section 4 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6 . 66 . 060 thereof entitled "Evidence of License, Payment to be Displayed" to read as follows : "6 . 66 . 060 EVIDENCE OF LICENSE PAYMENT TO BE DISPLAYED There shall be displayed upon each taxicab licensed under this Chapter such evidence of payment of the license fee as may be furnished by the Finance Department upon payment of the annual owner' s license fee. The owner' s 2 license shall not be transferable, provided however, in the event of a substitution of vehicles at any time during the license period, upon application to the Fiscal Services Department, evidence of registration of the substituted vehicle will be furnished upon the payment of a fee of fifty cents ($0 . 50) for each such substitution. " Section 5 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6 . 66 . 090 thereof entitled "Passengers" to read as follows : "6 . 66 . 090 PASSENGERS No person shall occupy any taxicab in excess of the seating capacity of such vehicle at anytime . It shall be the duty of the operator of such taxicab not to permit any persons in excess of the seating capacity of such taxicab to be in the taxicab under his control at any time. No more than one passenger may occupy the front seat of a taxicab and then only when there are more than three (3) passengers occupying the taxicab. No operator shall refuse a fare based on the requested destination. " Section 6 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6 . 66 . 130 thereof entitled "Bond" to read as follows : "6 . 66 . 130 BOND No person shall operate or permit to be operated upon the streets or other places in the city any taxicab unless there is in full force and effect, and duly filed in the office of the Fiscal Services Department, a proper bond with sureties approved by the City Council, or a policy of liability insurance providing for the payment and satisfaction of any judgment rendered against the owner or any person operating such vehicle with the owner' s implied or express consent, as a result of the operation of such vehicle . Such bond or insurance policy shall be in not less than the following aggregate amounts for each single occurrence : two hundred fifty thousand dollars ($250 , 000 . 00) for injury or death to one person, five hundred thousand dollars ($500, 000 . 00) for injury or death to two (2) or more persons, and fifty thousand dollars ($50, 000 . 00) for property damage. " 3 Section 7 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6 . 66 . 150 thereof entitled "Inspection" to read as follows : "6 . 66 . 150 INSPECTION A. All public passenger vehicles licensed in the city shall be inspected in January and July each year, at a city approved vehicle inspection station. B. A copy of the approved inspection from a vehicle inspection station shall be given to the Traffic Investigations Unit before an inspection of the meter will be done . Meters shall be inspected by Traffic Investigations Unit personnel by completing a mile run, to and from the beginning point to ensure the meter is accurate, at which point, the taximeter shall be sealed. C. Any vehicle failing to pass the inspection shall be allowed ten (10) working days for repairs . Such failing vehicles shall not be used as public passenger vehicles for hire until repairs are completed and the vehicle passes a reinspection. If the vehicle does not pass reinspection within thirty (30) working days, the vehicle license may be suspended. D. A list of approved inspection stations shall be available to each public passenger vehicle owner. An owner may use the approved inspection station of his choice; however, if a vehicle fails an inspection, once repairs are made, the vehicle must be reinspected at the same inspection station. E. Public Passenger Vehicle Owners that have taxis inspected by outside police agencies, as part of their city' s requirements, shall be accepted as a proper inspection. " Section 8 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6 . 66 . 170 thereof entitled "Application" to read as follows : 4 "6 . 66 . 170 APPLICATION Persons seeking a license to operate a taxicab pursuant to the provisions of this Chapter shall submit an application to the Fiscal Services Department on the form supplied by and containing such information as may be required by the Fiscal Services Department . The Fiscal Services Department shall issue such licenses or provide a written denial of such applications within thirty (30) days of their submission. Any denial shall state the reasons for the denial, and shall inform the applicant that the applicant may appeal the denial by submitting such appeal in writing to the Fiscal Services Manager within fifteen (15) days of the date of the denial . " Section 9 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6 . 66 . 180 thereof entitled "Application Criteria" to read as follows : "6 . 66 . 