AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A MOTOR VEHICLE REPAIR SHOP
AT 980 BLUFF CITY BOULEVARD
WHEREAS, written application has been made for a CI
Commercial Industrial District conditional use for a motor
vehicle repair shop at 980 Bluff City Boulevard; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice by publication and
has submitted its findings of fact and recommended approval;
and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Zoning and Subdivision
Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
"'" and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for a motor vehicle
repair shop at 980 Bluff City Boulevard and legally described
as follows :
LOTS 16 TO 18 (EXCEPT THAT PART THEREOF USED
FOR HIGHWAY PURPOSES) AND LOTS 28 TO 30 INCLUSIVE IN
BLOCK 5 IN MASON' S ADDITION TO ELGIN, BEING A
SUBDIVISION OF PART OF LOT 3 IN DIVISION (EXCEPT THE
NORTH WEST 1/4 OF NORTH WEST 1/4 ) IN SECTION 19,
TOWNSHIP 41 NORTH, RANGE 9 EAST OF THE THIRD
PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS .
be and is hereby granted subject to the following conditions :
1 . Compliance with the site plan dated
June 20, 1994 .
2 . No outside storage shall be allowed.
3 . The parking lot may be expanded to permit
additional occupancies in the existing structure,
subject to compliance with the off-street parking
ordinance and all applicable site design regulations .
4 . Signs may be erected on the premises in
compliance with Elgin Municipal Code 19 . 50 Signs .
5 . Compliance with all other applicable codes
and ordinances .
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect immediately after its passage in the manner
provided by law.

FINDINGS OF FACT
ZONING AND SUBDIVISION HEARING BOARD
CITY OF ELGIN
I. SUBJECT
Consideration of Petition 5-94 Requesting a CI Commercial
Industrial District Conditional Use for a Motor Vehicle
Repair Shop; Property Located at 980 Bluff City Boulevard;
by Elgin-O'Hare Auto Body & Repair, as Applicant, and John
Bacon, as Owner.
II. CONSIDERATIONS
A petition has been filed by Elgin-O'Hare Auto Body & Repair
requesting a CI Commercial Industrial District Conditional
Use for a Motor Vehicle Repair Shop. The subject property is
located at 980 Bluff City Boulevard.
The petitioner desires to establish a motor vehicle repair
shop on the subject property. The business would occupy the
largest tenant space in the building. The business
specializes in auto body and general repairs to late model,
classic, and antique motor vehicles.
III. FINDINGS
After due notice, as required by law, the Zoning and
Subdivision Hearing Board held a public hearing on Petition
5-94 on June 15, 1994 . The petitioner testified at the
public hearing.
A Petition Review, dated June 9, 1994, was submitted by the
Planning Department, which neither recommended approval nor
denial of Petition 5-94. This Petition Review, along with
the exhibits attached thereto, and the written
transcription of the proceedings of the public hearing, are
attached hereto and made a part hereof.

tow The Zoning and Subdivision Hearing Board made the following
findings with respect to Petition 5-94 :
A. Site Characteristics
The subject property is a regularly shaped parcel
containing approximately 33,840 square feet. The
property is improved with a one-story block building and
accessory off-street parking.
B. Sewer and Water
The subject property is served with municipal sewer and
water systems.
C. Traffic and Parking
The subject property fronts along Bluff City Boulevard.
Bluff City Boulevard functions as a major collector
street between U.S. Route 20 and Illinois State Route
25.
The existing .off-street parking lot can accomodate 11
standard parking stalls and one accessible parking
stall. The proposed motor vehicle repair business will
have four service bays and three employees. The
off-street parking requirement for the proposed use is
11 spaces (two per service bay and one per employee) .
D. Zoning History
The subject property was rezoned from M-1 Limited
Manufacturing District to CI Commercial Industrial
District in 1992.
E. Zoning Status
The subject property is improved with a lawful
commercial structure and accessory off-street parking.
The structure may be occupied with uses allowed in the
CI District subject to compliance with all applicable
codes and ordinances.
F. Surrounding Land Use and Zoning
The area located to the north of the subject property is
zoned CF Community Facility District. U.S. Route .20 is
located to the immediate north of the subject property.
A cemetery is located to the north of Route 20.
The areas located to the east and west of the subject
are zoned CI Commercial Industrial District. These areas

are developed with a mix of commercial service,
manufacturing, and residential uses.
The area located to the south of the subject property is
zoned CF Community Facility District. Bluff City
Boulevard is located to the immediate south of the
subject property. A cemetery is located to the south of
the roadway.
G. Trend of Development
The areas located north of Bluff City Boulevard, zoned
CI Commercial Industrial District, have developed with a
mix of of commercial service and manufacturing uses. The
CI District was created to recognize mixed
commercial/industrial patterns of development like the
area in which the subject property is located.
H. Comprehensive Plan
The subject property is designated "mixed commercial
industrial" .
IV. RECOMMENDATIONS
On a motion to recommend approval of Petition 5-94, subject
to the following conditions:
1. Revisions to the site plan, including:
- Stripe a minimum of 11 off-street parking spaces.
- Screen any trash receptacles located outside.
2. No outside storage shall be allowed.
3. The parking lot may be expanded to permit additional
occupancies in the existing structure, subject to
compliance with the off-street parking ordinance and all
applicable site design regulations.
4. Signs may be erected on the premises in compliance with
E.M.C. 19.50 Signs.
5. Compliance with all applicable codes and ordinances.
the vote was four yes and zero no.
Therefore, the motion to recommend approval of Petition 5-94
was adopted.
