Ordinance No. G29-98 AN ORDINANCE AMENDING CHAPTER 6 . 06 ENTITLED "ALCOHOLIC LIQUORS" OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, REGARDING EXTENDED HOURS PERMITS WHEREAS, on July 29 , 1997 , the City Council of the City of Elgin adopted Ordinance Number G32-97 which provided for the continuation of extended hours permits to allow the retail sale of alcoholic liquor on specific premises until 4 :00 a.m. on Saturdays and Sundays; and WHEREAS, the terms of said ordinance providing for an extended hours permit automatically expire on April 30, 1998; and WHEREAS, the City Manager has submitted a report to the City Council advising the City Council as to the city' s ongoing experience with an extended hours permit; and WHEREAS, the City Council of the City of Elgin has determined that it is desirable to continue to provide for extended hours permits pursuant to the terms and conditions as provided for in this ordinance. tow NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That the provisions of Section 2 of Ordinance G32-97 providing for the automatic expiration of extended hours permits pursuant to Elgin Municipal Code Section 6 . 06 . 056 is hereby repealed. Section 2 . That 6 . 06 . 056 of the Elgin Municipal Code, 1976 , as amended, shall without further council action automatically expire April 30, 1999 . It is hereby declared to be the legislative intent of the City Council that the adoption of ordinance provisions for an extended hours permit is being done on a continuing experimental basis only and that no licensee who is granted an extended hours permit shall have any property interest, vested right or other continuing protectable interest in the continuation of an extended hours permit. The City Manager is directed to submit a report to the City Council prior to the automatic expiration of Section 6 . 06 . 056 and therein shall advise the City Council as to the city' s continuing experience with an extended hours permits and whether an ordinance providing for the further continuation of extended hours permits should be adopted. Section 3 . That the annual fee of $500 for extended hours permits shall be prorated and the fee paid based upon the fraction of the license year for which the extended hours permit has been issued. Section 4 . That all ordinances or parts of ordinances in e,,,, conflict with the provisions of this ordinance be and are hereby repealed. Section 5 .
