AN ORDINANCE
AMENDING THE FEE SCHEDULE FOR CERTAIN BUSINESS LICENSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS :
Section 1 . That Section 6 . 09 . 140 entitled "Billiard Halls
and Bowling Alleys" of Chapter 6 . 09 of the Elgin Municipal
Code, 1976 , as amended, be and is hereby further amended to
road as follows :
6 . 09 . 140 BILLIARD HALLS AND BOWLING ALLEYS .
No person, firm or corporation shall operate,
maintain or conduct a billiard, pool , bagatelle, or
pigeon table or howling alley open to the public
without having first obtained a license therefor as
is provided in this chapter. All applications for
such a license shall state thereon the intended
location of the place of business and the number of
tables and/or the alleys to be used therein. An
annual. license fee of $20 . 00 for each alley or table
maintained or operated shall be paid.
Section 2 . That Section 6 . 09 . 150 entitled "Coin-Operated
Musical Devices" of Chapter 6 . 09 of the Elgin Municipal Code,
1976 , as amended, be and is hereby further amended to read as
follows :
6 . 09 . 150 COIN--OPERATED MUSICAL DEVICES .
A. Definition. "Coin-operated musical device"
means any phonograph, piano, player, music box,
jukebox, or other instrument or device capable of
producing or reproducing any vocal or instrumental
sounds, other than a motion picture sound machine,
which is governed or controlled by the deposit of a
coin or. token.
B. Regulations . Under this section the
operation of any coin-operated musical instrument at
any place or in any manner which will disturb the
peace and quiet of persons outside the premises is
prohibited . No immoral or indecent selections shall
be presented in any such instrument.
C . Penalty. Any person, firm or corporation
violating or refusing or failing to comply with any
of the provisions of this section shall be fined not
less than $5 . 00 nor more than $100 . 00 for each
offense; and a separate offense shall be deemed
committed on each day during or on which a violation
occurs or continues .
Section 3 . That Section 6 . 09 . 155 entitled "Automatic
Amusement Devices" of Chapter 6 . 09 of the Elgin Municipal Code,
1976 , as amended, be and is hereby further amended by amending
Subsection D to read as follows :
D. Fee . The annual fee for such license shall
be $40 . 00 for each automatic amusement device kept or
installed on the premises . The license period shall
be the same as the calendar year.
Section 4 . That Chapter 6 . 45 entitled "Peddlers and
Solicitors" be and is hereby further amended by adding Section
6 . 45 . 130 to read as follows :
6 . 45 . 130 PERMIT FEE--TERMS .
Applicants who solicit from house to house or at
any residence within the city shall be issued a
thirty ( 30 ) day permit for a fee of $20 . 00 .
Section 5 . That Section 9 . 14 . 050 entitled "Fees" of
Chapter 9 . 14 of the Elgin Municipal Code, 1976 , as amended, be
and is hereby further amended to read as follows :
9 . 14 . 050 FEES .
The annual fee for a license for an automatic
emk food vending machine shall be as follows :
A. Machines dispensing ball gum, nuts, panned
candy, prepackaged ice, prepackaged candy,
cookies , crackers , or similar prepackaged,
non -potentially hazardous snacks No fee.
B. Machines dispensing capped or sealed bottled or
canned beverages No fee.
C . Machines dispensing beverages in a cup $30 . 00 .
D. Machines dispensing hot and cold, frozen foods ,
milk, juice, and potentially hazardous
food $30 . 00 .
Section 6 . That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are
hereby repealed.
Section 7 . That this ordinance shall be in full force and
effect from and after January 1, 1998 .
