. AN ORDINANCE
AMENDING ORDINANCE NO. S-935, AN ORDINANCE GRANTING
AUTHORIZATION TO CONSTRUCT, OPERATE AND MAINTAIN A
COMMUNITY ANTENNA TELEPHONE SYSTEM IN THE CITY OF ELGIN
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1 . That Section 6( f) is amended to read as
follows :
Within ten days after passage of this
amendatory ordinance, operator shall commence
construction, installation and activation of an
institutional cable system, referred to as "I-Net"
which shall be fiber optic using "Star Bus Star"
architecture or an improved derivation. The I-Net
shall be connected to the following locations with
the fiber counts shown:

each location and outside plant shall be maintained
by operator.
All costs of providing the I-Net including but not
limited to labor, materials, permit fees, right of
way costs, pole rental and engineering services
shall be borne exclusively by operator and said
costs shall not be claimed as external costs under
federal rate rules and regulations and shall not be
included in subscribers ' bills.
Construction, installation and activation of
the "I-Net" shall be completed within 180 days
following passage of this amendatory ordinance.
Section 2 . This ordinance shall be in full force and
effect after its passage in the manner provided by law.

SUBJECT: Institutional Cable Network ( I-NET)
PURPOSE
The purpose of this memorandum is to forward to the Mayor and
City Council an amendment to the ordinance granting a cable
television franchise.
BACKGROUND
♦` In 1984, the City' s cable television franchise ordinance was
[ substantively amended. The amendment provided for Centel
Cable Television Company to become the new operator, a lump
sum $1 million payment as an advance upon future franchise
fees, and system improvements . Included with the system im-
provements was a requirement the operator, now Jones
Intercable, install and activate an I-NET system within six
months of a determination by the City of Elgin that such a
system is necessary and in the public interest. The I-NET is
a cable system, separate and distinct from the subscriber
system, designed to interconnect school buildings, municipal
facilities and the library with the cable operator' s studio.
Its purpose is to carry data, voice and video transmissions
between local sites and to connect into the world-wide infor-
mation network.
In 1992, a User Group representing the above institutions
began meeting to discuss the need for the I-NET. The User
Group determined an I-NET system was necessary and a series
of meetings were held to design the network requirements .
The User Group also met with Jones Intercable to review sys-
tem requirements and to negotiate the implementation of the
I-NET system. After several months of discussion, the par-
ties reached an agreement as to an I-NET system (please see
attached letter from Jones Intercable dated April 22, 1994
with cover memorandum) .

Representatives of the User Group and Jones Intercable will
be present on August 10th to explain the system and its bene-
fits .
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
Members of the User Group: School District U-46, Elgin Commu-
nity College, Gail Borden Library and City of Elgin.
FINANCIAL IMPACT
In order for the City to benefit from and be part of the
I-NET system certain end user equipment will be needed.
Funds for the hardware, estimated at about $40,000, will be
requested as part of the 1995 budget.
LEGAL IMPACT
None.
RECOMMENDATION
it is recommended that the City Council approve the attached
ordinance amendment implementing an I-NET system.

Thank you for all of your time and effort in developing a
workable I-NET system with Jones Intercable.
rft Enclosed is the latest proposal from Jones (April 22nd) which
purports to reflect the understandings reached with the User
Group. You will be interested to know that Jones plans to
install the fibers in conduit rather than standard burial
installation. The use of conduit has pushed the cost of the
project to an estimated $366 ,577 of which Jones will pay 100% .
Due to the initial cost and future maintenance expense of the
I-NET, Jones will not agree to provide the $40, 000 in equip-
ment for operating the system.
Please review the proposal and advise me in writing on whether
or not the proposal accurately reflects the understandings
reached on April 15th. Those letters should be returned to me
by Tuesday, May 3rd.
If the responses are favorable, the franchise agreement with
Jones would need to be amended. I would appreciate receiving
letters of support from the User Group to share with the City
Council prior to consideration of the franchise amendment.
The letter should include information on how the I-NET will
benefit your organization/community. I will be in touch with
you as to the exact date when the City Council will consider
this matter.
Within six months of adopting the franchise amendment, Jones
eft promises to have the I-NET completed.

After a great deal of discussion, engineering, and cooperation I believe that we
have an excellent plan for the I-Net. I feel very confident that this plan will meet
the needs of the City and the User Group for some time to come.

strand counts used were submitted by the user group and will provide a
transportation system that will be faster, more reliable, and flexible than any
metallic based system.

from the City Engineering department, due to the construction techniques
required to feed those locations in an economical fashion.
Jones Intercable will provide the costs associated with labor, materials, permits,
right of way, pole rental, and engineering services. Jones Intercable will deliver
un-connectorized dark fiber to each of the above listed locations. Jones
Intercable will provide the ongoing maintenance of the outside plant.
The estimated cost to complete this project is $366,577 of which Jones
Intercable will pay 100%.
This project as defined above, now meets the needs of the user group and the
City as designed at the meeting on April 15, 1994. If this is agreeable to you,
Jones Intercable will draft language to amend the franchise. After approval of the
ell" amendment Jones Intercable will begin the construction of the network.
