AN ORDINANCE
AMENDING AN APPROVED PLANNED DEVELOPMENT PLAN
FOR THE PROPERTY LOCATED AT 2000-2056 JEFFREY LANE
WHEREAS, written application has been made to amend the
approved planned development plan for a PMFR Planned Multiple
Family Residence District at 2000-2056 Jeffrey Lane to amend
the site plan for the townhomes to be located west of North
Lyle Avenue; and
WHEREAS, the Planning and Development Commission has
conducted a public hearing after due notice in the manner
required by law and has submitted its written findings and
recommended approval; and
WHEREAS, the City Council of the City of Elgin, Illinois,
concurs in the findings and recommendations of the Planning
and Development Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS :
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Planning and
eft Development Commission, a copy of which is attached hereto and
made a part hereof by reference as Exhibit A.
Section 2 . That the approved planned development plan
for the property located at 2000-2056 Jeffrey Lane and legally
described as follows :
Lot 3 of Century Oaks Square, Unit No. 2, being
a subdivision of the East Half of Fractional
Section 4 , Township 41 North, Range 8 East of the
Third Principal Meridian, in the City of Elgin, Kane
County, Illinois .
be and is hereby amended by amending the site plan for the
townhomes to be located west of North Lyle Avenue, subject to
the following conditions :
1 . Compliance with the "Century Oaks Square
Amendment to the Approved Final Plan Prepared for
Wencek Builders, Inc . " , prepared by Burnidge Cassell
and Associates, dated June, 1995 .
2 . Compliance with all applicable codes and
ordinances .
Section 3 . That all ordinances or parts of ordinances in
r- conflict with the provisions of this ordinance be and are
hereby repealed.
o Section 4 . That this ordinance shall be in full force
and effect from and after its passage in the manner provided
by law.

FINDINGS OF FACT
PLANNING AND DEVELOPMENT COMMISSION
CITY OF ELGIN
I . SUBJECT
Consideration of Petition 22-95 Requesting an Amendment
to Ordinance No. G45-93 Which Reclassified Property
Commonly Known as Century Oaks Square, in Order to Amend
the Approved Planned Development Plan; Property Located at
2000-2056 Jeffrey Lane; by Burnidge Cassell and
Associates, as Applicant and Philip J. Wencek, in care of
Wencek Builders, as Owner.
II . CONSIDERATIONS
A petition has been filed by Burnidge Cassell and
Associates requesting an amendment to Ordinance No. G45-93,
which reclassified property commonly known as Century Oaks
Square. The subject property is located at 2000-2056
Jeffrey Lane.
The petitioner proposes to amend the approved planned
development plan for the townhomes to be located west of
North Lyle Avenue. The proposed changes include fewer
units than previously approved (43 units proposed/52
originally approved) and a change to the building
elevations and floor plans.
III . FINDINGS
After due notice, as required by law, the Planning and
Development Commission held a public hearing on Petition
22-95 on July 17, 1995 . The petitioner testified at the
public hearing. Proponents of the petition did not
testify at the public hearing, and objectors to the
petition did not testify at the public hearing. Written
correspondence in support of the petition has not been
submitted, and written correspondence in objection to the
petition has not been submitted.
The Planning and Development Commission has made the
following findings with respect to Petition 22-95:

A. Site Characteristics
The subject property contains approximately 281,398
square feet (6 .46 acres) and is unimproved.
B. Sewer and Water
The subject property is served with municipal sewer
and water service. The proposed amendment to the
planned development plan will have no impact on the
provision of sewer and water service to the subject
property.
C. Traffic and Parking
Jeffrey Lane is a private street which serves the
planned development. Traffic counts are unavailable
for Jeffrey Lane. Access to North Lyle Avenue is via
Jeffrey Lane. No direct access from dwelling units to
North Lyle Avenue is permitted. An emergency access
to Big Timber Road was previously approved and will
continue to be provided in the revised plan.
The petitioner proposes to provide four off street
parking stalls per dwelling unit, two per unit in
garages and two per unit in front of the garages .

The subject property is unimproved, but could be
developed in substantial compliance with the approved
planned development plan.

The area located to the north of the subject property
is zoned TFR Two Family Residence District and is
developed with duplexes (Century Oaks West) .

The area located to the west is located in
unincorporated Kane County and is developed with a
single family residence.
The area located to the southeast is zoned PNB Planned
Neighborhood Business District and is undeveloped.
The area located to the east of the subject property
is zoned PMFR Planned Multiple Family Residence
District and is developing with townhomes (Century
Oaks Square) .
G. Trend of Development
The area surrounding the subject property is
developing with residential, office and community
facility uses.
H. Comprehensive Plan
The subject property is designated urban residential
in the Comprehensive Plan and in the Northwest Area
Plan.
IV. RECOMMENDATION
On a motion to recommend approval of Petition 22-95 ,
subject to the following conditions:
1. Substantial compliance with the "Century Oaks Square
Amendment to the Approved Final Plan Prepared for
Wencek Builders, Inc. " , prepared by Burnidge Cassell
and Associates, dated June, 1995 .
2 . Compliance with all applicable codes and ordinances .
the vote was six yes and zero no.
Therefore, the motion to recommend approval of Petition
22-95 was adopted.
