AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A PLANNED DEVELOPMENT
AT 321 DIVISION STREET
WHEREAS, written application has been made requesting a
RB Residence Business District Conditional Use for a Planned
Development to permit operation of a youth social activity
center; and
WHEREAS, the Zoning and Subdivision Hearing Board has
conducted a public hearing after due notice and submitted its
written findings and recommendations to the City Council; and
WHEREAS, the City Council has reviewed the
recommendations of the Zoning and Subdivision Hearing Board
and concurs in such recommendations .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for a planned
development for the operation of a youth social activity
center at 321 Division Street, Elgin, Illinois, legally
described as follows :
THAT PART OF BLOCK 1 OF THE ORIGINAL TOWN OF
ELGIN, ON THE EAST SIDE OF FOX RIVER, DESCRIBED AS
FOLLOWS: BEGINNING AT THE NORTHEAST CORNER OF SAID
BLOCK 1; THENCE SOUTH ALONG THE EAST LINE OF BLOCK,
200 FEET TO A POINT 130 FEET NORTH OF THE NORTHEAST
CORNER OF LOT 10 IN SAID BLOCK; THENCE WEST PARALLEL
WITH THE NORTH LINE OF LOTS 10 AND 9 IN SAID BLOCK,
132 FEET; THENCE SOUTH PARALLEL WITH THE EAST LINE
OF SAID BLOCK, 97 FEET; THENCE WEST PARALLEL WITH
THE NORTH LINE OF LOT 8 IN SAID BLOCK, 66 FEET TO
THE EAST LINE OF LOT 5 IN SAID BLOCK; THENCE NORTH
ALONG THE EAST LINE OF LOTS 5, 4, 3, 2, AND 1 OF
SAID BLOCK, 297 FEET TO THE NORTH LINE OF SAID
BLOCK; THENCE EAST ALONG SAID NORTH LINE 198 FEET TO
THE POINT OF BEGINNING; IN THE CITY OF ELGIN, KANE
COUNTY, ILLINOIS.
be and is hereby granted subject to the following conditions :

1 . The use for social activities for persons
between the ages of 14 and 18 of the subject
property shall be limited to a teen club, featuring
food service, game rooms, retail sales, dances and
educational programs .
2 . Compliance with the site plan, prepared by
Burnidge and Cassell Architects, and the
petitioner' s statement, prepared by Michael Powers,
dated April 12, 1993 and attached as Exhibit B,
except as modified by these conditions .
3 . Hours of operation on Monday through
Thursday shall be between the hours of 3 : 30 p.m. and
9 : 30 p.m. On Friday and Saturday closing hour may be
extended to 11 : 00 p.m. No operation shall be
permitted on Sunday.
4 . Two off-duty police officers, to serve as
security officers, shall be hired by the applicant
and stationed on the premises during all hours of
operation. One officer shall be inside the teen
club and one officer shall be outside.
5 . Execution of a written parking agreement
( with the owners of the property located at 33 North
Geneva Street to allow use of the parking lot by the
petitioner from 6 : 00 p.m. until closing; a copy of
said lease shall be filed with the city clerk.
6 . The teen club shall operate as a membership
organization with admission limited to members only.
7 . Maximum capacity of the teen club at any
one time shall be 186 individuals .
8. Compliance with all applicable codes and
ordinances .
9 . Execution and filing with the city clerk of
written consent by the applicant to the conditions
of the special use.
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect after its passage in the manner provided by law.

FINDINGS OF FACT
ZONING AND SUBDIVISION HEARING BOARD
CITY OF ELGIN
I . SUBJECT
Consideration of Petition 39-93 Requesting a RB Residence
Business District Conditional Use for a Planned
Development; Property Located at 321 Division Street; by
Michael Powers, as Applicant, and Dr. and Mrs . Richard C.
Powers, as Owners .
If . CONSIDERATIONS
A petition has been filed by Michael Powers requesting a RB
Residence Business District conditional use for a planned
development. The subject property is located at 321
Division Street.
The petitioner proposes to establish a social club for
teenagers within the existing structure at the subject
property. The teen club would feature food service, game
rooms, retail sales, dances, and educational programs.
III. FINDINGS
After due notice, as required by law, the Zoning and
Subdivision Hearing Board held a public hearing on Petition
39-93 on September 1, 1993. The petitioner testified at
the public hearing. Proponents of the petition testified
at the public hearing, and objectors to the petition
testified at the public hearing. Neither written
correspondence in support of nor in objection to the
petition has been submitted
The Zoning and Subdivision Hearing Board made the
following findings with respect to Petition 39-93 :
A. Site Characteristics
The subject property is an irregularly shaped parcel
containing approximately 46,006 square feet. The subject
property is improved with a structure which was originally
constructed as a single family residence and was adapted

