AN ORDINANCE
ESTABLISHING SAFE SCHOOL ZONES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1 . That the Elgin Municipal Code, 1976, as
amended, be and is hereby further amended by adding Chapter
10. 38 entitled "Safe School Zone" , as follows :
CHAPTER 10. 38
SAFE SCHOOL ZONE
10 . 38 . 010 Unlawful acts designated.
It is unlawful for any person to distribute on
any public sidewalk, street or way, unsolicited
material of any kind within 100 feet of the entrance
or exit of any elementary school property between
the hours of 7 :45 a.m. to 8:40 a.m. and 2 : 00 p.m. to
2 : 55 p.m. , junior high or middle school between the
hours of 8 :45 a.m. to 9 :00 a.m. and 3 : 10 p.m. to
3 :25 p.m. , or high school between the hours of
7 : 30 a.m. to 7 :45 a.m. and 2:55 p.m. to 3: 10 p.m. on
days in which classes are in session.
Section 2 . That all ordinances or parts of ordinance
thereof in conflict with this ordinance are repealed.
Section 3 . That this ordinance shall be in full force
and effect ten days from and after its passage and publication
in the manner provided by law.

TO: Mayor and Members of the City Council
FROM: Larry L. Rice, City Manager
SUBJECT: Establishment of Safe School Zones
At the last Council meeting, the U-PAC representatives
proposed that the City Council establish safe school zones by
ordinance which would prohibit the dissemination of any liter-
ature during certain hours within certain distance of the
school property on school days. The City Council directed
that the Corporation Counsel prepare such an ordinance for
its discussion at this meeting. Attached is that ordinance.
FINANCIAL IMPACT
The attached ordinance would not directly cause in-
creased City funding.
RECOMMENDATION
The City Council is asked to consider adoption of the
attached ordinance prohibiting the dissemination of any ma-
terial during certain times of the day within certain dis-
tance of school • operty.

Your Honor and City Council Members ,
As stated previously, our concern ' is one_ of. safety. As you have
heard, our children do have specific safety rules to follow while
in the immediate area of a school building, along with rules for
the loading and unloading of our bus students .
Any disruption of these rules clearly put children at risk.
We also have stated that " technically" those children who are bused
are clearly under the Districts hands , until such time they are
delivered to their appointed bus stop. Therefore , they are still
under supervision, and supervisors must be allowed control of these
areas at all times to insure the safety of all .
At this time, we would like to point out that ice cream trucks have
been prohibited access for this reason.
We also feel since there are other means "special interest groups"
can utili/e to approach schools , So therefore by the passing of this
ordinance does not _ inhibit them from seeking access . Contact can
be made through the Central Office of U46 to inquire about making
arrangements for proper access to the schools .
This insures that the basic safety rules have been met as to prevent
any accident from happening, such as what took place in Carol Stream,
when a child was run over by a bus .
Once again, we would like to thank the City Council for the
opportunity to speak.

Protecting Our thildren's Education
January 27 , 1993
Dear Mr. Mayor and City Council Members ,
We come before you tonight seeking a' "SAFE ZONE" for the children
during their arrival and departure to and from school .
Recent incidents that have occurred surrounding the immediate area of
school buildings has caused great concern. The loading and unloading
of children , along with those students who walk , enables special
interest groups to interfer with the easy access to and from the school
building or reaching the buses on departure .
Students must cross the public sidewalk to reach either destinaton.
This allows the groups to stand around the building and interfer with
the school ' s daily routine .
We submit this encroaches on the guarantee of safe passage of all students
in the Elgin area .
We have already posed this problem to the Board of U46 and asked that
wherever possible the buses be placed on school property, but this does
not slove the problem for those students who walk or the buses that
remain at risk.
Since the surrrounding area is City property, we therefore ask the
Council adopt an ordinance that would provide a "SAFE ZONE" of 300ft .
from any existing school building during the hours of 7 : 00a . m. to 4 : 30p . m.
This would allow students clear access to either destination and would
create a SAFE enviroment when coming and going to school .
I have already provided Mr . Rice with a recently taped radio interview
with two well noted child psychologists on the importance ii creating
a "SAFE ZONE" for children . We encourage the City Council to listen
to this tape , as it provides a clear understanding on this topic .
