AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A COMMERCIAL ANTENNA TOWER
(896 Bluff City Boulevard)
WHEREAS, written application has been made for a CI
Commercial Industrial District conditional use for a commercial
antenna tower at 896 Bluff City Boulevard; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice by publication and
has submitted its findings of fact and recommended approval;
and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Zoning and Subdivision
Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS :
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for a commercial
antenna tower at 896 Bluff City Boulevard and legally described
as follows :
LOTS TWO (2) AND THREE ( 3) , IN ELGIN HEIGHTS
ADDITION TO CITY OF ELGIN, BEING A SUBDIVISION OF
SECTION NINETEEN ( 19 ) , TOWNSHIP FORTY ONE (41) NORTH,
RANGE NINE ( 9) EAST OF THE THIRD PRINCIPAL MERIDIAN,
EXCEPTING THEREFROM, THAT PART OF SAID LOTS 2 AND 3
ALREADY DEEDED TO STATE OF ILLINOIS FOR HIGHWAY
PURPOSES, IN THE CITY OF ELGIN, COOK COUNTY,
ILLINOIS .
be and is hereby granted subject to the following conditions :
1 . Substantial conformance to the Application
for a Conditional Use for a Commercial Antenna Tower,
submitted by Richard Connor Riley & Associates,
L.L.C . on behalf of AT&T Wireless PCS, Inc. , dated
received 04/09/98; including the opportunity to lease
space on the antenna tower to the service providers
pursuant to compliance with FCC and FAA rules .
2 . Compliance with all other applicable codes
and ordinances .

FINDINGS OF FACT
Zoning and Subdivision Hearing Board City of Elgin, Illinois
SUBJECT
Consideration of Petition 32-98 Requesting a Conditional Use for
a Commercial Antenna Tower in the CI Commercial Industrial
District; Property Located at 896 Bluff City Boulevard, by AT &
T Wireless PCS, Inc. , as Applicant, and George W. Reich, as
Owner.

BACKGROUND
An application has been filed by AT & T Wireless PCS, Inc.
requesting a conditional use for a commercial antenna tower in
the CI Commercial Industrial District. The subject property is
located at 896 Bluff City Boulevard (reference Exhibits A, B and
C) .
The applicant is a public utility whose facilities and
operations are licensed by the FCC and regulated by the FAA.
Its main business is providing wireless communication services
to the public. The applicant proposes to develop the subject
property with a 152 foot tall monopole antenna structure and an
accompanying electronic equipment shelter (reference Exhibit D) .
FINDINGS
After due notice, as required by law, the Zoning and Subdivision
Hearing Board held a public hearing in consideration of Petition
rk 32-98 on May 20, 1998 . The applicant testified at the hearing
and presented documentary evidence in support of the
application. No objectors appeared at the hearing. The

rift. E. Surrounding Land Use and Zoning Standard. The suitability
of the subject property for the intended conditional use
with respect to consistency and compatibility with
surrounding land use and zoning.
Findings. The US Route 20 Bypass is located immediately
north of the subject property. The area located to the
north of Route 20 is improved with single family residences .
The areas located to the south, east, and west of the
subject property are zoned CI Commercial Industrial
District. These areas are developed primarily with
commercial service and industrial uses . The Bluff City
Cemetary, zoned CF Community Facility District, is located
south of Bluff City Boulevard.
F. Trend of Development Standard. The suitability of the
subject property for the intended conditional use with
respect to consistency with an existing pattern of
development or an identifiable trend of development in the
area.
Findings. The subject property is located within along a
road corridor developed with a mix of commercial and
industrial uses .

G. Zoning Districts Standard. The suitability of the subject
property for the intended conditional use with respect to
conformance to the provisions for the purpose and intent,
and the location and size of a zoning district.
Findings. The purpose of the CI Commercial Industrial
District is to provide for an existing pattern of
development in which certain commercial uses and industrial
uses have located together.
H. Comprehensive Plan Standard. The suitability of the subject
property for the intended conditional use with respect to
conformance to the goals, objectives, and policies of the
official comprehensive plan.
Findings. The subject property is designated as "mixed
commercial industrial" by the Official Comprehensive Plan of
Elgin.
I. Location, Design, and Operation Standard. The suitability
of the subject property for the intended conditional use
with respect to it being located, designed, and operated so
as to promote the purpose and intent of this title and
chapter.
Findings. The Planning Department does not make findings
regarding the location, design, and operation of a proposed
conditional use.