for use as a restaurant and most recently, a doctor's
office. The subject property is also improved with an off
street parking lot.
B. Sewer and Water
The subject property is currently served by municipal sewer
and water services. The proposed conditional use will have
no impact on the provision of sewer and water services to
the subject property.
C. Traffic and Parking
The subject property is located at the southwest corner of
Division Street and Chapel Street. Division and Chapel
Streets are local streets serving the Gifford Park
neighborhood. Trip generation information is not available
for teen clubs .
The off street parking ordinance requires the provision of
at least one off street parking space for each 100 square
feet of floor area. Accordingly, the approximate 3,200
square foot teen club must provide at least 32 off street
parking spaces. The subject property is currently improved
with an off street parking lot which contains 39 parking
spaces .
D. Zoning History •
The subject property was rezoned from B-3 Service Business
District to RB Residence Business District in 1992 .
E. Zoning Status
The use of the subject property as a doctor's office is
considered to be lawful.
F. Surrounding Land Use and Zoning
The area located to the north of the subject property is
zoned RB Residence Business District and is developed with
an office.
The areas located to the northeast and east of the subject
property are zoned CF Community Facility District and are
developed with a temple and a church.
The area located to the south of the subject property is
zoned RC4 Residence Conservation District and is in
residential use.

The area located to the west of the subject property is
zoned RB Residence Business District and is developed with
offices .
G. Trend of Development
The subject property is located in an area which has
developed with office, community facility and residential
uses.
H. Comprehensive Plan
The subject property is designated urban residential .
IV. RECOMMENDATIONS
On a motion to recommend approval of Petition 39-93 ,
subject to the following conditions:
1. Compliance with the site plan, prepared by Burnidge
and Cassell Architects, and the petitioner's
statement, prepared by Michael Powers, dated April 12,
1993.
2 . Hours of operation on weekdays (Monday thru Thursday)
shall be between the hours of 3:30 p.m. and 9 :30
p.m. , inclusive.
3. There shall be a designated security officer on the
premises during all hours of operation.
4. Execution of a formal parking agreement with the
owners of the property located" at 33 North Geneva
Street to allow use of the parking lot by the
petitioner during the petitioner's peak hours of
operation.
5. Compliance with all applicable codes and ordinances.

Therefore, the motion to recommend approval of Petition 39-93
was adopted.

The Concept
Zoo Station is a social club for Elgin area teenagers (12-18). it will require a
nominal, yearly membership fee, e.g., $10, for entrance and will include the
following features:
• fast food service, i.e., burgers, pizza, fries, soda, etc.;
• - game rooms, i.e., pool, ping pong, foosball, video games, big
screen tv, etc.;
• retail outlet for CDs, tapes and youth-oriented clothing, i.e.,
hats, t-shirts, jackets, etc.;
• dances featuring both bands and disc jockeys, i.e., the return of
the."10 to 12 Club" on Fridays;
• educational programs, e.g., book clubs, art classes, etc.
A high-security, clean, safe environment will be created to provide the kids of
Elgin with a conveniently located, more interesting alternative to traditional
malls.

The Market
The greater Elgin area is currently underserved in terms of entertainment and
shopping options for teenagers. This idea has been expressed by parents and
kids alike. Teens currently have to drive either 25 minutes east to Woodfield,
20 minutes north to Springhill or 20 minutes south to St. Charles to meet
friends, shop or go to a movie.
This is a sad state of affairs for a city of 75,000. The Zoo Station Teen Club
will fill a big void for the approximately 12,000 students who attend high
school and middle school in greater Elgin. It would also be a comfort to their
parents to know that their children have a safe, clean, conveniently located
place where they can meet friends and have fun.
