HomeMy WebLinkAboutG20-95 t Ordinance No. G20-95 AN ORDINANCE AMENDING A PCF PLANNED COMMUNITY FACILITY DISTRICT FOR A MEDICAL COMPLEX (SHERMAN HOSPITAL) WHEREAS, written application has been made to amend the PCF Planned Community Facility District for a medical complex at 934 Center Street; and WHEREAS, the Planning and Development Commission conducted a public hearing after due notice in the manner required by law and has submitted its written findings and recommended approval; and WHEREAS, the City Council of the City of Elgin, Illinois, concurs with the findings and recommendation of the Planning and Development Commission. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Planning and Development Commission, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2 . That the provisions of Ordinance No. G30-91 which amended the planned unit development for a medical complex and the provisions of Ordinance No. G31-91 granting a variation for a special sign district are hereby consolidated and are amended pursuant to the provisions of Chapter 19 . 60 Planned Developments of the Elgin Municipal Code, 1976, as amended, for the following described real estate: LOTS 1, 2 , 3, 4 , 5, 6, 7 , 8, 9 , 10, 11, 12 , 13, 14 , 15, AND 16 IN BLOCK I AND LOTS 1, 2 , 3, 4, 5, 6 , 7 , AND 8 IN BLOCK II AND THAT PART OF VACATED CENTER STREET LYING WESTERLY OF SAID ADJOINING LOTS 1 THROUGH 8 IN BLOCK II , ALL IN SLADE ' S ADDITION TO ELGIN, ALSO LOTS 1, 2 , 3, 4 , 5, 6 , 7 , AND 8 IN BLOCK IV OF CONGDON' S 2ND ADDITION TO ELGIN, ALSO LOTS 11, 12 , 13, 14 , 15, 16 , 17, 18, 19 , AND 20 OF BLOCK I OF GROTE AND WALDRON' S 2ND ADDITION TO ELGIN, ALSO LOTS 1, 2 , AND 3 IN BLOCK III OF GROTE AND WALDRON' S SECOND ADDITION TO ELGIN, IN THE CITY OF ELGIN, ELGIN TOWNSHIP, KANE COUNTY, ILLINOIS. Section 3 . The Sherman Hospital PCF Planned Community Facility District shall be developed, designed, and operated subject to: r A. PURPOSE AND INTENT The purpose and intent of the Sherman Hospital PCF District is to provide a planned environment for a medical complex located within an established residential neighborhood, subject to the provisions of Chapter 19 . 60 Planned Developments of the Elgin Municipal Code, 1976 , as amended. B. SUPPLEMENTARY REGULATIONS Any word or phrase contained within this ordinance followed by the symbol " (SR) " shall be subject to the definitions and the additional interpretative requirements provided in Chapter 19 . 90 Supplementary Regulations of the Elgin Municipal Code, 1976, as amended. The exclusion of such symbol shall not exempt such word or phrase from the applicable supplementary regulation. C . GENERAL PROVISIONS In the Sherman Hospital PCF District, the use and development of land and structures shall be subject to rft. the provisions of Chapter 19 . 05 General Provisions of the Elgin Municipal Code, 1976 , as amended. D. ZONING DISTRICTS In the Sherman Hospital PCF District, the use and development of land and structures shall be subject to the provisions of Chapter 19 . 07 Zoning Districts of the Elgin Municipal Code, 1976, as amended. E . LOCATION AND SIZE OF DISTRICT The location of the Sherman Hospital PCF District is in substantial conformance with the official comprehensive plan. The PCF District contains more than two acres of land pursuant to the provisions of Chapter 19 . 30 . 525 Location and Size of District of the Elgin Municipal Code, 1976 , as amended. F. LAND USE In the Sherman Hospital PCF District, the use and development of land and structures shall be subject to the provisions of Chapter 19 . 10 Land Use of the Elgin Municipal Code, 1976 , as amended. The following enumerated "land uses" (SR) shall be the only land uses allowed as a "permitted use" (SR) or as a "conditional use" (SR) in the Sherman Hospital PCF District. Permitted Uses . The following enumerated land uses shall be the only land uses allowed as a permitted use in the Sherman Hospital PCF District: Health Services . 1 . "Offices and clinics of doctors of medicine" ( 801) 2 . "Offices and clinics of dentists" ( 802 ) 3 . "Offices and clinics of doctors of osteopathy" (803) 4 . "Offices and clinics of other health practitioners" (804) 5 . "Hospitals" ( 806) Construction Division. 1 . "Contractors office and equipment areas" (SR) Transportation, Communication, and Utilities Division. 1 . "Radio and television antennas" (SR) (UNCL) 2 . "Satellite dish antennas" (SR) (UNCL) 3 . "Treatment, transmission, and distribution facilities : poles, wires, cables, conduits, laterals, vaults, pipes, mains, and valves" (SR) (UNCL) rik Miscellaneous Uses . 1 . The following enumerated land uses shall be the only land uses allowed as a conditional use in the Sherman Hospital PCF District: Transportation, Communication, and Utilities Division. 