Ordinance No. G45-96 AN ORDINANCE RECLASSIFYING TO PMFR PLANNED MULTIPLE FAMILY RESIDENCE DISTRICT PROPERTY LOCATED AT 1101 SOUTH RANDALL ROAD (SIERRA SOUTH) WHEREAS, written application has been made to reclassify certain property located at 1101 South Randall Road from MFR Multiple Family Residence District to PMFR Planned Multiple Family Residence District for a planned residence district; and WHEREAS, the Planning and Development Commission has conducted a public hearing after due notice and submitted its written findings and recommendations to the City Council; and WHEREAS, the City Council has reviewed the recommendations of the Planning and Development Commission and concurs in such recommendations . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Planning and eft Development Commission, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2 . " Section 3 . That the proposed planned multiple family residence shall be designed, developed, and operated subject to: A. PURPOSE AND INTENT The purpose and intent of the Sierra South PMFR District is to provide a planned environment for a townhome community, subject to the provisions of Chapter 19 . 60 Planned Developments of the Elgin Municipal Code, 1976 , as amended. B. SUPPLEMENTARY REGULATIONS Any word or phrase contained within this ordinance followed by the symbol " (SR) " shall be subject to the definitions and the additional interpretative requirements provided in Chapter 19 . 90 Supplementary Regulations of the Elgin Municipal Code, 1976, as amended. The exclusion of such symbol shall not exempt such word or phrase from the applicable supplementary regulation. C. GENERAL PROVISIONS In the Sierra South PMFR District, the use and development of land and structures shall be subject to the provisions of Chapter 19 . 05 General Provisions of the Elgin Municipal Code, 1976, as amended. D. ZONING DISTRICTS In the Sierra South PMFR District, the use and development of land and structures shall be subject to the provisions of Chapter 19 . 07 Zoning Districts of the Elgin Municipal Code, 1976, as amended. E. LOCATION AND SIZE OF DISTRICT The location of the Sierra South PMFR District is in substantial conformance with the official comprehensive plan. The PMFR District contains more than two acres of land pursuant to the provisions of Section 19 . 30 . 525 Location and Size of District of the Elgin Municipal Code, 1976, as amended. F. LAND USE In the Sierra South PMFR District, the use and development of land and structures shall be subject to the provisions of Chapter 19 . 10 Land Use of the Elgin Municipal Code, 1976 , as amended. The following enumerated "land uses" (SR) shall be the only land uses allowed as a "permitted use" (SR) or as a "conditional use" (SR) in the Sierra South PMFR District. Permitted uses . The following enumerated land uses shall be the only land uses allowed as a permitted use in the Sierra South PMFR District: Residences Division. 1 . "Multiple family dwellings" (SR) (UNCL) . 2 . "Residential garage sales" (SR) (UNCL) . 3 . "Residential occupations" (SR) (UNCL) . 4 . "Residential outdoor storage of firewood" (SR) (UNCL) . 5 . "Residential parking areas" (SR) (UNCL) . 6 . "Residential Storage" (SR) (UNCL) . 7 . "Residential storage of trucks or buses" (SR) (UNCL) . Municipal Services Division. 8 . "Public parks, recreation, open space" (SR) (UNCL) on a "zoning lot" (SR) containing less than two acres of land. Finance, Insurance, and Real Estate Division. 9 . "Development sales office" (SR) (UNCL) . Services Division. 10 . "Family residential care facility" (SR) (8361) . 11 . "Home child day care services" (SR) ( 8351) . Construction Division. 12 . "Contractors office and equipment areas" (SR) (UNCL) . Transportation, Communication, and Utilities Division. 13 . "Amateur radio antennas" (SR) (UNCL) . rft 14 . The following enumerated land uses shall be the only land uses allowed as a conditional use in the Sierra South PMFR District: Services Division. 1 . "Residential Care Facility" (SR) ( 8361) . Miscellaneous Uses Division. emb.. 2 . "Accessory uses" (SR) (UNCL) to the conditional uses allowed in the Sierra South PMFR District, subject to the provisions of Section 19 . 10 . 