AN ORDINANCE
PROVIDING FOR A SCHEDULE OF PAYM1NTS FOR THE
RECAPTURE OF COSTS OF CERTAIN WATER S STEM IMPROVEMENTS
TO BENEFITTED PROPERTIP S
WHEREAS, the Village of Bartlett e, tended a watermain,
identified as the Bluff City Bouleva d and Lake Street
Watermain Improvement; and
WHEREAS, the installation of said atermain made water
service available to nearby properties a d thereby benefitted
said properties; and
WHEREAS, on October 27, 1986, the City Council of the
City of Elgin adopted Ordinance N. . T6-86 requiring
reimbursement to the Village of Bartlett for a portion of the
cost of said watermain which benefitted su h properties; and
WHEREAS, Section 3 of Ordinance No. T6-86 requires that
the full amount due for each parcel shall be paid prior to any
connection to the subject watermain for an, such parcel; and
WHEREAS, the Ray Graham Association is a not-for-profit
organization which is the owner of on: of the benefitted
parcels identified in Ordinance No. T6-8: as Parcel 10 (such
owner of Parcel 10 hereinafter referred to as the "Owner" ) ; and
WHEREAS, there is due and owing fr•m the Owner of such
Parcel 10 as reimbursement costs pursua t to Ordinance No.
T6-86 the total amount of $16,523 . 08; and
WHEREAS, the Owner of Parcel 10 has requested that it be
permitted to pay such recapture cost- which are to be
reimbursed to the Village of Bartlett in nstallments pursuant
to the schedule attached hereto as Exhibit A; and
WHEREAS, the Village of Bartlett h.s consented to the
reimbursement of such costs to the Vil age of Bartlett in
installments pursuant to the schedule attached hereto as
Exhibit A; and
WHEREAS, the City Council of the City of Elgin has
determined that it is in the best interes s of the city and in
the public interest to allow for the •eimbursement of the
subject recapture costs in installmen•s pursuant to the
schedule attached hereto as Exhibit A.
NOW, THEREFORE, BE IT ORDAINED BY T E CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That notwithstanding the provisions of
Section 3 of Ordinance No. T6-86 which r:quires the payment of
the full amount due for each parcel prior to any connection to
said parcel the Owner of Parcel 10 as i•entified in Ordinance
No. T6-86 may tap on to the subject wter main conditioned
upon making the reimbursement of the redapture costs for the
subject watermain pursuant to the installment schedule
attached hereto as Exhibit A, provided f rther, however, such
departure from Ordinance No. T6-86 to allow for payment
pursuant to an installment schedule sh=1l apply only to a
not-for-profit organization.
Section 2 . That in the event the 0 ner fails to make the
timely installment payments as provide• in the schedule A
attached hereto upon thirty (30) days .dvance notice to the
Owner water service to the subject property shall be
discontinued.
Section 3 . That all ordinances or p.rts of ordinances in
conflict with the provisions of this ordinance are hereby
repealed.
Section 4 . That this ordinance shall be in full force
and effect form and after its passage the manner provided
by law.
