AN ORDINANCE
AMENDING CHAPTER 3 . 75 OF THE ELGIN MUNICIPAL CODE,
1976 , AS AMENDED, ENTITLED "CULTURAL ARTS COMMISSION"
WHEREAS, the City of Elgin is a home rule unit pursuant to
Article VII of the Illinois Constitution; and
WHEREAS, the City of Elgin, as a home rule unit, may
exercise any power and perform any function pertaining to its
government and affairs; and
WHEREAS, the City Council of the City of Elgin has
determined that it is necessary and desirable to amend the
ordinance providing for the city' s cultural arts commission to
delete the provision whereby a city council member serves as an
ex officio member of the commission and to change the length of
members terms from four years to three years; and
WHEREAS, the proposed ordinance amendments relating to the
city' s cultural arts commission pertains to the government and
affairs of the City of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS :
Section 1 . That Section 3 . 75 . 020 of the Elgin Municipal
Code, 1976 , as amended, entitled "Membership, Appointment and
Term of Office" be and is hereby amended in its entirety to
read as follows :
"3 . 75 . 020 MEMBERSHIP, APPOINTMENT AND TERM OF
OFFICE .
The commission shall consist of ten members, all
of whom shall be appointed by the city council .
A. All members shall be residents of the city
who are known to have an interest and expertise in
the functions of the commission and who shall be
voting members of the commission.
B. One member shall be a member of the Hemmens
advisory board and shall be a non-voting ex officio
member of the commission. "
Section 1 . That Subsection B of Section 3 . 75 . 030 of the
Elgin Municipal Code, 1976, as amended, entitled "Term of
Members" be and is hereby amended to read as follows :
"B. After the initial appointments as provided
above, each subsequent appointment shall be for a
term of three years, provided that no commission
tok member shall serve for more than two full consecutive
terms . "
Section 3 . That all ordinances or parts thereof in
conflict with this ordinance be and are hereby repealed.
Section 4 . That this ordinance shall be in full force and
effect from and after its passage in the manner provided by
law.
