AN ORDINANCE
AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTY
FOR PUBLIC PURPOSES
(32-52 SOUTH GROVE AVENUE - ONE-HALF INTEREST IN LOT F)
WHEREAS, the City of Elgin has previously entered into an
agreement for commercial development to assist Center City
Development Corporation in the acquisition of the property
commonly known as 32-52 South Grove Avenue; and
WHEREAS, the purpose of assisting in the acquisition of
said property was to provide for and advance the commercial,
civic, cultural and general economic development of the City
of Elgin, to aid, encourage, support and assist with the
economic redevelopment of the downtown area of the City of
Elgin, to encourage the use of real property located within
the area described in the City of Elgin Center City Master
Plan and to provide for the redevelopment and renovation of
the city' s downtown area in order to increase the city' s tax
base and provide employment opportunities within said area; and
WHEREAS, title to said property has since been
transferred from the Center City Development Corporation to
the City of Elgin; and
WHEREAS, the city holds title to the entire subject
property with the exception of a one-half undivided interest
in Lot F; and
WHEREAS, the City Council of the City of Elgin has
determined that it is necessary and desirable to obtain the
remaining one-half undivided interest in Lot F for public
purposes including but not limited to obtaining clear and
quiet title to said property and providing for the continued
redevelopment and renovation of the city' s downtown area in
order to increase the city' s tax base and provide employment
opportunities; and
WHEREAS, the City of Elgin is a home rule unit authorized
to exercise any power and perform any function relating to its
government and affairs; and
WHEREAS, acquiring property for public purposes including
but not limited to obtaining quiet title to city owned
property and providing for the continued redevelopment and
renovation of the city' s downtown area in order to increase
the city' s tax base and provide employment opportunities is
within the government and affairs of the City of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That it is hereby determined that certain
property in the City of Elgin, Kane County, Illinois,
hereinafter described, be acquired for public purposes .
Section 2 . That it is hereby determined that it is
necessary and desirable that the City of Elgin shall acquire
title to and possession of the following described real
property, which property is necessary, required and needed for
public purposes lying wholly within the limits of the City of
Elgin, to wit:
That part of Lot "F" lying easterly of the
easterly line of Riverside Avenue in Harvey and
Amick' s Subdivision of Lot 6 and 7 in Block 21 of
James T. Gifford' s Plat of Elgin, according to the
plat of said Harvey and Amick' s Subdivision Recorded
April 17 , 1866 , in Book 2 of Maps, Page 139-1/2 , in
the City of Elgin, Kane County, Illinois .
Section 3 . That Richard B. Helwig, City Manager of the
City of Elgin, or his designee, be and is hereby authorized,
empowered and directed to negotiate for and on behalf of the
City of Elgin with the owner or owners of the above described
real property for the purchase of the real property described
by the City of Elgin.
Section 4 . That the City Manager, or his designee, be
and is hereby authorized to offer $35,000 as and for
compensation to the owner or owners of the above-described
property.
Section 5 . That in the event that the City Manager is
unable to agree with the owner or owners of said property as
to compensation to be paid therefor, in accordance with the
provisions of this ordinance, then title to and possession of
said property shall be acquired by the City of Elgin in
accordance with the laws of eminent domain of the State of
Illinois, and the Corporation Counsel is hereby authorized,
empowered and directed to institute appropriate proceedings in
any court of competent jurisdiction to acquire title to and
possession of said property for the City of Elgin in
accordance with the eminent domain laws of the State of
Illinois .
