AN ORDINANCE
ALLOCATING THE COST OF CERTAIN SANITARY SEWER IMPROVEMENTS
TO BENEFITTED PROPERTIES
WHEREAS, 2400 Big Timber Road Venture extended a sanitary
sewer and it is fair and equitable to require benefitted
properties to pay their fair share of the improvement; and
WHEREAS, the installation of said sanitary sewer makes
sewer service available to nearby properties and thereby
benefits said properties; and
WHEREAS, it is fair and equitable to require
reimbursement to 2400 Big Timber Road Venture for a portion of
the cost of said sanitary sewer which benefits such
properties; and
WHEREAS, the additional cost of extending the sanitary
sewer to serve the properties benefitted amounts to
$93,612 . 00; and
WHEREAS, the City Engineer has determined that the
sanitary sewer installation heretofore described will benefit
23 parcels of land with a total of 303 . 82 acres; and
WHEREAS, the City of Elgin is a home rule unit authorized
to exercise any power and to perform any function relating to
its government and affairs; and
WHEREAS, sanitary sewer service is a function pertaining
to the government and affairs of the City of Elgin; and
WHEREAS, the City Council hereby finds that the fair
proportionate share of the cost of the above described
sanitary sewer improvements to properties benefitted by the
availability of such facilities should be computed at the rate
of $303 . 70 per acre.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That no territory described and identified in
Exhibit A, attached hereto and made a part hereof, shall be
(n permitted to connect or otherwise use the sanitary sewer
described herein until such time as payment is made to the
�- City of Elgin of an amount allocated as the fair proportionate
cF} share of said improvement as set forth in Exhibit B, attached
hereto and made a part hereof by reference.
Section 2 . That any property held in common ownership
with other property subject to the provisions of this
ordinance on the effective date of this ordinance shall be
subject to payment based on the entire amount established for
the entire parcel as provided in this ordinance.
Section 3 . That any person desiring to hook on may pay
the amount allocated without interest if payment is made prior
to September 15, 1993 . If full payment is not made prior to
September 15, 1993, then payment shall be made in full plus
interest at the rate of seven (7%) percent per annum accruing
from and after the date of passage of this ordinance until the
date of payment.
Section 4 . That any amounts received by the City
Treasurer pursuant to this ordinance shall be paid to 2400 Big
Timber Venture or their successors or assigns, as
reimbursement for the cost and expense of extending the
sanitary sewer described above.
Section 5 . That a certified copy of this ordinance shall
be recorded with the Recorder of Deeds, Kane County, Illinois .
Section 6 . That this ordinance shall be in full force
and effect from and after its passage in the manner provided
by law.

SUBJECT: Zale Recapture
Under Ordinance T4-93, certain real property described as
"Parcel 6" is subject to the recapture of part of the cost of
water main improvements made in the development of
Woodbridge. According to the ordinance the entire fee is due
for a parcel before any permit is issued. The amounts
collected are payable to the developer as reimbursement for a
part of the developer's costs .
Pulte Home Corporation has purchased a portion of Parcel 6 and
ha obtained the consent of the developer to the payment of
only part of the reimbursement due it and the deferral of the
collection of the balance due until a permit is sought for the
balance of Parcel 6 not owned by Pulte. Zale has also
assigned its rights to the balance of the reimbursement due
from Parcel 6 to Pulte so that when collected the balance
should be remitted to Pulte.
Attached for filing in the office of the City Clerk are the
original copies of the consent and assignment. Photocopies
are attached for the records of the Permit Control Officer.

ZALE GROUP LTD. and RANDALL ROAD DEVELOPMENT CORP. (collectively
"Assignor") do hereby assign unto PULTE HOME CORPORATION, ("Assignee") all rights of
Assignor under Ordinance Number T4-93 enacted September 22, 1993 by the City of Elgin to
receive from the City, all amounts due and payable under the Ordinance from the Owner of that
portion of"Parcel 6" described in the Ordinance which is depicted on Exhibit A attached hereto
and designated as the "Commercial Parcel".
The Commercial Parcel fronts approximately 920 lineal feet of the water main for which
recapture is due under Ordinance Number T4-93 on Bowes Road and fronts approximately 550
lineal feet of such water main along Randall Road for a total of 1,470 lineal feet. At $18.81 per
front foot, the recapturable amount for the Commercial Parcel is calculated to be $27,650.70 plus
interest from December 31, 1993.

Water Recapture Ordinance (Ordinance Number T4-93)
Gentlemen:
On September 22, 1993 you enacted Ordinance Number T4-93 which is intended to
reimburse Zale Group Ltd. for$234,052.81, constituting that portion of the cost of the water
main improvements for the Woodbridge Subdivision which were allocated to properties other
than Woodbridge. Reimbursement under the Ordinance is based on a rate of$18.81 per front
foot for each such owner's property adjoining the improvements.
Pulte Home Corporation is presently applying for a permit for development of certain
property located in "Parcel 6" under the Ordinance. According to the Ordinance the front
footage of Parcel 6 is 2,865 feet and the cost to be recovered is $53,890.65.
Ownership of Parcel 6 is now divided, with 1,395 lineal feet (215 lineal feet on Bowes
Road and 1,180 lineal feet on Randall Road) being owned by Pulte Home Corporation (the
"Pulte Parcel") and 1,470 lineal feet (920 lineal feet on Bowes Road and 550 lineal feet on
Randall Road) being owned by another party (the "Commercial Parcel").
You are hereby authorized to collect and remit to us at this time, only that part of the
recapture for Parcel 6 pertaining to the Pulte Parcel, which is $26,239.95 plus interest at 7% from
December 31, 1993 and to defer collection of that portion of the recapture for Parcel 6 relating to
the Commercial Parcel until the Commercial Parcel seeks development permits. The recapture
for the Commercial Parcel is $27,650.70, plus interest from December 31, 1993.
Furthermore, you are hereby notified that the undersigned has assigned to Pulte Home
Corporation its right to receive the recapture from the Commercial Parcel when it is paid to the
City by the owner of the Commercial Parcel in the future, since Pulte has independently paid to
us the amount we would otherwise have received from the Commercial Parcel had it applied for
permits at the same time as Pulte. We deliver to you herewith a copy of the Assignment.

According to our records, the amount due be paid to us for the Pulte Parcel as of
Thursday, October 31, 1996 is $31,444.21 ($26,239.95 principal and $5,204.26 interest from
December 31, 1993). For each day after October 31 that you do not receive payment on the Pulte
Parcel an additional $5.032 of interest is to be added.
Please remit the payment on the Pulte Parcel, when received, and all payments hereinafter
received pursuant to Ordinance Number T4-93 (except of course the payment from the
Commercial Parcel) to the order of Randall Road Development Corp. which is the beneficiary of
the land trust that owned and developed Woodbridge with Zale Group Ltd., as developer.
Would you kindly indicate your receipt of this Notice and your acknowledgement of the
assignment by signing and returning 3 copies to Pulte.
