AN ORDINANCE
RECLASSIFYING PROPERTY AT 300-302 DOUGLAS AVENUE AND GRANTING A
CONDITIONAL USE FOR A PLANNED DEVELOPMENT TO PERMIT OFFICES
WHEREAS, written application has been made to reclassify
certain property located at 300-302 Douglas Avenue from RC3
Residence Conservation District to CF Community Facility
District and for a conditional use for a planned development
to permit offices; and
WHEREAS, the Planning and Development Commission has
conducted a public hearing concerning said application and has
submitted its written findings and recommendation that the
subject property be reclassified and a conditional use for a
planned development to permit offices be granted; and
WHEREAS, the City Council has reviewed the findings and
recommendation of the Planning and Development Commission and
concurs in such recommendations .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS :
r Section 1 . That Chapter 19 . 08, Section 19 . 08 . 020
entitled "Zoning District Map" of the Elgin Municipal Code,
1976, as amended, be and the same is hereby further amended by
adding thereto the following paragraph:
"The boundaries hereinafter laid out in the
' Zoning District Map' , as amended, be and are hereby
altered by excluding from the RC3 Residence
Conservation District and including in the CF
Community Facility District, the following described
property:
Map Amendment
That part of Block 7 of P.J. Kimball ' s Jr.
Third Addition to Elgin, described as follows :
Commencing at a point on the East line of Brook
Street which is 16 rods South of the Northeast
corner of said Block 7 ; thence East parallel with
the North line of said Block 7 , 8 rods; thence North
parallel with Brook Street 4 rods, to the point of
beginning; thence North parallel with Brook Street 4
rods; thence East parallel with the North line of
said block, 4 rods; thence South parallel with Brook
Street 4 rods; thence West parallel with the North
line of said block, 4 rods to the place of
beginning; in the City of Elgin, Kane County,
Illinois .
Conditional Use for a Planned Development
That part of Block 7 of P.J. Kimball ' s Jr.
Third Addition to Elgin, described as follows :
Commencing at a point on the East line of Brook
Street which is 16 rods South of the Northeast
corner of said Block 7 ; thence East parallel with
the North line of said Block 7 , 8 rods, to the point
of beginning; thence North parallel with Brook
Street 4 rods; thence East parallel with the North
line of said block, 4 rods; thence South parallel
with Brook Street 4 rods; thence West parallel with
the North line of said block, 4 rods to the place of
beginning;
and
The South 4 rods of the North 16 rods of the
East 8 rods of Block 7 of P.J. Kimball ' s Jr. Third
Addition to Elgin, in the City of Elgin, Kane
County, Illinois . "
Section 2 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Planning and
Development Commission granting a conditional use for a
r planned development to permit offices at 300-302 Douglas
Avenue, a copy of which is attached hereto as Exhibit A and
incorporated herein by reference, subject to the following
conditions :
1 . The subject property shall be converted to
a two family residence upon discontinuation by
Neighborhood Housing Services of ownership and/or
occupancy.
2 . At the time the two family residence is
established the subject property shall meet all
applicable and ordinance including the paving of the
residential vehicle use area.
3 . Upon the sale of the northerly portion of
the subject property to the Salvation Army a common
access easement shall be established for access to
the Salvation Army portion of Parcel 2 via the
existing driveway.
4 . Compliance with all other applicable codes
and ordinances .
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
(0- passage of this ordinance.

Section 4 . That this ordinance shall be in full force
and effect from and after its passage in the manner provided
by law.
