AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A MOTOR VEHICLE SERVICE STATION
( 500 South McLean Boulevard)
WHEREAS, written application has been made for a NB
Neighborhood Business District conditional use for a motor
vehicle service station at 500 South McLean Boulevard; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice by publication and
has submitted its findings of fact and recommended approval ;
and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Zoning and Subdivision
Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for a motor vehicle
service station at 500 South McLean Boulevard and legally
described as follows :
LOT 2 OF SECOND ADDITION TO BURNIDGE BROS .
INDUSTRIAL PARK BLOCK D OF UNIT NO. 1 ; IN THE CITY
OF ELGIN, KANE COUNTY, ILLINOIS.
be and is hereby granted subject to the following conditions :
1 . Compliance with the site plan prepared by
McClure Engineering Associates , Inc . and dated
March 24 , 1997 .
2 . Compliance with the landscaping plan
prepared by McClure Engineering Associates , Inc . and
dated March 24 , 1997 .
3 . Compliance with all other applicable codes
and ordinances .
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect immediately after its passage in the manner
provided by law.

FINDINGS AND RECOMMENDATION
Zoning and Subdivision Hearing Board City of Elgin, Illinois
SUBJECT
Petition 10-97 Requesting a NB Neighborhood Business District
Conditional Use for a Motor Vehicle Service Station; Property
Located at 500 South McLean Boulevard; by The Daustron Group, as
Applicant and S&S Petroleum, as Owner.
CONSIDERATIONS
A petition has been filed by The Daustron Group requesting a NB
Neighborhood Business District conditional use for a motor
vehicle service station. The subject property is located at
emk 500 South McLean Boulevard.
The applicant is seeking zoning approval to develop the subject
property with a motor vehicle service station and convenience
store.
FINDINGS ,_
After due notice as required by law, the Zoning and Subdivision
Hearing Board held a public hearing to consider Petition 10-97
on March 5, 1997 . The applicant testified at the hearing and
presented documentary evidence regarding the conditional use
request. The Planning Department submitted a Conditional Use
Review, dated February 19 , 1997 .
The Zoning and Subdivision Hearing Board has made the following
findings concerning the subject property: _
A. Site Characteristics. The subject property contains --
approximately 34,244 square feet. The property is
unimproved.
B. Sewer and Water. The property can be serviced with
municipal sanitary sewer and water.
C. Traffic and Parking. The subject property is located at the
southwest corner of the intersection of Fleetwood Drive and
South McLean Boulevard. Fleetwood Drive functions as a

local street. South McLean Boulevard functions as an
arterial street.
The proposed development plan indicates that 10 off-street
parking spaces are to be provided. Ten parking spaces are
required.
D. Zoning History. The subject property has been zoned NB
Neighborhood Business District since 1992 . Prior to 1992 ,
the property was zoned B-3 Service Business District.
E. Zoning Status. Development of the subject property must
conform with the NB Neighborhood Business District design
standards .
F. Surrounding Land Use and Zoning. The area located to the
north and west of the subject property is zoned GI General
Industrial District. The area is developed predominately
with industrial and commercial service uses .
The area located to the east of the subject property is
zoned PRC Planned Residence Conservation District. The area
is developed with an apartment complex (The Mill) .
/•. The areas located to the northeast and south of the subject
E property are zoned NB Neighborhood Business District. These
areas are developed with restaurants and commercial service
uses .
G. Trend of Development. The area in which the subject
property is located is developing with a range of land uses,
including residential, commercial, and industrial uses .
H. Comprehensive Plan. The subject property is designated
"general manufacturing" . The Neighborhood Business District -
zoning is consistent with the "transportation corridor"
designation along South McLean Boulevard.
RECOMMENDATION
On a motion to recommend approval of Petition 10-97 subject to
the following conditions, the vote was seven ( 7 ) yes and zero
( 0) no: --
1 . Revisions to the site plan and landscaping plan per the City
of Elgin, including provisions to restrict northbound
traffic from entering the site through the South McLean
Boulevard approach.
2 . Substantial conformance with the revised site plan and
landscaping plan.
3 . Compliance with all applicable codes and ordinances .

Therefore, the motion to recommend approval of Petition 10-97
was adopted. I .