1 . SITE DESIGN In the Sherman Hospital PCF District, except as otherwise provided herein, the use and development of land and structures shall be in substantial conformance with the Existing Conditions Site Plan prepared by Walker Parking Consultants/Engineers, Inc. , dated August 15, 1994 which is attached hereto and made a part hereof by reference as Exhibit B. The heliport shall be located, designed and operated in compliance with the Planned Development Application and Petitioner' s Statement with attached r Exhibits A through J, Submitted by Sherman Hospital, dated December 2 , 1994 , which is attached hereto and made a part hereof by reference as Exhibit C. The use of the heliport shall be limited to use as a restricted landing site for emergency medical purposes only. The Sherman Hospital PCF District shall otherwise be subject to the provisions of Chapter 19 . 12 Site Design of the Elgin Municipal Code, 1976 , as amended. H. OFF-STREET PARKING In the Sherman Hospital PCF District, the location and design of the off-street parking lots and structure shall be in substantial conformance with the Existing Conditions Site Plan prepared by Walker Parking Consultants/Engineers, Inc . , dated August 15, 1994 . A minimum of 1, 046 off-street parking spaces shall be maintained to serve the hospital ( 845 spaces, 2 . 14 spaces/bed) , medical office building ( 180, 6 spaces/physician, maximum 30 physicians ) , and magnetic resonance imaging facility (21 spaces) . Future off-street parking developed south of Slade Avenue and east of Center Street shall proceed in a southerly direction, in a contiguous manner. All off-street parking lots adjoining residential property lines shall be screened with a six foot solid wood fence. Light rak standards in all off-street parking lots shall not exceed 15 feet in height and shall have cutoff luminaires to contain direct light rays within the parking lots . The Sherman Hospital PCF District shall otherwise be subject to the provisions of Chapter 19 . 45 Off-street Parking of the Elgin Municipal Code, 1976 , as amended. I . OFF-STREET LOADING In the Sherman Hospital PCF District, off-street loading facilities shall be located in substantial conformance with the Existing Conditions Site Plan prepared by Walker Parking Consultants/Engineers, Inc . , dated August 15, 1994 . Off-street loading facilities shall otherwise be subject to the provisions of Chapter 19 . 47 Off-street Loading of the Elgin Municipal Code, 1976 , as amended. J . SIGNS In the Sherman Hospital PCF District, signs shall be located and designed in substantial conformance with the Master Signage Plan which is attached hereto and made a part hereof by reference as Exhibit D. Signs shall otherwise be subject to the provisions of Chapter 19 . 50 Signs of the Elgin Municipal Code, 1976 , as amended . K . PLANNED DEVELOPMENTS The Sherman Hospital PCF District shall be subject to the provisions of Chapter 19 . 60 Planned Developments of the Elgin Municipal Code, 1976 , as amended. Amendments to the Sherman Hospital PCF District shall be reviewed for consistency with the Sherman Hospital Long Range Concept Plan prepared by Sherman Hospital and Schmidt, Garden & Erickson, dated July 11, 1983 which is attached hereto and made a part hereof by reference as Exhibit E . L. CONDITIONAL USES In the Sherman Hospital PCF District, the introduction or modification of any conditional use allowed shall be considered an amendment to the planned development and shall be reviewed subject to the provisions of Chapter 19 . 60 Planned Developments of the Elgin Municipal Code, 1976 , as amended. M. VARIATIONS In the Sherman Hospital PCF District, any variation of the requirements of Title 19 zoning Ordinance of the Elgin Municipal Code, 1975 , as amended, and any departure from the terms and conditions of the planned district shall be reviewed subject to the provisions of Chapter 19 . 60 Planned Developments of the Elgin Municipal. APPEALS Any requirement, determination, or interpretation associated with the administration and enforcement of the provisions of this ordinance may be appealed subject to the provisions of Chapter 19 . 75 Appeals of the Elgin Municipal Code, 1976 , as amended. Section 4 . That Ordinance No. G30-91, entitled "An Ordinance Amending Ordinance Nos . G48-87 and G45-90 Amending the Planned Development for a Medical Complex, so as to Permit a Heliport and Temporary Magnetic Resonance Imaging Facility" passed May 8, 1991, be and is hereby repealed. Section 5 . That Ordinance No. G31-91, entitled " An Ordinance Granting a Variation for a Special District" passed May 8, 1991, be and is hereby repealed. Section 6 . That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 7 . That this ordinance shall be in full r force and effect from and after its passage in the manner provided by law. Sherman Hospital proposes to relocate the heliport from its present street grade location near the entrances to the parking deck and the northeast surface parking lot, to the roof of the surgical wing. III . FINDINGS After due notice, as required by law, the Planning and Development Commission held a public hearing on Petition 1-95 on February 20, 1995 . The applicant testified at the public hearing. A Petition Review, dated January 16, 1995, was submitted by the Planning Department, which neither recommended approval nor denial of Petition 1-95 . This Petition Review., along with the exhibits attached thereto, and the written transcription of the proceedings of the public hearing, are attached hereto and made a part hereof. Current Status. Ordinance