HomeMy WebLinkAboutS13-96 Ordinance No. S13-96 AN ORDINANCE VACATING A PORTION OF A PUBLIC STREET (Hawthorne Street) WHEREAS, the public interest will be served by vacating a portion of a public street in the City of Elgin, Kane County, Illinois, as shown in Exhibit "A" attached hereto; and WHEREAS, said property is not necessary to serve the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That a portion of a public street in the City of Elgin, Kane County, Illinois, legally described as follows : That part of Hawthorne Street, described as follows : Commencing at the Northwest corner of Lot 2 in Block 3; thence South 0 degrees 00 minutes 16 seconds West along the West line of said lot, 106 . 0 feet to the present Southerly right of way line of Larkin Avenue for the point of beginning; thence continuing South 0 degrees 00 minutes 16 seconds ., West along the West line of said Lot 2 and along the West line of Lot 3 in Block 3, a distance of 519 .47 feet to the present Northerly right of way line of U.S . 20 Bypass recorded November 7, 1946 as Document No. 567849; thence North 65 degrees 00 minutes 49 seconds West, 66 . 07 feet to a point in the East line of Lot 4 in Block 2 (also being a point in said Northerly right of way line of U.S . 20 Bypass) ; thence North 0 degrees 00 minutes 34 seconds West along the East line of said Lot 4 and along the East line of Lot 1 in Block 2, a distance of 454 . 76 feet to the present Southerly right of way line of Larkin Avenue; thence North 58 degrees 28 minutes 26 seconds East, 70 . 39 feet to the point of beginning, containing 29,200 square feet, all in Walter G. McIntosh and Company' s Fox River Acres, in Elgin Township, Kane County, Illinois . be and the same is hereby vacated. Section 2 . That the City of Elgin does hereby reserve to itself and to any public utility company owning any public service for facilities in, upon or under said right of way vacated by this ordinance full right of access for the purpose of continuing or extending any public service facilities and t_ to maintain, renew, extend or construct or reconstruct any ir- such public service facilities . • . Section 3 . That a certified copy of this ordinance together with a plat of said vacated right of way be filed with the Recorder of Deeds of Kane County, Illinois . Section 4 .