180 APPLICATION CRITERIA The designee of the Fiscal Services Manager shall deny the applications of persons who are not licensed and otherwise qualified to provide taxicab services pursuant to the laws of the State and of the United States . Probationary licenses and temporary or judicial driving permits shall not be sufficient to obtain a taxicab license . The designee of the Fiscal Services Manager may deny applications for taxicab licenses or revoke taxicab licenses based upon a reasonable evaluation of the risk to the physical safety of the public which would be created by the granting of such licenses . Such an evaluation resulting in a denial of an application shall be based upon the conviction of the applicant or any violent or armed felony within five (5) years of the date of application, or of any drug or controlled substance felony conviction within one year of the date of application. Revocations shall be based upon such convictions during the period of the subject taxicab license' s effectiveness . " Section 10 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6 . 66 . 190 thereof entitled "Appeals" to read as follows : 5 "6 . 66 . 190 APPEALS Any person who has been denied a license pursuant to the provisions of this Chapter may appeal such denial to the Fiscal Services Manager within fifteen (15) days of the date of such denial . Such persons shall be provided an opportunity to provide reasonable evidence that the granting of a taxicab license to them will not pose an unreasonable risk to the physical safety of the public. Based upon the receipt of such evidence, the Fiscal Services Manager may issue a taxicab license to the applicant in the Fiscal Services Manager' s sole discretion. The Fiscal Services Manager shall issue a license or a denial of any appeal within fifteen (15) days of such appeal . Any denial of an appeal shall be in writing, and shall state the findings of the Fiscal Services Manager and the reasons for such denial . " Section 11 . That Chapter 6 . 66 entitled "Taxicabs" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by adding a new Section 6 . 66 . 200 thereto entitled "Penalty for Violation" to read as follows : "6 . 66 . 200 PENALTY FOR VIOLATION A. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this Chapter, shall be guilty of an offense . Any person convicted of an offense under this Chapter, in addition to other legal and equitable remedies available to the city, shall be punished by a fine of not less than Fifty Dollars ($50) nor more than Five Hundred Dollars ($500) . B. Any person shall be guilty of a separate offense for each and every day during any portion of which any violation or provision of this Chapter is committed, continued or permitted by any such person and he shall be punished accordingly. C. The levy and/or payment of any penalty or fine in this Chapter shall not be deemed a waiver of the power of the City of Elgin to suspend, revoke or refuse to renew any license otherwise issued by the City of Elgin. " 6 Section 12 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 13 . BACKGROUND There has been a steady increase in the use of public passenger vehicles over the last several years . The Police Department does not have mechanics that are qualified to perform vehicle inspections to certify vehicle safety or mechanical stability. They also cannot verify taxi meter accuracy or seal the taxi meters . It is therefore desirable to transfer this responsibility to certified mechanics and certified Inspection Stations . This can be accomplished by adding the following definitions : A. 1 "Inspection Station" shall mean facility as approved and designated by the Chief of Police to conduct inspections as required by this Article . A.2 "Certified Mechanic" shall mean any mechanic or technician who has submitted to and passed an examination given by the National Institute for Automotive Service Excellence (ASE) and granted a certification by the Institute . Other changes include : D. l-6 Requiring all licensed cabs to be inspected three times per year at an approved inspection station; and providing what the inspection shall include; what shall occur if the vehicle fails to pass inspection; who shall designate approved inspection facilities and where they are to be located; what occurs should a vehicle fail the inspection, and the institution of a fee for the inspection. This section also provides for the certification and sealing of the taxi meter. C Amendments to Taxi Ordinance March 8, 2002 Page 2 E. 1 Describes taxicab markings that shall be permanently affixed to the vehicle . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED The following taxi companies were invited to a meeting to discuss the proposed ordinance changes : A1, Taxi Leon, USA Taxi , Allstar Taxi, Taxi Mexico, Yellow Cab, Alex Cab, and Lakeview Taxi . Changes suggested at the meeting were incorporated into the amended ordinance. FINANCIAL IMPACT Fees received by the City and the established rates used by the taxi companies will remain the same. There is currently no charge for the inspection, but only the license fee of $25 per taxi . The only additional cost is to the taxi companies for vehicle inspections, anticipated to be approximately $25 per taxi . The City collected $4, 462 . 