HomeMy WebLinkAboutG70-00 Ordinance No. G70-00 AN ORDINANCE CLASSIFYING PROPERTY IN THE CENTER CITY PRESERVATION OVERLAY ZONING DISTRICT WHEREAS, the City has undertaken a study of its Center City and adjoining Riverfront through a comprehensive planning process that was initiated in September, 1999; and WHEREAS, as part of that comprehensive planning process, the City has commissioned City Vision Associates of Madison, Wisconsin and Hitchcock Design Group of Naperville, Illinois to prepare a comprehensive Master Plan for Elgin ' s Fox River and Center City that will create a vision and implementation strategy for the physical and economic revitalization of the City' s downtown and riverfront ; and WHEREAS, as part of the planning process in preparing the Master Plan for Elgin' s Fox River and Center City, a thorough public review process consisting of four public input sessions, four community input sessions, nine review meetings and work sessions with the Elgin Riverfront Steering Committee, and three meetings with various focus groups has been conducted to insure that information developed during the Center City and Riverfront master planning process was made f' available to the general public; and WHEREAS, written application has been made to classify certain property located in the Center City in the CCP Preservation Overlay Zoning District pending the adoption of the final comprehensive Master Plan for Elgin' s Fox River and Center City; and WHEREAS, the Planning and Development Commission has conducted a public hearing after due notice and submitted its written findings and recommendations to the City Council ; and WHEREAS, the City Council has reviewed the recommendations of the Planning and Development Commission and concurs in such recommendations; and WHEREAS, on April 26, 2000 the City Council adopted Ordinance G22-00 providing for the classification of certain property in the Center City Preservation Overlay Zoning District; and WHEREAS, Section 2 of Ordinance G22-00 provided that the provisions of such ordinance would expire and be void on November 1, 2000; and WHEREAS, it has been determined that additional time is required to complete the permanent Center City Preservation District zoning regulations; and WHEREAS, the Planning and Development Commission has elm' conducted a public hearing after due notice and submitted its written findings and recommendations to the City Council . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Chapter 19 . 07, Section 19 . 07 . 600 entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinafter laid out in the ' Zoning District Map ' , as amended, be and are hereby altered by including in the CCP Preservation Overlay Zoning District, the following described property: COMMENCING AT THE INTERSECTION OF THE CENTER LINES OF EAST CHICAGO STREET AND CHAPEL STREET; THENCE NORTH ALONG THE CENTER LINE OF CHAPEL STREET TO THE CENTER LINE OF PARK STREET; THENCE WEST ALONG THE CENTER LINE OF PARK STREET TO THE INTERSECTION OF THE CENTER LINE OF PARK STREET AND ACADEMY PLACE; THENCE NORTH ALONG THE CENTERLINE OF ACADEMY PLACE, EXTENDED NORTH, TO THE CENTER LINE OF FRANKLIN BOULEVARD; THENCE WEST ALONG THE CENTER LINE OF FRANKLIN BOULEVARD TO THE CENTER LINE OF DOUGLAS AVENUE; THENCE NORTH ALONG THE CENTER LINE OF DOUGLAS AVENUE TO THE CENTER LINE OF ANN STREET; THENCE WEST ALONG THE CENTER LINE OF ANN STREET TO THE CENTER LINE OF BROOK STREET; THENCE NORTH ALONG THE CENTER LINE OF BROOK STREET TO THE CENTER LINE OF SENECA STREET; THENCE WEST ALONG THE CENTER LINE OF SENECA STREET TO THE CENTER LINE OF NORTH GROVE AVENUE; THENCE NORTH ALONG THE CENTER LINE OF NORTH GROVE AVENUE TO THE CENTER LINE OF JEFFERSON AVENUE; THENCE WEST ALONG THE CENTER LINE OF JEFFERSON AVENUE TO THE EAST LINE OF THE FORMER CHICAGO AND NORTHWESTERN RAILROAD RIGHT OF WAY 9 NOW OWNED BY THE CITY OF ELGIN; THENCE NORTH ALONG THE EAST LINE TO THE WEST LINE OF RIVER BLUFF ROAD; THENCE WEST ACROSS THE FOX RIVER TO THE CENTER LINE OF MABEL STREET; THENCE SOUTH ALONG THE CENTER LINE TO THE CENTER LINE OF OWASCO AVENUE; THENCE WEST ALONG THE CENTER LINE OF OWASCO AVENUE TO THE CENTER LINE OF THE CHICAGO AND NORTHWESTERN RAILROAD RIGHT OF WAY; THENCE SOUTH ALONG THE CENTER LINE OF THE CHICAGO AND NORTHWESTERN RAILROAD RIGHT OF WAY TO THE CENTER LINE OF WEST HIGHLAND AVENUE; THENCE WEST ALONG THE CENTER LINE OF WEST HIGHLAND AVENUE TO THE CENTER LINE OF CRYSTAL STREET; THENCE SOUTH ALONG THE CENTER LINE OF CRYSTAL STREET, EXTENDED SOUTHEASTERLY, TO A POINT 200 FEET SOUTH OF THE SOUTHERLY LINE OF WALNUT AVENUE; THENCE EAST r PARALLEL TO AND 200 FEET FROM THE SOUTHERLY LINE OF WALNUT AVENUE / NATIONAL STREET, CONTINUING EAST PARALLEL TO AND 200 FEET FROM THE SOUTHERLY LINE OF NATIONAL STREET TO THE CENTER LINE OF VILLA STREET; THENCE NORTHWESTERLY ALONG THE CENTER LINE OF VILLA STREET TO THE CENTER LINE OF CHAPEL STREET; THE NORTH ALONG THE CENTER LINE OF CHAPEL STREET TO THE CENTER LINE OF EAST CHICAGO STREET, THE PLACE OF BEGINNING; CITY OF ELGIN; ELGIN TOWNSHIP; KANE COUNTY; ILLINOIS (PROPERTY COMMONLY KNOWN AS THE STUDY AREA FOR CENTER CITY / RIVERFRONT MASTER PLAN) . " Section 2 . Sunset Clause . The creation of the CCP Preservation Overlay District within the Center City is being enacted to provide the City with an opportunity to review and solicit comment before adopting the final comprehensive Master Plan for Elgin' s Fox River and Center City and to determine the impact of these regulations on the public ' s health, safety and welfare . Accordingly, unless extended by act of the Elgin City Council, these provisions shall expire and be void on June 1, 2001 . Section 3 .
