T18-97 AMENDING ORDINANCE T17-97 PROVIDING FOR A REFUND TO SENIOR CITIZENS OF MOBILE HOME LOCAL SERVICE TAXES ADOPTED BY THE CITY COUNCIL OF THE CITY OF ELGIN ON THIS 22ND DAY OF OCTOBER 1997 Published in pamphlet form by authority of the City Council of the City of Elgin, Kane and Cook Counties, Illinois, on this 24th day of October, 1997. STATE OF ILLINOIS ) ss. COUNTY OF KANE ) CERTIFICATE I, Dolonna Mecum, certify that I am the duly appointed and acting municipal clerk of the City of Elgin, Cook and Kane Counties, Illinois. I further certify that on October 22, 1997, the Corporate Authorities of such municipality passed and approved Ordinance No. T18-97, entitled An Ordinance Amending Ordinance T17-97 Providing for a Refund to Senior Citizens of Mobile Home Local Service Taxes, which provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. T18-97, including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted r` in the municipal building, commencing on October 24, 1997, and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the office of the municipal clerk. T17-96 PROVIDING FOR A REFUND TO SENIOR CITIZENS OF MOBILE HOME LOCAL SERVICE TAXES WHEREAS, the City Council of the City of Elgin has previously adopted Ordinance No. T17-96 providing for a refund to senior citizens of Mobile Home Local Service Taxes for the 1997 tax year; and WHEREAS, Section 2 of Ordinance T17-96 provides that to qualify for such senior citizen tax refund the owner(s) of the subject mobile home must have qualified and obtained for the 1997 tax year the Senior Citizens Reduction of the Mobile Home Local Services Tax; and WHEREAS, it has been discovered by city staff in the implementation of such ordinance that senior citizens owning mobile homes in Cook County do not pay the Mobile Home Local Service Tax as Cook County has not been collecting such tax and it is therefore necessary to amend Section 2 of Ordinance T17-96 to allow senior citizens with mobile homes in Cook County to participate in the refund program. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That Section 2 of Ordinance No. T17-96 entitled "An Ordinance Providing for a Refund to Senior Citizens of Mobile Home Local Services Taxes" be and is hereby amended to read as follows : "That to qualify for such senior citizen tax refund for mobile homes located in Kane County the owner(s) of the subject mobile home must have qualified and obtained for the 1997 tax year the Senior Citizens Reduction of the Mobile Home Local Services Tax in accordance with 35 ILCS 515/7, as amended. To qualify for such senior citizen tax refund for mobile homes located in Cook County the owner(s) of the subject mobile home must have been qualified in the 1997 tax year for the Senior Citizen Reduction of the Mobile Home Local Services Tax in accordance with 35 ILCS 515/7, as amended. " Section 2 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 3 .
