AN ORDINANCE
GRANTING A CONDITIONAL USE FOR
A PLANNED DEVELOPMENT FOR
METALWORKING MACHINERY AND EQUIPMENT
(516 Slade Avenue)
WHEREAS, written application has been made for an AB Area
Business District conditional use for planned development for
metalworking machinery and equipment at 516 Slade Avenue; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice by publication and
has submitted its findings of fact and recommended approval;
and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Zoning and Subdivision
Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for a planned
development for metalworking machinery and equipment at
516 Slade Avenue and legally described as follows :
LOTS 5 AND 6 AND THE EAST 14 FEET OF LOT 10 AND
LOTS 11, 12, AND 13 AND THE WEST 8 FEET OF LOT 14,
ALL IN BLOCK 2 OF INDUSTRIAL ADDITION TO ELGIN, IN
THE CITY OF ELGIN, KANE COUNTY, ILLINOIS.
be and is hereby granted subject to the following conditions :
1 . Substantial compliance with the development
plan prepared by William M. Brown and Associates,
dated June 25, 1996 and revised July 25, 1996 .
2 . Compliance with all other applicable codes
and ordinances .
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect immediately after its passage in the manner
provided by law.

FINDINGS OF FACT
ZONING AND'SUBDIVISION HEARING BOARD CITY OF ELGIN
I. SUBJECT
Petition 39-96 Requesting a Conditional Use for a Planned
Development in the AB Area Business District for Metalworking
Machinery and Equipment; Property Located at 516 Slade
Avenue; by William M. Brown & Associates, as Applicant and
Airtronics , as Owner.
II. CONSIDERATIONS
A petition has been filed by William M. Brown and Associates,
on behalf of Airtronics, requesting a conditional use for a
planned development in the AB Area Business District for
metalworking machinery and equipment. The subject property is
located at 516 Slade Avenue.
Airtronics, a subsidiary of Katy Industries, currently
operates a manufacturing facility for metalworking machinery
and equipment. Basically, they rebuild, clean, and regage
centerless grinders . Airtronics proposes to expand their
manufacturing use by adding a 3, 160 square foot masonry
building addition to house a ten ton bridge crane assembly for
the loading and unloading of centerless grinding machines.
The ten ton bridge crane assembly has become essential to
their expanding business operations and the safe handling of
newer and larger machinery.
Additionally, as part of the proposal, the gravel parking
areas will be improved in accordance with the Off Street
Parking Ordinance, as well as public sidewalk and landscaping
improvements .
III. FINDINGS
After due notice, as required by law, the Zoning and
Subdivision Hearing Board held a public hearing on Petition
39-96 on August 21, 1996 . The petitioner testified at the
public hearing. No objectors appeared at the public hearing.

been submitted, and written correspondence in objection to
the petition has not been submitted.
A Petition Review, dated August 6, 1996, was submitted by the
Planning Department, which neither recommended approval nor
denial of Petition 39-96 . This Petition Review, along with
the exhibits attached thereto, and the written transcription
of the proceedings of the public hearing, are attached hereto
and made a part hereof.
The Zoning and Subdivision Hearing Board has made the
following findings with respect to Petition 39-96 :
A. Site Characteristics
The subject property consists of 45,828 square feet, or
1 . 05 acres . The property is improved with a one story
commercial building and accessory gravel parking areas .
B. Sewer and Water
The subject property is served with municipal sewer and
water systems . Storm water will be retained on site
through construction of a new drywell as part of the
parking lot improvements .
C . Traffic and Parking

The subject property is a zoning "through lot" . The
building entrance and a shared common driveway, which
provides access to the rear parking area, are located
along Slade Avenue, a local street. Access to the
parking and loading areas is also provided via Page
Avenue, a one way street connecting Dundee Avenue and
Liberty Street (State Route 25) . Traffic counts are not
available adjacent to the subject property.
For the manufacturing use of the property, the off street
parking ordinance requires one stall per 1 . 5 employees
based on the peak demand shift, or one stall per 1,000
square feet of floor area, whichever is greater. For the
office use, the ordinance requires one stall per 250
square feet of floor area. Based on the site plan
submitted, it has been determined that the applicant has
provided the required number of off street parking spaces .

E.- Zoning Status
The Comprehensive Amendment to the Zoning Ordinance
reclassified the subject property to AB area Business
District in 1992 .
The manufacturing of metalworking machines and equipment
was classified as a permitted use prior to 1992 and
currently is permitted only within industrial zoning
districts . Upon adoption of the 1992 Zoning Ordinance,
the property was rendered lawful nonconforming, and
subject to Section 19 . 52 Nonconforming Uses and
Structures of the Elgin Municipal Code. Section 19 .52
prohibits the expansion of nonconforming uses .
Therefore, to introduce the manufacturing use of metal
working machines and equipment into the AB district
requires conditional use approval for a planned
(ow development.
F. Surrounding Land Use and Zoning
The areas to the north, east, and west of the subject
property are zoned AB Area Business District. These
areas are developed with various retail, service and
automobile sales, repair and service uses . The area
located south of the subject property is zoned PGI
Planned General Industrial District and is developed with
manufacturing uses .
G. Trend of Development
The subject property is located within the Industrial
Addition to Elgin which has developed with commercial and
industrial uses .
H. Comprehensive Plan
The Comprehensive Plan designates the subject property as
"Area Village Center" .

IV. RECOMMENDATIONS
On a motion to recommend approval of Petition 39-96 , subject
to the following conditions :
1 . Substantial conformance to the development plan prepared
by William M. Brown and Associates, dated June 25, 1996,
and revised July 25, 1996 .
2 . Compliance with all other applicable codes and ordinances .
the vote was five (5) yes and zero ( 0) no.
Therefore, the motion to recommend approval of Petition 39-96
was adopted.
