HomeMy WebLinkAboutG58-93 t Ordinance No. G58-93 AN ORDINANCE GRANTING A CONDITIONAL USE FOR AN INDIVIDUAL AND FAMILY SOCIAL SERVICE AGENCY AT 1845 GRANDSTAND PLACE WHEREAS, written application has been made for an AB Area Business District conditional use for an individual and family social service agency at 1845 Grandstand Place; and WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the findings and recommendation of the Zoning and Subdivision Hearing Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That the City Council of the City of Elgin hereby adopts the findings of fact made by the Zoning and Subdivision Hearing Board, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2 . That a conditional use for an individual and family social service center at 1845 Grandstand Place and legally described as follows : Lots 5 and 6 of Larkin-West Professional Park, Inc. , in the City of Elgin, Kane County, Illinois . be and is hereby granted subject to the following conditions : 1 . Substantial compliance with the petitioners statement of purpose and conformance, and with the floor plan prepared by Kirk & Partners, Inc. , dated July 2, 1993 . 2 . Compliance with all other applicable codes and ordinances . Section 3 . That the conditional use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 4 . SUBJECT Consideration of Petition 42-93 Requesting AB Area Business District Conditional Use Approval for an Individual and Family Social Service Center; Property Located at 1845 Grandstand Place; by Ecker Center for Mental Health, Inc. , as Applicant and Albany Bank and Trust Co. , as Owner. • II. CONSIDERATIONS A petition has been filed by the Ecker Center for Mental Health, Inc. requesting AB Area Business District conditional use approval for an individual and family social services agency. The subject property is located at 1845 Grandstand Place. The petitioner proposes to consolidate their scattered facilities at one location. The proposal involves the renovation of the third floor and a portion of the first floor of the existing building for business offices and counseling/treatment rooms associated with the individual and family social service agency. .. III. FINDINGS After due notice, as required by law, the Zoning and Subdivision Hearing Board held a public hearing on Petition 42-93 on October 20, 1993. The petitioner testified at the public hearing. Neither proponents of nor objectors to the petition testified at the public hearing. Neither written correspondence in support of nor in objection to the petition has been submitted. The Zoning and Subdivision Hearing Board has made the following findings with respect to Petition 42-93: -Page 1 - Exhibit A FOFPET42.93/TEXT040/ZON&SUB.DIV ope A. Site Characteristics The subject property occupies two parcels at the terminus of Grandstand Place. The property is improved with a three-story office building and accessory off-street parking. B. Sewer and Water The proposed use will not require any modification to the existing sanitary sewer, water, or storm sewer services to the property. C. Traffic and Parking Grandstand Place is a cul-de-sac street designed and intended to serve the office and commercial uses occupying the abutting properties. There are approximately 149 parking spaces available to serve the multiple tenant building. The 149 spaces exceeds the minimum number required by the off-street parking ordinance. D. Zoning History The subject property was rezoned from B-3 Service Business District to AB Area Business District in 1992. E. Zoning Status The subject property is lawful nonconforming with respect to the AB District site design standards. F. Surrounding Land Use and Zoning The area located to the north of the subject property is zoned RC1. The area is developed with single family residences. The areas located to the south and east of the subject property are zoned AB. These areas are developed with a variety of commercial uses. The area located to the west of the subject property is. zoned CF. The area is developed with facilities owned and operated by Sherman Hospital and St. Joseph Hospital. -Page 2 - FOFPET42.93/TEXT040/ZON&SUB.DIV G. Trend of Development The subject property is located within an fully developed commercial subdivision. H. Comprehensive Plan The subject property is designated "area " business district" . IV. RECOMMENDATIONS On a motion to recommend approval of Petition 42-93 , subject to the following conditions: 1. Substantial conformance with the petitioners statement of purpose and conformance, and with the floor plan prepared by Kirk & Partners, Inc. 2. Compliance with all other applicable codes and ordinances. the vote was four yes and zero no. Therefore, the motion to recommend approval of Petition 42-93 was four yes and zero no.
