HomeMy WebLinkAboutG38-99 Ordinance No. G38-99 AN ORDINANCE AMENDING CHAPTER 6 . 31 ENTITLED "MASSAGE ESTABLISHMENTS AND MASSAGE SERVICES" OF THE ELGIN MUNICIPAL CODE, 1976 , AS AMENDED WHEREAS, the City Council of the City of Elgin has determined that it is necessary and desirable to provide for the regulation and licensing of massage establishments and massage services; and WHEREAS, the City of Elgin is an Illinois municipal corporation and a home rule unit pursuant to the Constitution and laws of the State of Illinois; and WHEREAS, a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, the regulation and licensing of massage establishments and massage services are matters pertaining to the government and affairs of the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Section 6 . 31 . 030 (A) of the Elgin Municipal Code, 1976, as amended, entitled "Permit Required" r be and is hereby created to read as follows : "Every applicant for a permit to maintain and operate or conduct a massage establishment shall file an application in duplicate under oath with the public health officer upon a form provided by said public health officer and pay a non-refundable filing fee of $75 . 00 to the finance director, who shall issue a receipt which shall be attached to the application filed with the public health officer. " Section 2 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 3 .
