AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A CAR WASH AND AUTOMOTIVE
LUBRICATING SERVICE AT 927-939 SUMMIT STREET
WHEREAS, written application has been made for a AB Area
Business District conditional use for a car wash and
automotive lubricating service at 927-939 Summit Street; and
WHEREAS, the Zoning and Subdivision Hearing Board
conducted a public hearing after due notice by publication and
has submitted its findings of fact and recommended approval;
and
WHEREAS, the City Council of the City of Elgin concurs in
the findings and recommendation of the Zoning and Subdivision
Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the City Council of the City of Elgin
hereby adopts the findings of fact made by the Zoning and
Subdivision Hearing Board, a copy of which is attached hereto
"- and made a part hereof by reference as Exhibit A.
Section 2 . That a conditional use for a car wash and
automotive lubricating service at 927-939 Summit Street and
legally described as follows :
THAT PART OF THE SOUTH HALF OF SECTION 7,
TOWNSHIP 41 NORTH, RANGE 9 EAST OF THE THIRD
PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS :
COMMENCING AT THE NORTHEAST CORNER OF LORD' S PARK,
BEING ALSO THE NORTHWEST CORNER OF THE EAST HALF OF
THE NORTHWEST QUARTER OF SECTION 18, TOWNSHIP AND
RANGE AFORESAID; THENCE NORTH 88 DEGREES 38 MINUTES
00 SECONDS EAST, ALONG THE SOUTH LINE OF CAMPUS
EAST, BEING A SUBDIVISION OF PART OF THE SOUTH HALF

BEING SITUATED IN THE CITY OF ELGIN, COOK COUNTY,
ILLINOIS AND CONTAINING 40,010 .93 SQUARE FEET MORE
OR LESS.
be and is hereby granted subject to the following conditions :
1 . Substantial compliance with the site plan,
prepared by Scheflow Engineers, dated September 15,
1993 and revised October 1, 1993 .
2 . The free-standing sign shall be constructed
as a "monument-style" sign in accordance with
generally accepted standards and as approved by the
Development Administrator.
3 . Compliance with all other applicable codes
and ordinances .
Section 3 . That the conditional use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4 . That this ordinance shall be in full force
and effect immediately after its passage in the manner
provided by law.

FINDINGS OF FACT
ZONING AND SUBDIVISION HEARING BOARD
CITY OF ELGIN
I. SUBJECT
Consideration of Petition 30-93 Requesting an AB Area
Business District Conditional Use for a Car Wash and
Automotive Lubricating Service; Property Located at 927-939
Summit Street; by Heritage Development, as Applicant, and
Bank One of Elgin, as Owner.
II . CONSIDERATIONS
A petition has been filed by Heritage Development
requesting AB Area Business District conditional use
approval for a car wash and an automotive lubricating
service. The subject property is located at 927-939 Summit
Street.
The petitioner proposes to develop the subject property
with a car wash and quick oil change service.
III. FINDINGS
After due notice, as required by law, the Zoning and
Subdivision Hearing Board held a public hearing on Petition
30-93 on September 1, 1993 . The petitioner testified at
the public hearing. Neither proponents of nor objectors to
the petition testified at the public hearing. Neither
written correspondence in support of nor in objection to
the petition has been submitted.
The Zoning and Subdivision Hearing Board has made the
following findings with respect to Petition 30-93:
A. Site Characteristics
The subject property contains approximately 39,900
square feet (210 'x190 ' ) . The vacant parcel is
relatively flat.

B. Sewer and Water
The subject property can be served by municipal
utilities located in close proximity. The existing
utilities have adequate capacity to serve the proposed
uses .
C. Traffic and Parking
The subject property is located along Summit Street
(State Route 58) . Summit Street functions as a major
east-west arterial street serving the central east
side of Elgin. Access to Summit Street is subject to
the review and approval of the Illinois Department of
Transportation (IDOT) .
The Institute of Transportation Engineers does not
have reliable data on the amount of traffic generated
by car washes and quick oil change businesses . One of
the proposed businesses - Super Wash - has submitted
traffic data based on their experience at over 300
locations (see Exhibit E(2) ) .
D. Zoning History
'"`- The subject property was rezoned from B-3 Service
Business District to AB Area Business District in 1992 .
E. Zoning Status
The subject property is vacant. The proposed uses are
classified as conditional uses in the AB District.
F. Surrounding Land Use and Zoning .
The subject property is located within an area zoned
AB Area Business District. The area is developed with
a variety of retail, commercial service, and office
uses .
G. Trend of Development
The subject property is located in a developing
commercial district.
H. Comprehensive Plan
The subject property is designated "area business
district" .

. .•. IV. RECOMMENDATIONS
On a motion to recommend approval of Petition 30-93 ,
subject to the following conditions :
1. Revisions to the site plan, prepared by Super Wash,
dated June 1, 1993, and preliminary engineering plan,
per the City of Elgin and IDOT, including, but not
limited to the relocation of the car wash to the
westerly side of the property, at approximately the
same distance from the south property line as shown on
the 6/1/93 site plan, and relocation of the automotive
lubricating service to the easterly side of the
property, at approximately the same distance from the
south property line as shown on the 6/1/93 site plan.
2 . Substantial conformance with the revised site plan and
preliminary engineering plan.
3. Compliance with all applicable codes and ordinances.

Therefore, the motion to recommend approval of Petition 30-93
was adopted.
