TIN AN ORDINANCE
AMENDING CHAPTER 19 , ENTITLED "ZONING" OF THE
ELGIN MUNICIPAL CODE, 1976, AS AMENDED
WHEREAS, written application has been made to amend the
provisions of the zoning ordinance relating to off premise
signs for amusement and recreation services located within a
planned center city zoning district; and
WHEREAS, the Planning and Development Commission held a
public hearing concerning the proposed amendment after due
notice in the manner provided by law; and
WHEREAS, the Planning and Develppment Commission has
submitted its written findings and recommendation that the
requested amendment be granted; and
WHEREAS, the City Council of the Cty of Elgin, Illinois,
concurs in the findings and recommendations of the Planning
and Development Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That Chapter 19 . 50 entitled "Signs" of
Title 19 of the Elgin Municipal Code, 1976, as amended, be and
is hereby further amended by adding Secition 19 .50 . 095 to read
as follows :
19 . 50 . 095 Signs for Planned Center City Districts .
Signs for amusement and relreation services
located within a PCC Planned Ceniter City District
may be located off the premises . Such signs shall
be subject to all of the provision of this chapter,
except as may be specifically p ovided otherwise.
Such signs shall be subject to the following
regulations :
A. General . Signs located off the premises
shall be limited to advertisements for those land
uses classified as "amusementand recreation
services, not elsewhere classified" , as enumerated
in the lists of permitted, conditional, and similar
land uses . Such amusement and recreation services
shall be located within a PCC Planned Center City
District.
B. Zoning District. Signs Located off of the
premises for amusement and re reation services
within a PCC Planned Center Cit District may be

located within any community facility, business, or
industrial zoning district.
C. Size, Number, and Location of Signs .
Signs located off of the premises ' for amusement and
recreation services within a PCC Planned Center City
District may be located on any zoning lot without
affecting the size or number of signs otherwise
permitted on the zoning lot. Such signs shall be
limited to a maximum surface area of 1,200 square
feet and to a maximum height of, 80 linear feet.
There shall be a maximum of five such signs for each
separately owned and operated amusement and
recreation service. Such signs shall be located
within 500 linear feet of al limited access
arterial . A 500 linear foot separation shall be
maintained between all signs erected under the
provisions of this section, wherevdr practicable.
D. Characteristics . Signs located off of the
premises for amusement and recreation services
within a PCC Planned Center Cit District may be
electronically driven message s�gns . Up to a
maximum of 50 percent of the display time shall be
made available for community events sponsored by the
City of Elgin. Signs located off of the premises
for amusement and recreation serv',ices within a PCC
Planned Center City District shall be located on a
monopole supporting structure.
Section 2 . That all ordinances or, parts of ordinances in
conflict with the provisions of this ordinance be and are
hereby repealed.
Section 3 . That this ordinance scall be in full force
and effect after its passage in the manner provided by law.

I . SUBJECT
Petition 39-94 Requesting an endment to Title 19,
Zoning, of the Elgin Municipal Co a concerning Off Premise
Signs for Amusement and Recreatio Services located within
a Planned Center City Zoning istrict by the City of
Elgin, as Applicant.
II. CONSIDERATIONS
A petition has been filed by the City of Elgin requesting
an amendment to Title 19, Zoning of the Elgin Municipal
Code concerning off premise s gns for amusement and
recreation services located withi any Planned Center City
Zoning District. This applicati n has been developed in
cooperation with the Hyatt Dev lopment Corporation and
Nevada Landings in support of the rand Victoria Casino.
As proposed, the off premise sign are not to exceed 1,200
hundred square feet in surface a ea, and the signs are to
be located only along limited acc ss arterials such as the
Northwest Tollway and State Route 0.
III. FINDINGS
After due notice, as required b law, the Planning and
Development Commission held a ublic hearing regarding
Petition 39-94 on July 18, 1994 . The applicant testified
at the hearing, as well as a epresentative of Nevada
Landings .
The Planning and Development Comm4ssion has found that the
provisions for regulating signs should be amended as
follows :
19.50.000 Signs for Planned Cente City Districts.
Signs for amusement and rec eation services located
within a PCC Planned Center City District may be located
off the premises . Such signs sh 11 be subject to all of
the provisions of this chapt r, except as may be
specifically provined otherwise. ' Such signs shall be
subject to the following regulations :

IV. RECOMMENDATION
On a motion to recommend the app oval of Petition 39-94,
the vote was five (5) yes and zero (0) no.
Therefore, the Planning and Development Commission
recommends the approval of Petition 39-94 .

PURPOSE
Petition 39-94 Requesting an Amendment o Title 19, Zoning,
of the Elgin Municipal Code concerning ff Premise Signs for
Amusement and Recreation Services loca ed within a Planned
Center City Zoning District by the City of Elgin, as
Applicant.
r BACKGROUND
A petition has been filed by the City o Elgin requesting an
amendment to Title 19, Zoning, of the lgin Municipal Code
concerning off premise signs for amus ment and recreation
services located within any Planned Center City Zoning
District. This application has been dev loped in cooperation
with the Hyatt Development Corporation a d Nevada Landings in
support of the Grand Victoria Casino.
As proposed, the off premise signs are not to exceed 1200
hundred square feet in surface area, and the signs are to be
located only along limited access ar erials such as the
Northwest Tollway and State Route 20 (see the attached
transcript of the public hearing and t e Findings of Fact,
dated August 1, 1994) .
UNRESOLVED ISSUES
None.

RECOMMENDATION
On a motion to recommend approval of Petition 39-94, subject
to the text contained in the Findingsf Fact, dated August
1, 1994, the vote was five (5) yes and zero (0) no.
Therefore, the Planning and Dvelopment Commission recommends
the approval of Petition 39-94 .
