AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A CHILD DAY CARE CENTER
WHEREAS, written application has been made for a CF
Community Facility District conditional use for a child day
care center at 340 Grand Boulevard; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice by publication and
has submitted its findings of fact and recommended approval;
and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Zoning and Subdivision
Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for a child day care
center at 340 Grand Boulevard and legally described as follows:
That part of the Northeast Quarter of
Section 13 Township 41 North, Range 8 East of the
Third Principal Meridian, described as follows :
Beginning at a point on the North line of Franklin
Boulevard 701 . 6 feet East of the point of
intersection of said North line with the East line
of Liberty Street; thence North 520 . 75 feet to the
South line of Block 6 of Highland Park Addition to
Elgin; thence South 898 52 ' East along said South
line 295 . 60 feet to the westerly line of Grand
Boulevard as established by warranty deed from
Mary E. Carpenter Lord to the City of Elgin recorded
July 8, 1896 as Document 24876 and by agreement made
by said first party with Eliza J. Vail recorded
June 10, 1901 as Document 51200 thence southerly
along said westerly line to the North line of said
Franklin Boulevard; thence West along said westerly
line to the North line of said Franklin Boulevard;
thence West along said North line to the point of
beginning, in the City of Elgin, Kane County,
Illinois .
be and is hereby granted subject to the following conditions:
1 . Substantial compliance with the site plan
and floor plan prepared by Bethlehem Lutheran
Church, dated June 17, 1994 .
2 . Construction of the following additional
structures shall be permitted at the subject
property in conjunction with the conditional use for
a church and child day care center, provided said
additional structures are in compliance with all
applicable codes and ordinances:
-- accessory structures and buildings
-- off street parking facilities
-- off street loading facilities
-- signs
3 . Compliance with all other applicable codes
and ordinances .
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect immediately after its passage in the manner

FINDINGS OF FACT
ZONING AND SUBDIVISION HEARING BOARD
CITY OF ELGIN
I . SUBJECT
Consideration of Petition 34-94 Requesting an Amendment to
the Conditional Use for a Church to Include a Child Day
Care Center; Property . Located at 340 Grand Boulevard; by
Bethlehem Lutheran Church, as Applicant and Owner.
II . CONSIDERATIONS
A petition has been filed by Bethlehem Lutheran Church
requesting an amendment to the conditional use for a church
to include a child day care center. The subject property
is located at 340 Grand Boulevard.
The subject property is developed with a church. The
petitioner proposes to amend the conditional use for a
church to include a child day care center, utilizing 12 of
the existing classrooms. The center will accommodate 24
fluk children, ages three to five, Monday through Friday from
6 :30 a.m. to 5:30 p.m. The center will follow the same
holiday schedule as District U46 .
III . FINDINGS
After due notice, as required by law, the Zoning and
Subdivision Hearing Board held a public hearing on
Petition 34-94 on September 7, 1994 . The petitioner
testified at the public hearing. Neither proponents of nor
objectors to the petition testified at the public
hearing. Neither written correspondence in support of nor
objection to the petition has been submitted.
The Zoning and Subdivision Hearing Board has made the
following findings with respect to Petition 34-94 :
A. Site Characteristics
The subject property is an irregularly shaped parcel
containing approximately 2 .4 acres. The subject
property is improved with a church and accessory
parking lot.

B. Sewer and Water
rft. The subject property is served by municipal sewer and
water. Storm water is discharged into municipal storm
sewers . The proposed day care center and preschool
will have no impact on the provision of sewer and
water to the subject property, nor on the control of
storm water from the subject property.
C. Traffic and Parking
Grand Boulevard is a local street serving the Lord's
Park area. Traffic counts are unavailable for Grand
Boulevard adjacent to the subject property.
Franklin Boulevard is a local street serving the
city's near east side. Traffic counts are unavailable
for Franklin Boulevard adjacent to the subject
property. • •
Trip generation information is not available for
churches, day care centers or preschools .
The Off Street Parking Ordinance requires the
provision of at least one parking stall per employee
and one stall per five children. The proposed
facility would serve 39 children. Over 100 parking
stalls are provided at the church.

developed with residences.

The area located to the east of the subject property
is zoned CF Community Facility District and is
developed with Lord's Park.
The area located to the south of the subject property
is zoned RC2 Residence Conservation' District and is
developed with residences .
The area located to the west of the subject property
is zoned CF Community Facility District and is
developed with Elgin Academy's playing fields .
G. Trend of Development
The subject property is located in an area which has
developed primarily with recreational and residential
uses .

H. Comprehensive Plan
The subject property is designated as open space in
the Comprehensive Plan.
IV. RECOMMENDATION
On a motion to recommend approval of Petition 34-94 ,
subject to the following conditions:
1. Revisions to the site plan and floor plan, prepared by
Bethlehem Lutheran Church, dated June 17, 1994 .
2 . Compliance with the revised site plan and floor plan.
3. Construction of the following additional structures
shall be permitted at the subject property in
conjunction with the conditional use for a church and
child day care center, provided said additional
structures are in compliance with all applicable codes
and ordinances:
- accessory structures and buildings
- off street parking facilities
- off street loading facilities
- signs
4 . Compliance with all applicable codes and ordinances.

Therefore, the motion to recommend approval of Petition
34-94 was adopted.