50 in taxi license fees in 2001 . V\OVAGAL IMPACT None . ALTERNATIVES The City Council may chose not to amend the ordinance and the Police Department will continue to inspect taxi cabs . RECOMMENDATION It is recommended that the City Council approve the amended taxi ordinance and direct implementation. Definitions - Unless otherwise stated, the following terms shall, for the purpose of this article, have the meanings indicated in this section. 1. "Inspection Station" shall mean a facility approved by the Chief of Police to conduct inspections as required by this Article. 2. "Livery Vehicle" shall mean any public passenger vehicle transporting passengers for hire, as a result of an individual contract, on a trip or hourly basis. 3. "Public Passenger Vehicle Owner" shall mean any person, Firm or Corporation owning a public passenger vehicle for hire. 4. "Public Passenger Vehicle" shall mean taxicabs and livery vehicles used for transporting persons for hire. 5. "Public Passenger Vehicle Chauffeur" shall mean any person who drives a public passenger vehicle for the transportation of persons for compensation. 6. "Taxicab" shall mean all motor propelled vehicles, carrying passengers for hire, indiscriminately accepting and discharging all such persons as may offer themselves for transportation. 7. "Taxicab Stand" shall mean any place, public or private, where taxicabs are placed on display and presented for hire to prospective customers. 8. "Taximeter" shall mean a mechanical, electro-mechanical, or electronic device which records or indicates a charge or fare measured by distance traveled, waiting time, and extra passengers. 9. "Waiting Time" shall mean time when the taxicab is not in motion, beginning with the arrival at the place to which it has been called, or the time consumed while standing at the direction of the passenger. Public Passenger Business Owner Requirements 1. No person shall use or occupy any street, alley or other public place in the city for the purpose of conducting a business for the transportation of persons for hire in taxicabs, unless they shall have first obtained a license therefor for each such taxicab, as provided and required in this section. For Each Calender Year or Part Thereof : One Taxicab $100.00 Two Taxicabs $200.00 Each Taxicab in excess of two $25.00 a. There shall be displayed upon each taxicab licensed under this chapter such evidence of payment of the license fee as may rk be furnished by the city clerk upon payment of the annual owner's license fee. The owner's license shall not be transferable, provided however, in the event of a substitution of vehicles at any time during the license period, upon application to the city clerk, evidence of registration of the substituted vehicle will be furnished upon the payment of a fee of 50 cents for each substitution. b. Applications for public passenger vehicle license shall be made by the vehicle owner upon forms furnished by the City. A separate application and license is required for each vehicle to be operated in the City, with up to five vehicles per application. Such applications shall contain the full name and address of the Public Passenger Business Owner, a complete description of the vehicle, including make, model, state license plate number, color of vehicle and/or other data as the City 2 may require. r'mk' c. The City Clerk shall issue a public passenger vehicle license after the vehicle has passed the inspection as required by this article. 2. No taxicab shall park on any public street or place except in compliance with the general traffic ordinances of the city or in places designated as cab stands by the Chief of Police by and with the approval of the City Council. a. No person operating or controlling a taxicab shall permit such taxicab to remain in a cab stand for more than sixty consecutive minutes. The operator of such taxicab shall be in attendance at all times such cab remains in a stand. b. It is unlawful for any person operating or controlling a taxicab to use or permit such taxicab to be used for the transportation or delivery at any place in the city of alcoholic beverages either as the agent of the seller of such beverages or as the agent of the purchaser thereof. 3. The Public Passenger Business Owner shall provide locations of the proposed depots and terminals. a. The Public Passenger Business Owner shall provide a list of drivers, along with each drivers driver's license number to the Elgin Police Department Traffic Investigations Unit, bi- annually. 4. No public passenger vehicle may operate in the City without proof of insurance in the amounts as required by this code. This minimum coverage shall be: Not less than $250,000 per personal injury to one person and not less than $250,000 per incident. 5. Every public passenger vehicle business owner shall keep in service at all times while his license is in effect, regular telephone service 3 within the City, by means of which a person desiring to hire a public passenger vehicle may call the business. The business owner shall cause the telephone number to be listed in a local or regional telephone directory which is published for the municipality by the telephone company which furnishes local telephone service in the municipality. 