G48-87, adopted August 12, 1987, which was later incorporated into Ordinance G30-91, authorizes a heliport on a portion of the Hospital campus. Attached hereto as Exhibit B is a site plan on which the present heliport site is located; the legal description of the present heliport site is set forth on Exhibit C. Attached hereto as Exhibit D is a letter from the Flight Safety Coordinator of the Illinois Department of Transportation ( "IDOT") indicating his view that the present heliport site is no longer acceptable to the Department and his opinion that the relocation of the heliport to a site atop the surgical wing is the most desirable alternative available. Applicant desires to comply with the suggested relocation of the heliport and, in order to accomplish same, it is necessary to amend the current P.U.D. Ordinance (G30-91) to authorize construction of the new heliport site as suggested by IDOT, which is depicted on Exhibit E and legally described on Exhibit F. B. Proposal. As Exhibit B indicates, the present heliport site is located at street grade near the entrances to the parking deck and the northeast surface parking lot. Sherman Hospital proposes to relocate the heliport to the roof of the three (3) story surgical wing in accordance with the Roof Floor/Plan attached as Exhibit G. The proposed relocation will have the advantage of facilitating vehicular access to the hospital at times when the heliport is in use and will reduce the disturbance of the surrounding neighborhood by limiting the maximum noise levels to 55 feet above surface grade. Attached hereto as (1) Exhibit H is a copy of the Notice of Landing Area Proposal submitted by Sherman Hospital to the Federal Aviation Administration, (2) Exhibit I is a copy of the Application for Approval of Extension or Alteration submitted by Sherman Hospital to IDOT, and (3) Exhibit J is a Design Narrative dated August 14, 1992, relating to the project. C. Background. Sherman Hospital has been designated by the Illinois Department of Public Health as an area wide Trauma Center since 1974. The Emergency Medical Services (EMS) Systems Act of the State of Illinois requires each Trauma Center to provide helicopter landing capabilities approved by applicable State of Illinois and Federal authorities. Sherman Hospital has experienced an average of five (5) to six (6) helicopter flights . per month over the past three (3) years. The regionalization and categorization of trauma services across the United States has proven to be an efficient method of decreasing mortality and morbidity related to trauma, the primary source of which is motor vehicle accidents. Numerous studies have demonstrated significant improvement in long-term survival statistics of persons who have suffered traumatic injuries resulting from regionalization. Under the Rules and Regulations which implement the Emergency Medical Services (EMS) Systems Act, there is a "bypass provision, " by which, when patients are assessed at the scene of an accident as "trauma victims, " it is incumbent to transport such patients to the closest Trauma Center, bypassing other non- designated hospitals along the way. It is anticipated that, if Sherman Hospital does not retain its designation as a Trauma Center, patients from the Elgin area will need to be transported to either Hoffman Estates, Arlington Heights, or Rockford for trauma care. This would greatly increase the danger to the trauma victims and would require the City of Elgin and other service providers to purchase and staff additional ambulances, as they would spend considerable time traveling outside the community. The Illinois Department of Public Health and the United States Department of Transportation indicate that there are currently only three other helicopter landing areas in the Elgin area, none of which are on the east side of the Fox River. The heliport does not meet our minimum safety standards for a hospital heliport. In recent years we have seen larger helicopters being used in EMS work and a larger number of pilots. As a result we have safety concerns with your landing facility. Our safety rules require a clear area equal to twice the rotor diameter of the largest helicopter to use your facilicty. In addition there is a requirement for 2 approach routes to the heliport clear of obstructions to provide a safe approach path to the landing area. I am listing below the steps necessary to make the existing landing area acceptable. Even with these measures, the heliport will be marginally acceptable from a . safety point of view. We feel siting a heliport or the roof of your facility is the best possible option. ' To clear the approach paths to the heliport the following items need to be addressed. The approach Path from the South 1) Remove 2 trees South of the landing area 2) Trim 2 other trees South of the powerline across the. road to a height no greater than the powerline. The approach path from the East 1) Remove the 9 pine trees immediately East, Northeast of the landing area. 2) Remove the guard shack East of the landing area EXHIBIT eb' page 2 3) Remove a light standard near the -guard shack. 