The pamphlet form of Ordinance No. G22-02, including the Ordinance and
a cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the
municipal building commencing on March 29, 2002, and continuing for at least ten days
rk thereafter. Copies of such Ordinance were also available for public inspection upon
request in the office of the municipal clerk.

Ordinance No. G22-02
AN ORDINANCE
AMENDING CHAPTER 11 . 60 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED "STOPPING, STANDING AND PARKING"
WHEREAS, the City Council of the City of Elgin has determined
it is necessary and desirable to amend the ordinance provisions
regulating the parking of motor vehicles; and
WHEREAS, the City of Elgin is a home rule municipality as
defined in Article VII , Section 6A of the 1970 Constitution of the
State of Illinois; and
WHEREAS, a home rule unit may exercise any power and perform
any function pertaining to its government and affairs; and
WHEREAS, the regulation of motor vehicles on the streets and
highways within the municipality pertains to the government and
affairs of the City of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS :
Section 1 . That Chapter 11 . 04 , entitled "Definitions" of the
Elgin Municipal Code, 1976, as amended, be and is hereby amended to
amend Section 11 . 04 . 010 to read as follows :
"11 . 04 . 010 : DEFINITIONS :
Except as hereinafter stated and unless a different
meaning of a term is clear from its context, the
definition of the terms used in this Title shall be
defined as provided by the Illinois Vehicle Code (625
ILCS 5/100 et seq. ) , as amended.
A. DRIVEWAY: The way of vehicular access from a public
or private right-of-way or street to a parking
structure, a parking lot, a parking aisle, a
parking garage, or a residential parking area.
B. FIRE LANE : Every public way or place in private
ownership used expressly for vehicular travel by
emergency equipment and marked as such by signs or
pavement markings . "
Section 2 . That Chapter 11 . 60 , entitled "Stopping,
Standing and Parking" of the Elgin Municipal Code, 1976, as
amended, be and is hereby amended by amending Section
11 . 60 . 050F, entitled "Stopping, Standing, Parking Prohibited
Where, " to read as follows :
"Within twenty (20) feet of any intersection or
crosswalk. "
Section 3 . That Chapter 11 . 60 , entitled "Stopping, Standing
and Parking" of the Elgin Municipal Code, 1976, as amended, be and
is hereby amended by amending Section 11 . 60 . 050I , entitled
"Stopping, Standing, Parking Prohibited Where, " to read as
follows :
"At any place where the parking or standing of any
vehicle will prevent full use of any driveway, alley or
fire lane . Full use shall be prevented if any vehicle is
parked or standing less than three (3) feet in a
residential area and eight (8) feet in a commercial area
from the point where the curb line meets an imaginary
line which constitutes an extension of the boundary of
the driveway, alley or fire lane at its narrowest point . "
Section 4 . That Chapter 11 . 60 , entitled "Stopping, Standing
and Parking" of the Elgin Municipal Code, 1976, as amended, be and
is hereby amended by amending Section 11 . 60 . 065, entitled
"Stopping, Standing or Parking Prohibited on Private Property" to
read as follows :
"By written agreement with the city pursuant to Section
11-209 or 11-209 . 1 of the Illinois Vehicle Code, as
amended (625 ILCS 5/11-209 and 5/11-209 . 1) , the following
regulations are established for the private properties
described below.
A. Fire Lanes . Fire lanes are established on the
private property described below subject to
compliance with the regulations set forth in this
subsection:
1. The property owner shall erect, install and
maintain not less than two appropriate signs
designating the fire lane . Each sign shall include
the words "No Parking Fire Lane" followed by the
words "Tow Zone .
2. The property owner shall designate the fire lane
with bright yellow painted lines and the words
"Fire Lane No Parking. " The property owner shall
maintain the painted areas in a clear and legible
condition.
r► 3. The standing or parking of any vehicle in such a
manner so as to block or obstruct any such
designated fire lane shall be prohibited.
4. The city, pursuant to said written agreement, is
authorized and empowered to cause vehicles
violating the prohibitions of said written
agreement to be ticketed, removed, towed and stored
pending payment by the vehicles registered owner
for the costs of removing, towing and storing such
vehicle .
5. Designated Fire Lanes :
a. Plymouth Lane within the Tyler Towers
Condominium complex.
b. The campus of Elgin Community College;
c. Within the Poplar Creek subdivision on Spruce
Lane, Spruce Court, Hemlock Lane, Hemlock
Court, Apple Lane, Peach Tree Lane, Peach Tree
Court;
eft d. Within the Huntington Park subdivision on the
east side of Spruce Lane, the south side of
Rosemont Lane, and the west side of Apple Lane
from Peach Tree Lane to Spruce Lane;
e. The grounds of St . Joseph Hospital ;
f. Within the Tyler Creek Plaza shopping center
parking lot located at the northeast corner of
Big Timber and McLean Boulevard;
g. Upon property owned by the Elgin housing
authority;
h. The grounds of Sherman Hospital ;
i. Garden Quarter complex.
j. Sandy Creek Condominium complex;
k. Waverly Commons Condominium complex.
�w 1. Regency South Condominium complex.
C m. Elgin Bethesda Church of God in Christ .
r n. Within the parking lot of the Jewel/Osco
located at 1660 Larkin Avenue immediately
south and adjacent to the store;
o. Within the parking lot of the Jewel/Osco
located at 1040 Summit Street immediately
south and adjacent to the store .
B. No Parking. No parking shall be permitted on the
following private property:
1 . Both sides of Plymouth Court south from McLean
Boulevard to its end.
C. No Parking Without Permit . No parking shall be allowed in
the Fulton Street Parking Lot, located at the northeast
corner of the Fulton Street and Spring Street
intersection, Mondays through Fridays from 7 : 00 a.m. to
8 : 00 p.m. unless a vehicle is displaying a current Elgin
Community College staff, temporary staff, or handicapped
student parking sticker. "
Section 5 . That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are hereby
repealed.
Section 6 . That this ordinance shall be in full force and
effect upon its passage and publication in the manner provided by
law. /