6. Every public passenger business owner shall operate every public passenger vehicle regularly in the City to the extent reasonably necessary to meet the public demands for passenger service. They shall maintain a system for the purpose of receiving calls and dispatching vehicles. They shall answer all calls received by them for service within the City as soon as possible. Anyone who shall refuse to accept a call anywhere within the City, for the purpose of discrimination, at any time where there are vehicles available, or who shall refuse to give overall service, shall be deemed in violation of this Article. C. Inspection 1. All public passenger vehicles licensed in the City are required to be inspected in January and July each calender year, at a City approved vehicle inspection station. 2. A copy of the approved inspection from a vehicle inspection station shall be given to the Traffic Investigations Unit before an inspection of the meter will be done. Such non-complying vehicles shall not be used as a public passenger vehicles for hire until repairs are completed and the vehicle passes a reinspection. A list of the approved inspection stations shall be available at the City Hall and shall be given to each public passenger vehicle owner with the notice of required inspection. An owner may use the approved inspection station of his choice; however, if a vehicle fails an inspection, once repairs are made, the vehicle must be reinspected at the same inspection station. 5. Public Passenger Vehicle Owners that have taxi's inspected by outside Police agencies, as part of their City's requirements, will be accepted as a proper inspection. 6. The inspection stations shall charge a fee as approved by the City Manager for each public passenger vehicle inspected. D. Vehicle Identification 1. Every taxicab licensed in the City shall bear on both sides of the vehicle, in a color contrasting to the color of the vehicle, the name of the company and its telephone number. The lettering shall be a minimum of two inches (2") in heights and one quarter inch (1/4") brush stroke. Such markings shall be permanently affixed to the vehicle. Magnetic signs or similar materials used to identify the vehicle shall be unacceptable. 2. The identification number assigned to the taxicab by the company shall appear on both exterior sides of the vehicle at a minimum of four inches (4") in height and one quarter inch ('/4') brush stroke and also in a conspicuous place in the passenger area at a minimum of two inches (2") in height. 3. The color scheme or insignia used shall be readily distinguishable from that of emergency vehicles and vehicles previously licensed by public passenger vehicle companies. No taxicab shall be painted or labeled so as to be so similar to the vehicles of any others licensed for business in the City, so as to be an imitation and/or calculated to deceive the patrons of taxicabs into believing that such vehicles are 5 in reality the taxicabs of the other. E. Chauffeur License 1. It shall be unlawful for any person to operate any public passenger vehicle for hire within the City without first having obtained a valid public passenger vehicle chauffeur's license from the City. 2. It shall be unlawful for any person owning or controlling any public passenger vehicle to permit any person to operate such vehicle for hire within the City unless such driver has a valid public passenger vehicle chauffeur's license issued by the City. 3. The application for a license for a public passenger vehicle chauffeur shall contain the name of the applicant, his residence, current employer, status of his current Illinois driver's license and the license number, whether his driver's license has ever been suspended, cancelled or revoked, and if so, why, and a list of convictions, if any, for violation of federal, state, or municipal laws. 4. Applicants are subject to the following qualifications: a. Shall be no less than eighteen (18) years of age. b. Must hold a valid Illinois driver's license. c. Must not have been convicted of a violent or armed felony within the past 5 years of the date of application, or of any drug or controlled substance felony conviction within one year of the date of application. d. Must not have had his driver's license suspended or revoked in any state within the past 3 years as a result of violations of law concerning the operation of motor vehicles. 5. The Chief of Police shall cause an investigation to be conducted of each applicant, to include fingerprinting, and a traffic and criminal history. 6. The chauffeur's license shall be displayed at all times in the public passenger vehicle in plain view of the passenger. 7. It shall be unlawful to transfer any public passenger vehicle 6 chauffeur's license from one person to another. 