AN ORDINANCE
AMENDING ORDINANCE NO. G7-93 GRANTING A
CONDITIONAL USE FOR A NURSING AND PERSONAL CARE FACILITY

WHEREAS, written application has been made to amend the
conditional use heretofore granted for a nursing and personal
care facility at 2355 Royal Boulevard; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice in the manner
required by law and has submitted its written findings and
recommended approval; and
WHEREAS, the City Council of the City of Elgin, Illinois,
concurs in the findings and recommendations of the Zoning and
Subdivision Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
and made a part hereof by reference as Exhibit A.
Section 2 . That an amendment to a conditional use for a
nursing and personal care facility at 2355 Royal Boulevard
granted by Ordinance No. G7-93 over the following legally
described property:
Lot 91 of Valley Creek Unit 4, in the City of
Elgin, Kane County, Illinois .
be and is hereby granted subject to the following conditions :
1 . Substantial conformance with the site plan,
prepared by Kuhlmann Design Group, dated April 18,
1994 .
2 . The ground mounted television antenna shall
be a maximum 24 feet in height and the television
antenna tower shall be constructed of silver
colored, galvanized steel .
3 . Compliance with all other applicable codes
and ordinances .
Section 3. That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are
hereby repealed.
Section 4 . That this ordinance shall be in full force
and effect from and after its passage in the manner provided
by law.

FINDINGS OF FACT
ZONING AND SUBDIVISION HEARING BOARD
CITY OF ELGIN
I . SUBJECT
Consideration of Petition 68-93 Requesting an Amendment
to an Existing Conditional Use for a Nursing and
Personal Care Facility, Property Located at 2355 Royal -
Boulevard, by HSM Development Corporation, as
Applicant, and Elgin Real Estate, Incorporated, as
Owner.
II . CONSIDERATIONS
A petition has been filed by HSM Development
Corporation requesting an amendment to an existing
conditional use for a nursing and personal care
facility. The subject property is located at 2355 Royal
Boulevard.
The petitioner requests an amendment to the existing
conditional use in order to modify the parking lot
design and to construct a ground-mounted, 24 foot tall
television antenna tower. The proposed changes to the
previously approved plan do not effect the location and
design of the building, which is now under
construction.
III . FINDINGS
After due notice, as required by law, the Zoning and
Subdivision Hearing Board held a public hearing on
Petition 68-93 on March 16, 1993 . The petitioner
testified at the public hearing. The Planning
Department testified that several contacts were
received from individuals objecting _ to the ground

mounted television antenna. There was no ' other
testimony for or against the petition.
A Petition Review, dated March 11, 1994, was submitted
by the Planning Department, which neither recommended
approval nor denial of Petition 68-93 . This Petition
Review, along with the exhibits attached thereto, and
the written transcription of the proceedings of the
public hearing, are attached hereto and made a part
hereof.
The Zoning and Subdivision Hearing Board has made the
following findings with respect to Petition 68-93:
A. Site Characteristics
The subject property is located at the southeast
corner of Royal Boulevard and Valley Creek Drive.
The 4 .75 acre parcel is being developed with a
45, 380 square foot, 135 bed nursing home.
B. Sewer and Water
The subject property can be served by existing
municipal utilities located in Royal Boulevard and
Valley Creek Drive.
C. Traffic and Parking
Royal Boulevard functions as a collector street
between McLean Boulevard and Randall Road. Valley
Creek Drive functions as a local street.
Nursing homes average approximately 2 .6 weekday
vehicle trips per bed. Accordingly, the 135 bed
facility can be expected to generate 351 weekday
vehicle trips onto the street system.
Development of the property is subject to full
compliance with the off-street parking ordinance.
A -minimum of one parking stall per three beds and
one parking stall per employee working on the
largest shift are required. Accordingly, a total
of 82 parking stalls are required to serve the 135
bed facility with the largest shift having 37
employees .

D. Zoning History
The subject property was annexed and zoned B-1
Community Business District in 1978 . The property
was rezoned to AB Area Business District in 1992 .
The property was rezoned to its present
classification, CF Community Facility District
with a conditional use for a nursing and personal
care facility in 1993 .
E. Zoning Status
The property is being developed with a nursing
home, subject to compliance with the approved
conditional use and all other applicable codes and
ordinances .
F. Surrounding Land Use and Zoning
The areas located to the north, east, and west of
the subject property are zoned AB Area Business
District. These areas are developing with retail
and office uses .
The area located to the south of the subject
property is zoned MFR Multiple Family Residence
District. This area is improved with multiple
family residences .
G. Trend of Development
The subject property is located in Valley Creek
Subdivision. The subdivision is developing as
originally approved with a mix of residential,
commercial, and community facility uses .
H. Comprehensive Plan
The subject property is designated "area
business" .
IV. RECOMMENDATIONS
On a motion to recommend approval of Petition 68-93,
subject to the following conditions :

1 . Revisions to the Site Plan prepared by Kuhlmann
Design Group, dated October 25, 1993, per the
Planning Department.
2 . Conformance with the revised site plan.
3 . The ground mounted television antenna shall be a
maximum 24 feet in height and the television antenna
tower shall be constructed of silver colored,
galvanized steel .
4 . Compliance with all applicable codes and ordinances .
the vote was five yes and zero no.
Therefore, the motion to recommend approval of Petition
68-93 was adopted.
