STATE OF ILLINOIS ) ) ss. COUNTY OF KANE ) CERTIFICATE I, Dolonna Mecum, certify that I am the duly appointed and acting municipal clerk of the City of Elgin, Cook and Kane Counties, Illinois. I further certify that on August 12, 1998, the Corporate Authorities of such municipality passed and approved Ordinance No. G72-98, entitled An Ordinance Amending Chapter 6.06 Entitled "Massage Establishments and Massage Services" of the Elgin Municipal Code, 1976, as Amended, which provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. G72-98, including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted l* in the municipal building, commencing on August 14, 1998, and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the office of the municipal clerk. DATED at Elgin, Illinois, on August 14 , 1998. I' Municipal Clerk (SEAL) Ordinance No. G72-98 AN ORDINANCE AMENDING CHAPTER 6 . 31, ENTITLED "MASSAGE ESTABLISHMENTS AND MASSAGE SERVICES" OF THE ELGIN MUNICIPAL CODE, 1976 , AS AMENDED BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Title 6, Chapter 6 . 31 of the Elgin Municipal Code, 1976 , as amended, be and is hereby further amended by adding Section 6 . 31 .040C to read as follows : C. The applicant for a permit to operate a massage establishment shall provide the name of the insurance carrier, policy number, coverage amounts, and policy periods of the applicants general liability policies . The application for a permit shall have attached to it proof of liability insurance in the amount of not less than one million dollars ($1, 000, 000 . 00) for each person injured and one million dollars ( $1,000, 000 . 00) aggregate per incident and three hundred thousand dollars ($300, 000 . 00) for property damages for each accident. This insurance must name the City of Elgin as an additional insured with right to notice of cancellation. The insurance required by this section shall be occurrence-based and shall remain in effect for the period of time the applicants massage establishment permit remains valid. Section 2 . That Title 6, Chapter 6 . 31 of the Elgin Municipal Code, 1976 , as amended, be and is hereby further amended by amending Section 6 . 31 . 110A to read as follows : 3 . Adequate dressing and locker facilities shall be provided for the patrons served at any given time. In the event male and female patrons are to be served simultaneously, separate dressing, locker and massage room facilities shall be provided; Section 3 . That Title 6 , Chapter 6 . 31 of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6 . 31 . 130 to read as follows: Any masseuse or masseur who provides any of the services listed in Section 6 . 31 . O10C of this chapter at any hotel or motel must first register his or her name and permit number with the owner, manager or person in charge of the hotel or motel . tom• Section 4 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 5 . That this ordinance shall be in full force and effect ten days after its passage and publication in the manner provided by law.
