AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A CHURCH AT 1451 DUNDEE AVENUE
WHEREAS, written application has been made for a GI
General Industrial District conditional use for a church at
1451 Dundee Avenue; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice by publication and
has submitted its findings of fact and recommended approval;
and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Zoning and Subdivision
Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for a church at
1451 Dundee Avenue and legally described as follows :
THE LEASED PROPERTY OVER THAT PART OF THE WEST
HALF OF THE WEST HALF OF FRACTIONAL SECTION 6 ,
TOWNSHIP 41 NORTH, RANGE 9 EAST OF THE THIRD
PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS:

be and is hereby granted subject to the following conditions :
1 . Substantial compliance with the planned
development application, site plan, and floor plan
prepared by NB, dated November 11, 1993 .
2 . Compliance with all other applicable codes
and ordinances .
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect immediately after its passage in the manner
provided by law.

FINDINGS OF FACT
ZONING AND SUBDIVISION HEARING BOARD
CITY OF ELGIN
I. WBJECT
Consideration of Petition 40-93 Requesting GI General
Industrial District Conditional Use Approval for a
Planned Development, to Allow a Church; Property Located
at 1451 Dundee Avenue; by Church of the Brethren General
Board, as Applicant and Owner.
II. CONSIDERATIONS
A petition has been filed by the Church of the Brethren
requesting GI General Industrial District conditional use
approval for a planned development to include a church.
The subject property is located at 1451 Dundee Avenue .
The petitioner proposes to renovate a portion of
warehouse space in the existing building to permit the
use of that space for assembly purposes for church
services. The assembly area would occupy approximately
7,118 square feet in the present warehouse facility.
III. FINDINGS
After due notice, as required by law, the Zoning and
Subdivision Hearing Board held a public hearing on
Petition 40-93 on October 20, 1993. The petitioner
• testified at the public hearing. Neither proponents of
nor objectors to the petition testified at the public
hearing. Written correspondence in support of the
petition has been submitted, but written correspondence
in objection to the petition has not been submitted.
The Zoning and Subdivision Hearing Board has made the
following findings with respect to Petition 40-93:
A. Site Characteristics

The subject property is improved with general
offices and a warehouse facility, and accessory
off-street parking.
B. Sewer and Water
The subject property is served with existing sewer
and water service.
C. Traffic and Parking
Dundee Avenue functions as a major arterial street.
Stewart Avenue functions as a local street.
The subject property is improved with 116 off-street
parking spaces. A total of 25 parking spaces are
required to serve the 100 member congregation, plus
additional spaces for employees on the premises.
D. Zoning History
The subject property was rezoned from B-4 General
Service District to GI General Industrial District
in 1992.
E. Zoning Status
The subject property is lawful nonconforming with
respect to various GI District site design standards.
F. Surrounding Land Use and Zoning
The areas located to the north and west of the
subject property are zoned CF. The areas are
developed with park and open space, and the State
Route 25/I-90 interchange.
The areas located south and east of the subject
property are zoned RC2. These areas are developed
with single family residences. The parcels located
to the south of the subject property and fronting on
Dundee Avenue are zoned NB, and are developed with
commercial uses.
G. Trend of Development
The subject property is located within a mature,
fully-developed area featuring residential and
commercial uses, parks and open space, and major
transportation facilities.

H. Comprehensive Plan
The subject property is designated "mixed commercial
and industrial" .
IV. RECONfl4ENDATIONS
On a motion to recommend approval of Petition 40-93 ,
subject to the following conditions:
1. Substantial conformance with the planned development
application, site plan, and floor plan.
2. Conformance with all other applicable codes and
ordinances.
the vote was four yes and zero no.
Therefore, the motion to recommend approval of Petition 40-93
was adopted.
