AN ORDINANCE
GRANTING A VARIATION OF THE OCCUPATION AND USE OF
FLOOD FRINGE AREA AT 250 WILLARD AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS :
Section 1 . That a variation of the occupation and use of
flood fringe area under Section 21 . 10 . 040 of the Elgin Municipal
Code, 1976, as amended, for the property located at 250 Willard
Avenue and legally described as follows :
First Spates Parcel Including Foundation, . 344 Acres Just
North of Schroeder Parcel . September 13 , 1983
That part of Lot 22 of the County Clerk' s Division
of Unsubdivided Lands in the South % of Section 18 ,
Township 41 North, Range 9 East of the Third Principal
Meridian, described as follows : Commencing at the North
East corner of said Lot 22 , thence South 01 degree 10
minutes 00 seconds West along the East line thereof
323 . 39 feet ; thence North 89 degrees 51 minutes 38
seconds West and parallel with the North line of said
Lot 22 , a distance of 33 . 0 feet to the West line of
Willard Avenue for the point of beginning; thence

be and is hereby granted to permit the replacement of a structure
destroyed by fire, subject to the following conditions :
1 . The owner satisfies any outstanding issues on his
properties east of Willard Avenue prior to the
city' s issuance of a permit for the replacement
structure .
2 . The temporary building, now located at 225 Willard
Avenue, is removed from that address within
�► ninety (90) days of occupancy issuance on the
replacement structure .
3 . For permitting, the owner shall provide to scale
engineering drawings, signed and sealed, of the
entire property (five parcels) clearly showing
existing grades upon the property and the exact
location of the replacement structure .
4 . The owner shall re-establish grades along the
western most fifteen (15) feet of the property to a
grade similar to that west of his property.
5 . Provide the city with a no permit required letter
or a permit issued from the Illinois Department of
Natural Resources - Division of Water Resources .
6 . The applicant agrees not to fill , revise grades or
establish any new structures on any parcel west of
Willard Avenue .
Section 2 . That this ordinance shall be in full force and
effect from and after its passage in the manner provided by law.