4) Remove 2 signs East of the guard shack 5) Move 1 sign North of the guard shack 50' further North 6) Remove the posts used for chains to block the driveway near the guard shack. 3) Landing area The landing area will be marginally acceptable with the removal of the obstructions listed above. We do recommend removing the floodlights on the parking deck West of the Heliport and the building Northwest. The floodlight on the building Southeast of the landing area should be aimed down to illuminate the landing area. The driveways South and East of the landing area should still be secured to prevent vehicles and people from entering the heliport area whenever a helicopter is present. We have already had in Illinois the unfortunate experience of an ambulance hitting a parked helicopter with considerable damage to the helicopter. I had an opportunity to visit with Walter Clarke and William Suszek to explore alternative sites for the heliport. I believe the best possible option is the rooftop Northeast of the existing landing area. There is access to elevators, and requirements for rooftop heliports have changed in recent years to make them more feasible with some relaxed requirements. I am more than happy to work with your staff and architect on this project. Since one of the helicopter EMS services in your area is getting a larger helicopter in the near future, we feel there is an urgency to do something about your heliport. SHERMAN HOSPITAL SHERMAN HOSPITAL ELGIN, ILLINOIS JULY 11 , 1983 LONG RANGE CONCEPT PLAN EXHIBIT E LONG RANGE CONCEPT PLAN Sherman Hospital has developed a Long Range Concept Plan which is included in this application as an attachment to the planned unit development ordinance. The attached Long Range Concept Plan has been adopted by the Sherman Hospital Board of Managers. The Plan depicts the forseeable future with respect to the present time and the given conditions that exist today. It must be pointed out that a long range plan for a major hospital is a dynamic document which is subject to change due to variable economic conditions and health needs of the service area. The P.U.D. process permits and requires incremental modifications at the time any change of facility is anticipated. The Planning Process Sherman Hospital intends to initiate a long-range planning process which will provide for maximum participation with all interested parties. The plan proposed is outlined as follows: 1. Sherman Hospital will update the Long Range Concept Plan every three years or as conditions change, whichever occurs first. 2. The planning process is to include Sherman Hospital , the neighborhood, the Elgin Planning Committee, the Elgin Land Use Committee, and the Elgin City Council. 3. Sherman . Hospital will amend the Plan to best balance community health care needs, city requirements, and hospital and neighborhood viability. 4. Sherman Hospital will file the Plan as an attachment to the P.U.D. ordinance. Boundaries The proposed long range boundary is a balance between the hospital and the neighborhood. The boundary gives the hospital an area for replacement and expansion while maintaining the residential integrity of the surrounding neighborhood, an aspect which is critical to maintaining the vitality of both hospital and community. The proposed boundary is divided into two areas - a primary development area and a secondary development area. r -1- The primary development area consists of approximately 8 acres and is bounded on the south by Slade Avenue, on the east and west by Prospect Boulevard and Spring Street, and on the north by Cooper Avenue. The secondary development area consists of approximately 5 acres south of Slade Avenue. It includes the Center Street right-of- way and approximately 180 feet east and 160 feet west of Center Street. Residential properties fronting on Prospect Boulevard and Spring Street are not altered and are conserved as individual residences. The property located at the northwest corner of Center Street and Lincoln Avenue is to be returned to use in keeping with the residential neighborhood. This property will be deeded to the City of Elgin when the physical construction shown on the Long Range Concept Plan is completed. The area will be used to provide required off-street parking until that time. Sherman Hospital has agreed to sell all residences it owns north of Cooper Avenue and east of Prospect Boulevard. Sherman Hospital will retain all houses it currently owns south of Slade and in the 800 block of Prospect Boulevard. These residences will be well maintained ,and will be used for single family residences only. Sherman Hospital will use these residences to house students, key employees and for use in recruitment of new employees. This proposed hospital use will serve to provide a transitional buffer zone for adjoining residences. Primary Development Area The area north of Slade Avenue is proposed as the primary area for hospital replacement and expansion. The decision to totally replace the hospital rather than to remodel it was made in 1972 because: 1. Story heights of the existing hospital were too low to accommodate required utility clearances for surgery, radiology and other special uses. 2. Structural and physical limitations prevent adequate resolution of traffic circulation, code problems, and contemporary planning standards. 