HomeMy WebLinkAboutG7-93 fek Ordinance No. G7-93 AN ORDINANCE RECLASSIFYING PROPERTY AT 2355 ROYAL BOULEVARD AND GRANTING A CONDITIONAL USE FOR A NURSING AND PERSONAL CARE FACILITY WHEREAS, written application has been made to reclassify certain property located at 2355 Royal Boulevard from Area Business District to CF Community Facility District and for conditional use approval for a nursing and personal care facility; and WHEREAS, after due notice in the manner provided by law the Planning and Development Commission conducted a public hearing concerning said application and has submitted its written findings and recommendation that the subject property be reclassified and a conditional use for a nursing and personal care facility be granted; and WHEREAS, the City Council has reviewed the findings and recommendation of the Planning and Development Commission and concurs in its recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That Chapter 19 . 07, Section 19 . 07 . 600 entitled "Zoning District Map" of the Elgin Municipal Code, 1976 , as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinafter laid out in the ' Zoning District Map' , as amended, be and are hereby altered by excluding from the AB Area Business District and including in the CF Community Facility District, the following described property: Lot 91 of Valley Creek Unit 4 , in the City of Elgin, Kane County, Illinois . " Section 2 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Planning and Development Commission granting a conditional use for a nursing and personal care facility at 2355 Royal Boulevard, a copy of which is attached hereto as Exhibit A and incorporated herein by reference, subject to the following conditions : 1 . Substantial conformance with the Site Plan prepared by Kuhlmann Design Group, dated October 19 , 1992 . 2 . Compliance with all other applicable codes and ordinances . Section 3 . That the conditional use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 4 . That this ordinance shall be in full force and effect from and after its passage 'n the manner provided by law. January 19, 1993 FINDINGS OF FACT PLANNING AND DEVELOPMENT COMMISSION CITY OF ELGIN I. SUBJECT Consideration of Petition 47-92 Requesting a Rezoning from AB Area Business District to CF Community Facility District and Conditional Use Approval for a Nursing and Personal Care Facility; Property Located at 2355 Royal Boulevard; by HSM Development Corporation, as Applicant and Valley Creek of Elgin, Inc. , as Owner. II. CONSIDERATIONS A petition has been filed by HSM Development Corporation requesting a rezoning from AB Area Business District to CF Community Facility District with a conditional use for a nursing and personal care facility. The subject property is located at 2355 Royal Boulevard. The petitioner proposes to develop the property with a 135 bed nursing and personal care facility. The petitioner has been granted a Certificate of Need by the Illinois Department of Public Health. III. FINDINGS After due notice, as required by law, the Planning and Development Commission held a public hearing on Petition 47-92 on January 4, 1993 . The petitioner testified at the public hearing. Proponents of the petition did not testify at the public hearing, and objectors to the petition did not testify at the public hearing. Written correspondence in support of the petition has not been submitted, and written correspondence in objection to the petition has not been submitted. The Planning and Development Commission has made the following findings with respect the Petition 47-92 : A. Site Characteristics: The subject property is located at the southeast corner of Royal Boulevard and Valley Creek Drive. The unimproved parcel contains 206,817 square feet. B. Sewer and Water: The subject property can be served by existing municipal utilities located in Royal Boulevard and Valley Creek Drive. Exhibit A -Page 1- C. Traffic and Parking: Royal Boulevard functions as a collector street between McLean Boulevard and Randall Road. Valley Creek Drive functions as a local street. Nursing homes average approximately 2.6 weekday vehicle trips per bed. Accordingly, the proposed 135 bed nursing and personal care facility can be expected to generate 351 weekday vehicle trips onto the street system. Development of the subject property is subject to full compliance with the Off-street Parking Ordinance. A minimum of one parking stall per two beds, plus one parking stall per employee based on the peak demand shift are required. D. Zoning History: The subject property was annexed and zoned B-1 Community Business District in 1978. The property was rezoned to AB Area Business District in 1992 . E. Zoning Status : The subject property is unimproved. F. Surrounding Land Use and Zoning: The areas located to the north, east, and west of the subject property are zoned AB District. These areas are developing with retail and office uses. The area located to the south of the subject property is zoned MFR District. This area is improved with multiple family residences. G. Trend of Development: The subject property is located in Valley Creek Subdivision. The subdivision is developing as planned with a mix of residential, commercial, and community facility uses. H. Comprehensive Plan: The subject property is designated "area business" . IV. RECOMMENDATIONS On a motion to recommend approval of Petition 47-92 , subject to the following conditions : 1 . Substantial conformance with the Site Plan prepared by Kuhlmann Design Group, dated October 19, 1992 . 2 . Compliance with all applicable codes and ordinances. the vote was six yes and zero no. Therefore, the motion to recommend approval of Petition 47-92 was adopted. -Page 2- • Robert W.
