HomeMy WebLinkAbout97-07 Kane County STATE OF ILLINOIS COUNTY OF KANE /� ORDINANCE NO. 97- �./7 ESTABLISHING STORMWATER MANAGEMENT PLANNING COMMITTEE WHEREAS, the Kane County Board passed Resolution 88-133, Establishing Stormwater Management Planning, and Resolution 89-188, Stormwater Management Planning recognizing that proper stormwater management and flood control are essential to insure the public health, safety and welfare of all the residents of the County; and WHEREAS, the Kane County Board desires to rescind Resolution 88-133 and Resolution 89-188 and update them with this Ordinance; and WHEREAS, the Illinois General Assembly has passed 55 ILCS5/5-1062, an Act to Amend Certain Acts in relation to Stormwater Management and, therein, has authorized counties in conjunction with municipalities to form County-wide stormwater management planning committees with equal County/municipal representation to develop County-wide stormwater management plans; and WHEREAS, the Kane County Board wishes to establish a stormwater management program in response to 55 ILCS5/5-1062 and desires to meet its obligation for establishing a stormwater management planning Committee. NOW, THEREFORE, BE IT ORDAINED by the Kane County Board that the following six geographic areas, as delineated by the respective and inclusive Kane County Board Districts shown, are designated as representation units in formulating the Kane County Stormwater Management Planning Committee (KCSMPC) : KCSMPC Area KANE COUNTY BOARD No. Name Districts Included I. Aurora Area - East 1, 2, 7 and 8 II. Aurora Area - West 3, 4, 5, 6 and 9 III. Fox River - Central 10, 11, 12 and 13, IV. Elgin Area 16, 17, 18, 19 and 20 V. Fox River - North 21, 22, 23 and 24 VI. Western Kane County 14, 15, 25 and 26 BE IT FURTHER ORDAINED by the Kane County Board that a Kane County Stormwater Management Planning Committee is established and shall be comprised of twelve members: Six (6) members shall be representatives of the Kane County Board, appointed by the Board chairman with the approval of the County Board; and Six (6) members shall be representatives of municipalities of Kane County selected by a convention of the mayors in the County. BE IT ALSO FURTHER ORDAINED that the principal duties of this Committee are to develop a stormwater management plan for presentation to and approval by the County Board (PHASE I) ; to direct the plan' s implementation and any subsequent revisions (PHASE II) ; and to undertake V Page 2 of 2 Ord. No. 97- 07 any other duties as authorized in 55 ILCS5/5-1062. BE IT FURTHER ORDAINED that Ordinance 96-323, an Ordinance Adopting the Annual Appropriations, be amended to reflect the establishment of Fund 086, Stormwater Management Planning. Initial funding of $200, 000. 00 for Fund 086 shall be appropriated from Fund 085, Riverboat. If expenditures occur from Fund 086 prior to the County receiving the FY' 97 appropriation of Fund 085, a loan from Fund 082 (Enterprise General Fund) to Fund 086 shall be completed to cover said expenditures until the Fund 085 appropriation is received. Funds are appropriated to Fund 086 to conduct Phase I of the Stormwater Management Planning Committee' s duties as defined above. Upon completion of Phase I and the adoption of the Kane County Stormwater Management Plan by the County Board, shared funding responsibilities shall be evaluated and determined to implement said Plan. BE IT FURTHER ORDAINED that the Kane County Department of Environmental Management is designated to serve as the primary staff to the Committee during its organization and work program development. BE IT FURTHER ORDAINED that the County Clerk is hereby requested and authorized to distribute certified copies of this Ordinance to all municipalities wholly or partially within the boundaries of Kane County, Illinois. BE IT FURTHER ORDAINED that any previous resolutions or ordinances, including Resolution 88-133, Resolution 89-188 , and previous appointments which are inconsistent with the terms of this Ordinance are vacated.
