I further certify that on September 14 , 1994, the Corporate Authorities of such municipality passed and approved Ordinance No. G46-94 , entitled An Ordinance Amending Chapter 6 . 06 Entitled "Alcoholic Liquor Dealers" of the Elgin Municipal Code, 1976 , Adding a Class N Liquor License which provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. G46-94 , including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the municipal building, commencing on September 15, 1994 , and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the office of the municipal clerk. DATED at Elgin, Illinois, on September 15, 1994 . .-')frfi"6-2-1.--1-47 /2/4-C(41-, Municipal Clerk (SEAL) Ordinance No. G46-94 AN ORDINANCE AMENDING CHAPTER 6 . 06 ENTITLED "ALCOHOLIC LIQUOR DEALERS" OF THE ELGIN MUNICIPAL CODE, 1976 , ADDING A CLASS N LIQUOR LICENSE WHEREAS, Elgin Riverboat Resort, an Illinois General Partnership, has applied to the City of Elgin for a liquor license to allow for the sale and consumption of alcoholic liquor in certain designated areas in the riverboat gaming pavilion facilities located at 250 South Grove Avenue, in Elgin, Illinois; and WHEREAS, the Liquor Control Commission has determined that in order to provide for the most appropriate regulation of the sale and consumption of alcoholic liquor on said property that it is necessary and desirable to amend Chapter 6 . 06 of the Elgin Municipal Code to provide for a new Class N license; and WHEREAS, the City of Elgin is an Illinois municipal corporation and a home rule unit pursuant to the Constitution and laws of the State of Illinois; and WHEREAS, a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, the regulation of the sale and consumption of alcoholic liquor is a matter pertaining to the government and affairs of the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Section 6 . 06 . 040 of the Elgin Municipal Code, 1976 , as amended, entitled "License--Classes-- Fees" be and is hereby amended by adding Subsection 0 to read as follows : "O. Class N. For the retail sale of alcoholic liquor at the riverboat gaming pavilion on the premises commonly known as 250 South Grove Avenue, Elgin, Illinois, in the following areas : 1 . First Floor - Designated restaurant area in conjunction with the service of meals for consumption on the premises . 2 . First Floor - Designated food court, snack bar and all seating areas for consumption on the premises . 3 . First Floor - Designated tavern area for consumption on premises . 4 . Second Floor - Designated banquet facility for consumption on premises . 5 . Second Floor - Designated lounge area for consumption on premises . The term "premises" shall include any adjoining interior areas utilized in conjunction with the first floor designated food court, snack bar and seating areas . The term "premises" shall also include any adjoining exterior terrace areas utilized in conjunction with the designated areas . The first floor designated tavern area and the second floor designated lounge area shall be subject to the restrictions for a Class A license as set forth under Section 6 . 06 . 140(0) as amended, relating to the admission of persons who have not attained the age of 21 years, with the exception that such restrictions shall not apply to the second floor designated lounge area when said area is being utilized not as a lounge area but instead as part of the second floor banquet facility. The license fee per year is $2300 . 00 eft Section 2 . That all ordinances or parts thereof in conflict with the provisions of this ordinance be and are hereby repealed. Section 3 . That this ordinance shall be in full force and effect from and after its passage and publication in the manner provided by law.
