AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A MASTER SIGNAGE PLAN
( 1090 E. Chicago Street)
WHEREAS, written application has been made for a CI
Commercial/Industrial District conditional use for a a master
signage plan at 1090 E. Chicago Street; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice by publication and
has submitted its findings of fact and recommended approval;
and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Zoning and Subdivision
Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
rft and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for a master signage
plan at 1090 E. Chicago Street and legally described as
follows :
THAT PART OF THE SOUTHEAST QUARTER OF SECTION
18, TOWNSHIP 41 NORTH, RANGE 9 EAST OF THE THIRD
PRINCIPAL MERIDIAN DESCRIBED AS FOLLOWS: COMMENCING

1 . Substantial conformance with the Sign
Elevation/Site Plan prepared by Architects XXI,
dated May 21, 1996 ; and the Statement of Purpose and
Conformance prepared by Robert A. McNees, dated
June 4 , 1996 .
2 . Compliance with all other applicable codes
and ordinances .
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect immediately after its passage in the manner
provided by law.

FINDINGS AND RECOMMENDATION
Zoning and Subdivision Hearing Board City of Elgin, Illinois
SUBJECT
Consideration of Petition 31-96 Requesting a CI
Commercial/Industrial District Conditional Use for a Master Signage
Plan; Property Located at 1090 East Chicago Street; by Mohan L.
Khetarpal, as Applicant and Tony Ceresa, as Owner.
CONSIDERATIONS
A petition has been filed by Mohan L. Khetarpal requesting a CI
Commercial/Industrial District conditional use for a Master Signage
Plan. The subject property is located at 1090 East Chicago Street.
The applicant proposes to develop the subject property with a
gasoline service station/convenience store/car wash. The allowable
freestanding sign area for the subject property is allocated to an
existing nonconforming freestanding sign located on the premises .
The applicant is requesting conditional use approval for a master
signage plan in order to locate an 80 square foot freestanding sign
along East Chicago Street.
FINDINGS
After due notice, as required by law, the Zoning and Subdivision
Hearing Board held a public hearing on Petition 31-96 on July 17,
1996 . The applicant presented the petition. A Conditional Use
Review prepared by the Planning Department, dated July 10, 1996, and
a transcription of the public hearing are attached and made a part
of these Findings and Recommendation.
The Zoning and Subdivision Hearing Board made the following findings
with respect to Petition 31-96 :
A. Site Characteristics. The development site contains
approximately 35, 327 square feet. The property is undeveloped.
B. Sewer and Water. The subject property is served with sanitary
sewer and water systems .

C. Traffic and Parking. The subject property is located at the
northeast corner of East Chicago Street (State Route 19 ) and
Woodview Drive. East Chicago Street functions as an arterial
street. Woodview Drive functions as a local street.
A total of 14 parking spaces are required in support of the gas
station/convenience store. A total of 10 stacking spaces are
required in support of the car wash. The proposed plan
features 22 parking spaces and 10 stacking spaces .
D. Zoning History and Zoning Status. The subject property was
zoned as follows for the years listed:
1961 Annexed, "C" Apartment District
1962 B-3 Service Business District
1992 CI Commercial/Industrial District
Present CI Commercial/Industrial District
The subject property is a conforming zoning lot.
E. Surrounding Land Use and Zoning. The areas located to the
north, south, and west of the subject property are zoned CI
Commercial/Industrial District. These areas are developed with
a variety of commercial and industrial uses .
The area located to the east of the subject property is zoned
PRC Planned Residence Conservation District. The area is
developed with the Poplar Creek Townhomes .
The Elgin High School campus is located to the southeast of the
subject property.
F. Trend of Development. East Chicago Street has developed with a
variety of commercial and industrial uses, interspersed with
some residential and community facility uses .
G. Comprehensive Plan. The subject property is designated "mixed
commercial/industrial" by the Official Comprehensive Plan for
Elgin.
RECOMMENDATION
The Zoning and Subdivision Hearing Board recommends approval of
Petition 31-96 . On a motion to recommend approval, subject to the
following conditions, the vote was six yes and zero no.
1 . Substantial conformance with the Sign Elevation/Site Plan
prepared by Architects XXI, dated May 21, 1996; and the
Statement of Purpose and Conformance prepared by Robert A.
McNees, dated June 4, 1996 .