3. Sequential re-development to keep all departments operating and viable was impossible. (Pk -2- kThe proposed plan provides for complete replacement of Sherman Hospital. Sherman Hospital will be able to increase its total number of beds from four hundred eighteen (418 ) to five hundred fifty (550) , increase the medical office building from thirty (30) physicians to fifty-three (53) , provide the required off- street parking, and respect the long range boundary which has been proposed. While the proposed second phase of the medical office building is acknowledged by the City of Elgin, its approval is not necessarily implied by the City' s acceptance of the Long Range Concept Plan. The approval or denial of the second phase is to be based on an impact evaluation of the first phase of the medical office building. Zoning considerations include use, setbacks, building height, bulk, and off-street parking. 1. Use: The uses of the primary development area include a hospital of both "traditional or customary uses" , a medical office building, an accessory parking structure, and accessory surface parking lots. 2. Setbacks: Building and parking lot setbacks range from a minimum of approximately five (5) feet to a maximum of sixty (60) feet, the existing north and proposed east patient towers are set back from the property lines five (5) feet. All building and parking lot setbacks are to be used exclusively for landscaping and access drives. The design concept suggests the use of compensatory setbacks as follows: a. The taller patient towers are shaped octagonally to reduce length along the sidewalk property line. The • _ remaining distance to the corner at Cooper and Prospect is greater than the tower wall dimension. b. Lower mass of the emergency addition. c. The necessity of patient room windows assures the mass limitation of the addition. d. The sixty (60 ) foot compensatory setback of the emergency addition allows better vision at the intersection. o . Cooper and 2Lospect. -3- • The total yard area open to the street provides a greater area of public space than a constant twenty (20' ) foot setback. This undulation of wall horizontally and vertically will lend interest to the street scene by avoiding the continuous wall which a static setback requirement would necessitate. The octagonal base of the existing surgical pavillion represents the lower floors of the north patient tower and has established the site relationship with the future east patient tower. Setbacks of the medical office building are shown as a minimum of twenty (20) feet to the public rights-of-way, a parking lot setback minimum of eight (8) feet is to be maintained from all public rights-of-way, and existing building and parking encroachments will remain until re- development. 3. Building Height: Building heights range from a minimum of thirty-nine (39 ) feet to a maximum of one hundred forty-seven (147) feet. The plan provides a medical office building at thirty-nine (39 ) feet, the existing parking structure at forty=five (45) feet, and new hospital buildings with varying heights of forty-five (45) feet, one hundred twenty-eight (128) feet, and one hundred forty-seven (147) feet (elevator penthouses) . 4. Bulk: The proposed plan relieves structural bulks by providing variations in building height and setbacks along public rights-of-way. 5. Off-street Parking: The proposed plan provides for fifteen hundred sixty-four (1 ,564) spaces. Approximately one thousand one hundred (1,100) are sized at eight and one-half (8 .5) feet by seventeen and one-half (17.5) feet, and four hundred sixty-four (464 ) spaces (30%) are to be downsized for compact cars. The required number of off-street parking spaces is to be maintained before, during and after all phases of hospital replacement and expansion. Secondary Development Area . The area located south of Slade Avenue is designated only as an accessory surface parking area for the hospital. r -4- Ailk Setbacks for the accessory parking lot located within the Secondary Development Area are to be six (6) feet from interior lot lines and eight (8) from the Slade Avenue right-of-way. Existing encroachments into the setbacks are to be removed simultaneously with the final phase of construction for the surface parking area to be located east of Center Street (to be vacated) . Setback areas are to be used exclusively for landscaping and access drives. The proposed surface parking area east of Center Street (to be vacated) is to be developed from north to south. Residences are to be razed only with each phase of parking development. Premature razing of homes and piecemeal re-development will be avoided. In order to accomplish this entire master plan Sherman Hospital must acquire only two additional residences. The plan includes the razing of nine residences. Neighborhood Park When the final phase of surface parking has been completed, Sherman Hospital will deed to the City of Elgin the southern one hundred twenty-two (122) feet of property which fronts on Lincoln Avenue. This land will also include the vacated portion of Center Street.
