HomeMy WebLinkAboutG19-98 Ordinance No. G19-98 AN ORDINANCE AMENDING CHAPTER 16 . 32 ENTITLED HEATING, VENTILATING AND AIR CONDITIONING CODE OF THE ELGIN MUNICIPAL CODE, 1976 , AS AMENDED WHEREAS, the City of Elgin may adopt by reference any published compilation of rules and regulations prepared by a nationally recognized technical trade or service association pursuant to the provisions of Article 1, Division 3 of the Illinois Municipal Code ( 65 ILCS 5/1-3-1 et seq. ) ; and WHEREAS, the International Mechanical Code, 1996 Edition establishes minimum regulations governing the design, installation, maintenance, alteration and inspection of mechanical systems that are permanently installed and utilized to provide control of environmental conditions and related processes within buildings; and WHEREAS, the City Council of the City of Elgin has determined it is necessary and desirable to adopt the International Mechanical Code, 1996 Edition as published by the International Code Council , Inc . , with the additions, insertions, deletions and changes prescribed in this ordinance; and WHEREAS, one copy of the International Mechanical Code, 1996 Edition has been on file with the City Clerk for more than thirty days preceding the passage of this ordinance, in accordance with Section 1-3-2 of the Illinois Municipal Code ( 65 ILCS 5/1-3-2 ) . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Chapter 16 . 32 , Section 16 . 32 . 010 of the Elgin Municipal Code, 1976 , as amended, be and is hereby amended to read as follows : 16 . 32 . 010 ADOPTED-EXCEPTIONS . That a certain document, one ( 1) copy of which is on file in the office of the City Clerk of the City of Elgin, being marked and designated as the International Mechanical Code, 1996 Edition as published by the International Code Council, Inc . , be and is hereby adopted as and shall be known as the Heating Ventilating and Air Conditioning Code of the City of Elgin for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems; and each and all of the regulations, provisions , penalties, conditions and terms of said International Mechanical Code are hereby referred to, eft adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes prescribed in this chapter. Section 2 . That Chapter 16 . 32 entitled Heating Ventilating and Air Conditioning Code of the Elgin Municipal Code, 1976 , as amended, be and is hereby amended by amending Section 16 . 32 . 020 to read as follows : 16 . 32 . 020 ADDITIONS, INSERTIONS AND CHANGES. The International Mechanical Code, 1996 Edition is amended and revised in the following respects : Section PM-101 . 1, entitled Title, shall be amended to read as follows : These regulations shall be known as the Heating, Ventilating and Air Conditioning Code of the City of Elgin, hereinafter referred to as this code. Section 109 . 1, entitled Application for Appeal, shall be amended to read as follows : Appeals . A person shall have the right to appeal a decision of the code official in accordance with the provisions set forth in Chapter 3 . 60, Section 3 . 60 . 050 of the Elgin Municipal Code, 1976 , as amended. Sections 109 . 2 , 109 . 3, 109 . 4 , 109 . 5, 109 . 6 , and 109 . 7 are hereby deleted in their entirety. Section 403 . 2 , entitled Outdoor air required, shall be amended to read as follows : Air temperature. The temperature differential between ventilation air and the air in the conditioned space shall not exceed 10 degrees Fahrenheit. Exception: Ventilation air that is part of the air conditioning system. Section 603 . 5, entitled Flexible air ducts, shall be amended to read as follows : Flexible air ducts, both metallic and nonmetallic, shall be listed and labeled to indicate conformance with the requirements of U.L. 181 for Class 0 or Class 1 flexible air ducts . Flexible air ducts shall not exceed ten ( 10) feet in length. Section 603 . 6 . 1 , entitled Length limited, shall be amended to read as follows : Flexible air connectors shall be limited in length to Ten ( 10) feet. ,. Section 926 . 1 , entitled Unvented Room Heaters . General, shall be amended to read as follows : Unvented room heaters and fireplaces shall be prohibited from being installed, maintained or operated. Sections 926 . 2 , 926 . 3 , 926 .4 , 926 . 5, and 926 . 6 are hereby deleted in their entirety. Chapter 13, entitled Fuel-Gas Piping is hereby deleted in its entirety. Section 3 . That Chapter 16 . 32, Section 16 . 32 . 120, entitled Conflicts With Other Provisions, shall be amended to read as follows : Conflicts With Other Provisions . When the provisions of this chapter conflict with any other provision of the Elgin Municipal Code regulating the same subject matter, the more stringent or restrictive provision shall apply. Section 4 . That Chapter 16 . 32 entitled Heating, Ventilation and Air Conditioning Code of the Elgin Municipal Code, 1976 , as amended, Sections 16 . 32 . 060 through 16 . 32 . 110, inclusive, be and are hereby repealed. Section 5 . That nothing in this ordinance or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance. Section 6 . That this ordinance shall be in full force and effect immediately after its passage in the manner provided by law.
