G38-01 AN ORDINANCE CLASSIFYING PROPERTY IN THE ARC ARTERIAL ROAD CORRIDOR OVERLAY DISTRICT ADOPTED BY THE CITY COUNCIL OF THE CITY OF ELGIN ON THIS 13TH DAY OF JUNE 2001 Published in pamphlet form by authority of the City Council of the City of Elgin, Kane and Cook Counties, Illinois, on this 18th day of June 2001. STATE OF ILLINOIS ) ss. COUNTY OF KANE ) CERTIFICATE I, Dolonna Mecum, certify that I am the duly appointed and acting municipal clerk of the City of Elgin, Cook and Kane Counties, Illinois. I further certify that on June 13, 2001, the Corporate Authorities of such municipality passed and approved Ordinance No. G38-01, which provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. G38-01, including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the municipal building, commencing on June 18th, and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon ( request in the office of the municipal clerk. DATED at Elgin, Illinois, on June 18, 2001. Municipal Clerk (SEAL) Ordinance No. G38-01 AN ORDINANCE CLASSIFYING PROPERTY IN THE ARC ARTERIAL ROAD CORRIDOR OVERLAY DISTRICT WHEREAS, the City has considered reports by the Elgin Image Advisory Commission concerning the image and appearance of improvements along the arterial road corridors; and WHEREAS, the City has undertaken a comprehensive planning process that was initiated in June, 2000 ; and WHEREAS, the City has commissioned Terkla, Pettigrew, Allen and Payne, Inc. , DLK Architecture and Design, Wolff-Clements Landscape Architecture and Design, and Real Estate Planning Group as a consulting team to assist the City in preparing an updated comprehensive plan for the community; and WHEREAS, as one part of the comprehensive planning process, the consulting team will evaluate the arterial road corridors, and with the participation of the community, recommend land use, appearance, and design goals and objectives for the arterial road corridors; and WHEREAS, upon adoption of the comprehensive plan, new zoning regulations can be prepared and adopted to reinforce the desired development character along the arterial road corridors; and WHEREAS, written application has been made to classify certain property located along the arterial road corridors in the ARC Arterial Road Corridor Overlay District pending the adoption of an undated comprehensive plan for the City of Elgin, Illinois, and new zoning regulations; and WHEREAS, the Planning and Development Commission has conducted a public hearing after due notice and submitted its written findings and recommendations to the City Council; and WHEREAS, the City Council has reviewed the recommendations and concurs in such recommendations . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Chapter 19 . 07, Section 19 . 07 . 600 entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinafter laid out in the ` Zoning District Map' , as amended, be and are hereby altered by including in the ARC Arterial Road Corridor Overlay District, the following described property: All "zoning lots" adjoining Randall Road and the "arterial streets" as defined in Chapter 19 . 90 entitled "Supplementary Regulations" of the Elgin Municipal Code, 1976, as amended, including McLean Boulevard, State Route 31 (State Street) , Dundee Avenue, Villa Street, Center Street (between Dundee Avenue and Villa Street) , State Route 25 (St . Charles Street, Bluff City Boulevard, Liberty Street , Dundee Avenue) , Big Timber Road, Highland Avenue, Larkin Avenue, Kimball Street, Congdon Avenue (east of State Route 25) , State Route 58 (east of Dundee Avenue) , and State Route 19 (East Chicago Street) . " Section 2 . Sunset Clause. The creation of the ARC Arterial Road Corridor Overlay District is being enacted to provide the City the opportunity to prepare and adopt a new comprehensive plan, and to thereafter consider new zoning regulations to reinforce the desired development character along the arterial road corridors. Accordingly, unless extended by act of the Elgin City Council, these provisions shall expire and be void on December 31, 2003 . Section 3 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 4 . That this ordinance shall be in full force and effect from and after its passage in the manner provided by law.