8. A public passenger vehicle chauffeur's license may be suspended for a period not to exceed thirty (30) days, or revoked for any failure or refusal to comply with the provisions of this Article, or upon a determination that said license was obtained fraudulently, or upon determination that the license owner has become physically or mentally unfit to perform his duties as a public passenger vehicle chauffeur, or that there has been fraudulent use of the public passenger vehicle chauffeur's license by, or with consent of the license owner. The Public Passenger Vehicle Owner shall be notified of any suspension or revocation of a Public Passenger Vehicle Chauffeur's license if applicable. F. Public Passenger Vehicle Operation 1. No operator of a public passenger vehicle shall carry a passenger load, in excess of the manufacturer recommended capacity, including the driver. 2. After a public passenger vehicle has been hired by one or more persons traveling together, the operator shall not pick up other persons without the expressed permission of the person(s)first hiring the public passenger vehicle. An appropriate sign shall be posted indicating the restrictions on share rides. 3. No driver of a public passenger vehicle shall seek business by repeatedly or persistently driving his vehicle to and from in a short space before any theater, hotel, motel, railway station, or other public place or otherwise interfere with the proper and orderly access to or egress from any such place. 4. The operator of any taxicab may, in advance, demand payment of the fare from the person(s) desiring to be carried by such taxicab. The operator may also refuse to convey any persons(s)who shall not comply with the demand; however, no operator shall refuse or neglect rik to convey any orderly person, upon request, unless previously 7 engaged or unable to do so. 5. Subject to the conditions and limitations of this Article, permission and authority are hereby granted to the business owners hereunder to operate the taxicabs licensed in the City upon the public streets and other public ways within the City unless terminated or revoked. It shall be unlawful for any public passenger vehicle not licensed by the City to solicit business in the City, or to accept for transportation any passengers within the City. 6. Nothing in this Article shall be construed to prohibit any public passenger vehicle from coming into the City to discharge passengers accepted for transportation outside of the City. No person shall solicit business from any place in the City unless that person and vehicle is licensed in the City. G. Taxicab Rates- Rates of compensation may be set by an owner or operator of a taxicab and such rates shall be typed on business letterhead and filed on or before January 10th yearly with the City Clerk. Any changes in taxicab rates must be filed at least 30 days prior to implementation. H. Posting Established Rates - There shall be affixed inside each taxicab in a place conspicuous to any person riding in such taxicab a rate card, printed in plain, legible type, the rates of fare and photo identification of passenger vehicle chauffeur which is to be posted above the middle pillar on the passenger side of the vehicle. Taximeters 1. No taxicab shall operate with passengers for hire unless the taximeter is accurately recording the fare to be charged, and the taximeter has been inspected and sealed, unless an Airport flat rate is pre- established. 2. The taximeter shall be located so that its face can be seen by a passenger from the rear compartment of the vehicle. 3. Adequate lighting facilities shall be provided for illuminating the face of the taximeter so that it may be read by the passenger whenever the 8 vehicle is in operation. J. Fixing of Rates Prohibited - It shall be unlawful for any person, firm, or corporation licensed under the provision of this Article to conspire among themselves or with other persons to fix or control rates for taxicab hire within the City. It is the purpose of this Article to provide for free and uncontrolled rates. Any scheme, device, or other subterfuge employed by any business owner to evade this purpose shall be deemed to be in violation of this Article. K. Operation of Livery Vehicles - 1. Livery vehicles shall not pick up or solicit passengers for hire from the streets. 2. Livery vehicles shall not park in taxicab stands. 3. Livery vehicles shall be limited in their scope of operation to carrying passengers for hire on a contract basis at a price agreed upon prior to employment and by arrangement of the parties at the time of initial contract by the customer to the livery company. Section 2: That any person, firm, or corporation guilty of violating any of the provisions of this Ordinance shall be fined not less than Ten Dollars ($10.00) nor more than Five Hundred Dollars ($500.00). Section 3: That the City Clerk is hereby authorized to publish this ordinance in pamphlet form. Section 4: That this ordinance shall be in full force and effect 10 days from and after its passage, approval, and publication as provided by law. 9 01.
