AN ORDINANCE
GRANTING A CONDITIONAL USE FOR MOTOR VEHICLE REPAIR
AT 910 EAST CHICAGO STREET
WHEREAS, written application has been made for a CI
Commercial Industrial District conditional use for motor
vehicle repair at 910 East Chicago Street; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice by publication and
has submitted its findings of fact and recommended approval;
and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Zoning and Subdivision
Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for motor vehicle
repair at 910 East Chicago Street and legally described as
follows :
THAT PART OF LOT 11 IN COUNTY CLERKS
SUBDIVISION OF PART OF THE SOUTHWEST QUARTER OF
SECTION 18, TOWNSHIP 41 NORTH, RANGE 9 EAST OF THE
THIRD PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS:
BEGINNING AT A POINT IN THE NORTH LINE OF CHICAGO
STREET, WHICH POINT IS ALSO THE INTERSECTION OF THE
NORTH LINE OF CHICAGO STREET AND THE EAST LINE OF
THE ETTNER TRACT; THENCE SOUTH 67 DEGREES AND 14
MINUTES EAST ALONG THE NORTH LINE OF CHICAGO STREET

ordinances .
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect immediately after its passage in the manner
provided by law.

ZONING AND SUBDIVISION HEARING BOARD
CITY OF ELGIN
I . SUBJECT
Consideration of Petition 41-94 Requesting an Amendment to a
CI Commercial Industrial District Conditional Use for Motor
Vehicle Repair; Property Located at 910 East Chicago Street;
by Joseph P. Maslanka, as Applicant, and First Colonial
Trust Company, Trust No. 6441, as Owner.
II . CONSIDERATIONS
A petition has been filed by Joseph P. Maslanka requesting
an amendment to a CI Commercial Industrial District
conditional use for motor vehicle repair. The subject
property is located at 910 East Chicago Street.
The petitioner desires to expand the existing motor vehicle
repair business. Subsequent to expansion, the business
would include 10 service bays, indoor storage for vehicles
and parts, and additional off-street parking.
III . FINDINGS
After due notice, as required by law, the Zoning and
Subdivision Hearing Board held a public hearing on Petition
41-94 on September 21, 1994 . The petitioner testified at
the public hearing. No other testimony was heard for or
against the petition.
A Petition Review, dated September 13, 1994 was submitted by
the Planning Department, which neither recommended approval
nor denial of Petition 41-94 . This Petition Review, along
with the exhibits attached thereto, and the written
transcription of the proceedings of the public hearing, are
attached hereto and made a part hereof.
The Zoning and Subdivision Hearing Board made the following
findings with respect to Petition 41-94 :

A. Site Characteristics
The subject property contains approximately 101,578
square feet. There is an abrupt grade change of
approximately 20 to 25 feet behind t1'e existing
improvements . The property is traversed by a drainage
swale.
The property is improved with two commercial buildings
(motor vehicle rental business and motor vehicle repair
business) and accessory off-street parking.
B. Sewer and Water
The existing buildings are connected to municipal
sanitary sewer and water systems . Stormwater flows
overland to a swale which drains to the Lord's Park
Tributary of Poplar Creek.
C. Traffic and Parking
East Chicago Street (Illinois State Route 19) functions
as an arterial street serving Elgin's east side. Route
19 connects Elgin with the Chicago metropolitan area.
Trip generation information is unavailable for motor
vehicle repair businesses .
The motor vehicle repair business, with the proposed
expansion, is required to provide a total of 30
off-street parking spaces . The petitioner proposes to
provide 33 spaces .

The area located to the north of the subject property
is zoned CF Community Facility District. The area is
developed with a nursing care facility.
The areas located to the south, east, and west of the
subject property are zoned CI Commercial Industrial
District. These areas are developed with a variety of
commercial uses including a garden center, new and used
auto dealerships, and other auto related uses .
G. Trend of Development
The area in which the subject property is located is
developing with a variety of commercial and industrial
uses. The most prevalent uses relate to automobile
sales and service.
H. Comprehensive Plan
The area in which the subject property is located is
designated as a "transportation corridor" .
IV. RECOMMENDATIONS
On a motion to recommend approval of Petition 41-94, subject
to the following conditions :
1 . Revisions to the site plan to demonstrate general
conformance with the off-street parking and site design
regulations, including:
- surfacing
- perimeter curb
- aisles and stalls
- striping
- landscaping
2 . Substantial conformance with the revised site plan.
3 . The following improvements and minor changes to the
above referenced site plan shall be allowed subject to
compliance with all applicable codes and ordinances,
and without requiring an amendment to the conditional
use ordinance:
- adjustment to the location of parking lots or

buildings by 20 feet or less
- signs
- fences
- obstructions in yards
4 . Compliance with all applicable codes and ordinances .

Therefore, the motion to recommend approval of Petition