100, Component Land Uses . G. SITE DESIGN In the Sierra South PMFR District, except as otherwise provided herein, the use and development of land and structures shall be in substantial conformance with the Preliminary Development Plan, Architecture Sheets, and Preliminary Landscape Plan contained in a Development Application for Sierra South prepared by Pulte Home Corporation, dated June 10, 1996, which is attached hereto and made a part hereof by reference as Exhibit B. A bicycle and pedestrian pathway easement shall be provided along and adjoining the easterly right of way line of Randall Road. H. OFF-STREET PARKING In the Sierra South PMFR District, the location and design of driveways and guest parking spaces shall be in substantial conformance with the Preliminary Development Plan contained in a Development Application for Sierra South prepared by Pulte Home Corporation, dated June 10, 1996 . I . OFF-STREET LOADING In the Sierra South PMFR District, the use and development of land is not subject to the provisions of Chapter 19 .47 Off-street Loading. J. SIGNS In the Sierra South PMFR District, signs shall be subject to the provisions of Chapter 19 . 50 Signs . K. VARIATIONS The Sierra South PMFR District shall be subject to the provisions of Chapter 19 . 70 Variations . N. APPEALS Any requirement, determination, or interpretation associated with the administration and enforcement of the provisions of this ordinance may be appealed subject to the provisions of Chapter 19 . 75 Appeals . The subject property is located at 1101 South Randall Road. The applicant proposes to develop the subject property with a townhome community. The proposed development features 32 buildings containing a total of 162 dwelling units (see enclosed Petition Review) . UNRESOLVED ISSUES None. RECOMMENDATION The Planning and Development Commission recommends approval of Petition 38-96 . On a motion to recommend approval of the r August 5, 1996 PLANNED DEVELOPMENT FINDINGS AND RECOMMENDATION Planning and Development Commission City of Elgin, Illinois SUBJECT Consideration of Petition 38-96 Requesting a Map Amendment from MFR Mutiple Family Residence District to PMFR Planned Multiple Family Residence District; Property Located at 1101 South Randall Road; by Pulte Home Corporation, as Applicant and Sundance Holdings, Inc. , as Owner. CONSIDERATIONS A petition has been filed by Pulte Home Corporation requesting a zoning map amendment from MFR Multiple Family Residence District to PMFR Planned Multiple Family Residence District. The subject property is located at 1101 South Randall Road. The applicant proposes to develop the subject property with a townhome community. The proposed development features 32 buildings containing a total of 162 dwelling units. FINDINGS After due notice, as required by law, the Planning and Development Commission held a public hearing on Petition 38-96 on July 15, 1996 . The applicant presented the petition. A Planned Development Review prepared by the Planning Department, dated July 9, 1996, and a transcription of the public hearing are attached and made a part of these Findings and Recommendation. The Planning and Development Commission made the following findings with respect to Petition 38-96: A. Site Characteristics. The subject property is an irregularly shaped parcel containing approximately 20. 1 acres. There are scattered pockets of wetlands on the property that are being mitigated to a larger wetland/detention area located to the east of the development, across Umbdenstock Road extended. B. Sewer and Water. The subject property will be served with Page 1 FOF38. 96/PZTEXT/3000DV.SV/3200PD.PC/3261PD.DT/3261PLAN. 96/PET38 .96 G. Comprehensive Plan. The subject property is designated "urban residential" by the Official Comprehensive Plan of Elgin. RECOMMENDATION The Planning and Development Commission recommends approval of Petition 38-96 . On a motion to recommend approval of the petition, subject to the following conditions, the vote was five yes, zero no, and one abstention. 1. Submission of an easement document providing for the future extension of a bicycle/pedestrian pathway along Randall Road. 2. Substantial conformance with the Development Application for "Sierra South" prepared by Pulte Home Corporation, dated June 10, 1996 . 3. Compliance with all other applicable codes and ordinances.
