STATE OF ILLINOIS ) ss . COUNTY OF KANE CERTIFICATE I , Dolonna Mecum, certify that I am the duly appointed and acting municipal clerk of the City of Elgin, Cook and Kane Counties, Illinois . I further certify that on June 14, 1995, the Corporate Authorities of such municipality passed and approved Ordinance No. G39-95, entitled An Ordinance Amending Chapter 10 . 65 Entitled "Vandalism" of the Elgin Municipal Code, 1976 , as Amended which provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. G39-95, including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the municipal building, commencing on June 15, 1995, and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the office of the municipal clerk. DATED at Elgin, Illinois, on June 15, 1995. lA Municipal Clerk (SEAL) r Ordinance No. G39-95 AN ORDINANCE AMENDING CHAPTER 10. 65 ENTITLED "VANDALISM" OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Section 10 . 65 . 020 of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows : "10 . 65 . 020 PROHIBITED ACTS DESIGNATED. It is unlawful for any person to commit any of the following acts within the corporate limits of the city: A. Willfully, recklessly, or knowingly damage, deface, or destroy any property of another without his consent; B. Knowingly and without authority enter into or obtain control over any motor vehicle, bicycle, building, house, trailer, aircraft, or watercraft or any part thereof of another person without his consent. " Section 2 . That Section 10 . 65 . 030B of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows : "B. A minor shall be deemed to have committed the offenses enumerated in this chapter with the knowledge, consent, acquiescence, and permission of such minor's parent or legal guardian. Such parent or legal guardian shall be liable for the payment of any fine, requirement of restitution or reparation which may be imposed by a court upon the minor defendant for a violation of this chapter. Parental responsibility under this section shall apply where a parent or legal guardian has received written notice, either by certified or registered mail, return receipt requested, or by personal service of summons or notice to appear. " Section 3 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. row Section 4 . That this ordinance shall be in full force and effect 10 days after its passage and publication in pamphlet form or by newspaper in the manner provided by law.
