AN ORDINANCE
RECLASSIFYING PROPERTY FROM CC2 CENTER CITY DISTRICT TO
PCC2 PLANNED CENTER CITY DISTRICT
(1-95 Clock Tower Plaza)
WHEREAS, written application has been made to reclassify
certain property located at 1-95 Clock Tower Plaza from the CC2
Center City District to the PCC2 Planned Center City District; and
WHEREAS, after due notice in the manner provided by law the
Planning and Development Commission conducted a public hearing
concerning said application and has submitted its written findings
and recommendations; and
WHEREAS, the City Council of the City of Elgin, Illinois, has
reviewed the findings and recommendations of the Planning and
Development Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS :
Section 1 . That Chapter 19 . 07, Section 19 . 07 . 600 entitled
rm. "Zoning District Map" of the Elgin Municipal Code, 1976, as
amended, be and the same is hereby further amended by adding
thereto the following paragraph:
"The boundaries herein before laid out in the
`Zoning District Map' , as amended, be and are hereby
altered by including in the PCC2 Planned Center City
District, the following described property:

Section 2 . That the City Council of the City of Elgin hereby
grants the PCC2 Planned Center City District which shall be
/w- designed, developed, and operated subject to the following
provisions :
A. Purpose and Intent. The purpose of this PCC2 Planned
Center City District is to facilitate the implementation
of the official comprehensive plan for the center city,
as focused on a distinctive subarea of the city with a
common urban fabric . This PCC2 Center City District
provides for a concentration of finance, service, retail,
civic, office, and cultural uses, in addition to
complementary uses such as hotels, entertainment and
housing. The development standards are intended to
encourage a mix of activity in the area while providing
for quality development that maintains a sense of
history, human scale and pedestrian-oriented character.
The development standards are intended to promote a
transition between the more intense development in the
CC1 zoning district and the residential neighborhoods
surrounding the center city. "
B. Supplementary Regulations . Any word or phrase contained
herein, followed by the symbol " (SR) " , shall be subject
to the definitions and the additional interpretive
requirements provided in Chapter 19 . 90 , Supplementary
Regulations of the Elgin Municipal Code, 1976, as
amended. The exclusion of such symbol shall not exempt
such word or phrase from the applicable supplementary
regulation.
C. General Provisions . In this PCC2 Center City District,
the use and development of land and structures shall be
subject to the general regulations contained in Chapter
19 . 05 , General Provisions . (Ord. G45-92 § 2 (part) ,
1992 . )
D. Zoning Districts - Generally. In this PCC2 Planned
Center City District, the use and development of land and
structures shall be subject to the provisions of Chapter
19 . 07, Zoning Districts . (Ord. G45-92 § 2 (part) , 1992 . )
E. Location and Size of District. This PCC2 Planned center
City District should be located in conformance to the
official comprehensive plan for the center city. There
shall be no maximum or minimum area of land, which shall
be necessary to constitute the PCC2 Planned Center City
District . (Ord. G45-92 § 2 (part) , 1992 . )
F. Land Use. In this PCC2 Planned Center City District, the
use of land and structures shall be subject to the
provisions of Chapter 19 . 10 , Land Use of the Elgin
Municipal Code, 1976, as amended. The following
enumerated "land uses" [SR] shall be the only land uses
allowed as a "permitted use" [SR] , as a "conditional use"
[SR] , or as a "similar use" [SR] in this PCC2 Planned
Center City District .
A. Permitted Uses. The following enumerated land uses shall
be the only land uses allowed as a permitted use in the
PCC2 Planned Center City District :

G. Site Design. In this PCC2 Planned Center City District,
the use and development of land and structures shall be
subject to the provisions of Chapter 19 . 12 , Site Design,
of the Elgin Zoning Ordinance . In this PCC2 Planned
Center City District, the use and development of land and
structures shall be subject to the provisions of Chapter
19 . 35 . 735, Site Design, (CC2 district) of the Elgin
Zoning Ordinance, as amended. In this PCC2 Planned Center
City District, the use and development of land and
structures shall be according to the above with the
exception of below:
1 . Section 19 . 12 . 300 Zoning Lots - Clarifications and
Exceptions - (E) Principal Buildings per Zoning
Lot. Three principal buildings shall be permitted
on this zoning lot .
2 . Section 19 .35 .735 Site Design - (D) Setbacks -
Generally. The new building shall be set 14 feet
from National Street .
eft In this PCC2 Planned Center City District, the use and
development of land and structures shall also be subject to the
following conditions :
1 . Substantial conformance with Site Plan prepared by
Antonio Fanizza Assoc . Ltd. , dated 9/21/01 and
revised 11/28/01 .
2 . Substantial conformance with the Landscape Plan
prepared by Antonio Fanizza Assoc . Ltd. , dated
9/21/01, except that the plan shall be modified to
provide landscaping in all newly created landscape
islands . Modifications to the landscape plan shall
be subject to approval by the Development
Administrator.
3 . Substantial conformance with the Exterior
Elevations prepared by Antonio Fanizza Assoc .
Ltd. , dated 9/21/01 and revised 11/28/01 .
4 . Provide lighting for the out-lot which is
consistent with the lighting provided in the
existing shopping center.
w 5 . The liquor store shall occupy the southern tenant
space in the new building.
6 . Compliance with all other applicable codes and
ordinances .
�... H. Off Street Parking. In this PCC2 Planned Center City
District, off street parking shall be subject to the
provisions of Chapter 19 . 45, Off Street Parking, of the
Elgin Municipal Code, 1976 , as amended.
I . Off Street Loading. In this PCC2 Planned Center City
District, off-street loading shall be subject to the
provisions of Chapter 19 . 47 , Off Street Loading of the
Elgin Municipal Code, 1976, as amended.
J. Signs. In this PCC2 Planned Center City District, signs
shall be subject to the provisions of Chapter 19 . 50 ,
Signs of the Elgin Municipal Code, 1976, as amended.
K. Planned Developments. In this PCC2 Planned Center City
District, the use and development of the land and
structures shall be subject to the provisions of Chapter
19 . 60, Planned Developments of the Elgin Municipal Code,
1976, as amended.
L. Conditional Uses. In this PCC2 Planned Center City
District, application for conditional uses shall be
subject to the provisions of Chapter 19 . 65 Conditional
Uses of the Elgin Municipal Code, 1976, as amended. A
tow conditional use may be requested by an individual lot or
property owner for a zoning lot without requiring an
amendment to this PCC2 Planned Center City District and
without necessitating that all other property owners
authorize such an application.
Conditional use approval is hereby granted to allow a
carry-out restaurant and a package liquor store with a
check cashing agency to be established in the new 6, 410
square foot multi-tenant building subject to the
conditions listed herein.
M. Variations . In this PCC2 Planned Center City District,
application for variation shall be subject to the
provisions of Chapter 19 . 70, Variations of the Elgin
Municipal Code, 1976, as amended. Any of the requirements
of this ordinance may be varied by petition of a lot or
property owner for a zoning lot without requiring an

N. Appeals. Any requirement, determination, or
interpretation associated with the administration and
enforcement of the provisions of this ordinance may be
appealed subject to the provisions of Chapter 19 . 75,
Appeals of the Elgin Municipal Code, 1976 , as amended.
Section 4 . That this ordinance shall be in full force and
effect immediately after its passage in e manner provided by law.
