HomeMy WebLinkAboutG19-96 1 ♦ > > Ordinance No. G19-96 AN ORDINANCE GRANTING A CONDITIONAL USE FOR A BANK DRIVE THROUGH FACILITY AT 998 SOUTH MCLEAN BOULEVARD WHEREAS, written application has been made for an NB Neighborhood Business District conditional use for a bank drive through facility at 998 South McLean Boulevard; and WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Zoning and Subdivision Hearing Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Zoning and Subdivision Hearing Board, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. eft Section 2 . That a conditional use for a bank drive through facility at 998 South McLean Boulevard and legally described as follows : LOT 17 OF PINE MEADOW SUBDIVISION, BEING A SUBDIVISION OF PART OF THE SOUTHWEST QUARTER, AND PART OF THE NORTHWEST QUARTER OF SECTION 27, TOWNSHIP 41 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED OCTOBER 19, 1990, AS DOCUMENT NO. 90K55267 , IN THE CITY OF ELGIN, ELGIN TOWNSHIP, KANE COUNTY, ILLINOIS. be and is hereby granted subject to the following conditions : 1 . Substantial conformance with the site plan prepared by Architects 127 & Associates, Inc. , dated February 21, 1996, subject to the review and approval of roadway access by the Kane County Division of Transportation 2 . Provide for the minimum required landscaping for a transition landscape yard less than 50 feet in depth in conformance with EMC �., 19 . 12 . 700(A) . 3 . CONSIDERATIONS A petition has been filed by Sentry Construction Co. , Inc. requesting a NB Neighborhood Business District conditional use for a bank drive through facility. The subject property is located at 998 South McLean Boulevard. The petitioner proposes to develop the subject property with a multiple tenant neighborhood commercial center, including a bank with a drive through facility. FINDINGS After due notice, as required by law, the Zoning and Subdivision Hearing Board conducted a public hearing to consider Petition 10-96 on March 6 , 1996 . The applicant presented the request for a NB Neighborhood Business District conditional use for a "drive-through" associated with a proposed bank. A Conditional Use Review prepared by the Planning Department, dated February 26, 1996, and a transcription of the public hearing are attached and made a part of these Findings and Recommendation. Site Characteristics The subject property contains 2 .53 acres . The property is unimproved. Sewer and Water The property can be seviced with municipal sanitary sewer and water service. The two streets function as part of the arterial street system serving Elgin and the Village of South Elgin. A total of 93 parking spaces are proposed to serve the 20, 390 square foot neighborhood commercial center. A total of 82 spaces are required if all tenant spaces are occupied with traditional retail and commercial service uses . Occupancy is dependent on the prospective tenant documenting the existence of adequate parking to serve all uses in the commercial center. Zoning History The subject property was annexed and zoned B-3 Service Business District in 1990 . The property was rezoned to NB Neighborhood Business District in 1992 . Zoning Status The subject property is unimproved. Development of the property is subject to compliance with the NB District standards. Surrounding Land Use and Zoning The areas located to the north and west of the subject property are zoned PRC Planned Residence Conservation District. The areas are developed with townhomes (Pine Meadows) . The area located to the east of the subject property is zoned ORI Office, Research, Industrial District. The area is developing with light manufacturing uses (Fox Bluff Corporate Center) . The area located to the south of the subject property is in the Village of South Elgin and is zoned for commercial development (Heartland Meadows Subdivision) . The commercial area is unimproved. Trend of Development The area in which the subject property is located is developing with a wide range of land uses, including single family residences, townhomes, commercial uses, and industrial uses . Comprehensive Plan The subject property is designated "urban residential" . The Neighborhood Business District zoning is consistent with the "transportation corridor" designations along Bowes Road and South McLean Boulevard. On a motion to recommend approval of the petition subject to the following conditions, the vote was four yes and zero no. 1 . Substantial conformance with the site plan prepared by Architects 127 & Associates, Inc. , dated February 21, 1996 , subject to the review and approval of roadway access by the Kane County Division of Transportation. 2 .
