The pamphlet form of Ordinance No. G45-93, including
the Ordinance and a cover sheet thereof, was prepared, and a
copy of such Ordinance was posted in the municipal building,
commencing on September 9 , 1993, and continuing for at least
ten days thereafter. Copies of such Ordinance were also
available for public inspection upon request in the office of
the municipal clerk.

AN ORDINANCE RECLASSIFYING PROPERTY LOCATED
ON THE EAST AND WEST SIDES OF
NORTH LYLE AVENUE, NORTH OF BIG TIMBER ROAD;
COMMONLY KNOWN AS CENTURY OAKS SQUARE
WHEREAS, written application has been made to reclassify
certain property located on the east and west sides of North
Lyle Avenue, north of Big Timber Road, from MFR Multiple Family
Residence District to PMFR Planned Multiple Family Residence
District and PNB Planned Neighborhood Business District; and
WHEREAS, the Planning and Development Commission has
conducted a public hearing after due notice and submitted its
written findings and recommendations to the City Council; and
WHEREAS, the City Council has reviewed the recommendations
of the Planning and Development Commission and concurs in such
recommendations .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
e"- Section 1 . That Chapter 19 . 07, Section 19 . 07 . 600 entitled
" Zoning District Map" of the Elgin Municipal Code, 1976, as
amended, be and the same is hereby further amended by adding
thereto the following paragraphs :

PARCEL lA (located on the north side of Big Timber Road, west
of North Lyle Avenue)
A. PURPOSE AND INTENT: The purpose of the PNB Planned
Neighborhood Business District is to provide a planned
commercial area supplying daily convenience
commodities and services to a neighborhood population,
subject to the provisions of Chapter 19 . 60, Planned
Developments . The scale of development of the PNB
zoning district is limited by the applicable site
design regulations due to its function and resulting
close proximity to residences . The PNB zoning
district is most similar to, but departs from the
standard requirements of the NB zoning district.
B. SUPPLEMENTARY REGULATIONS: Any word or phrase
contained within this ordinance followed by the symbol
" (SR) " shall be subject to the definitions and the
additional interpretive requirements provided in
Chapter 19 . 90, Supplementary Regulations, of the Elgin
Municipal Code, 1976, as amended. The exclusion of
such symbol shall not exempt such word or phrase from
the applicable supplementary regulation.
C. GENERAL PROVISIONS: In the PNB District, the use and
development of land and structures shall be subject to
the general regulations contained in Chapter 19 . 05,
General Provisions, of the Elgin Municipal Code, 1976,
as amended.
D. ZONING DISTRICTS - GENERALLY: In the PNB District,
the use and development of land and structures shall
be subject to the provisions of Chapter 19 . 07, Zoning
Districts, of the Elgin Municipal Code, 1976, as
amended.
E. LOCATION AND SIZE OF DISTRICT:The PNB District shall
be located on the north side of Big Timber Road, west
of North Lyle Avenue. The PNB District is located in
conformance with the official comprehensive plan. The
amount of land necessary to constitute this PNB
District is 2 . 00 acres .
F. LAND USE: In the PNB District, the use and
development of land and structures shall be subject to
the provisions of Chapter 19 . 10, Land Use, of the
Elgin Municipal Code, 1976 , as amended. The following
enumerated "land uses" shall be the only land uses
allowed as "permitted uses" (SR) in the PNB District:

with the approved planned development plan.
- "Accessory uses" (SR) (UNCL) to the permitted uses
allowed in the PNB Planned Neighborhood Business
District, subject to the provisions of Section
19 . 10 . 400, Component Land Uses, of the Elgin Municipal
Code, 1976, amended.
G. SITE DESIGN In the PNB District, the use and
development of land and structures shall be subject to
the provisions of Chapter 19 . 12 , Site Design, of the
Elgin Municipal Code, 1976, as amended. In the PNB
District, the site design shall be in substantial
conformance with the approved planned development plan.
H. OFF STREET PARKING: In the PNB District, off street
parking shall be subject to the provisions of Chapter
19 .45, Off Street Parking, of the Elgin Municipal
Code, 1976 , as amended, including but not limited to
the minimum required number of parking spaces for each
use established within the PNB District. Off street
parking shall be designed, constructed and located in
substantial conformance with the approved planned
development plan.
I . OFF STREET LOADING: In the PNB District, off street
loading shall be subject to the provisions of Chapter
19 .47, Off Street Loading, of the Elgin Municipal
Code, 1976, as amended. Off street loading shall be
designed, constructed and located in substantial
conformance with the approved planned development plan.
J. SIGNS: In the PNB District, signs shall be subject to
the provisions of Chapter 19 .50, Signs, of the Elgin
low Municipal Code, 1976, as amended. Signs shall be
designed, constructed and located in substantial
conformance with the approved planned development plan.
K. AMENDMENTS: In the PNB District, text and map
amendments shall be subject to the provisions of
Chapter 19 . 60, Planned Developments, of the Elgin
Municipal Code, 1976 , as amended.
L. VARIATIONS: In the PNB District, no variation shall
be granted pursuant to the provisions Chapter 19 . 70,
Variations of the Elgin Municipal Code, 1976, as
amended.
M. APPEALS: Any requirement, determination or
interpretation associated with the administration and
enforcement of the provisions of this ordinance may be
appealed subject to the provisions of Chapter 19 . 75
Appeals, of the Elgin Municipal Code, 1976, as amended.
N. SITE AND OWNERSHIP REQUIREMENTS: The site of the
planned development shall remain under unified control
pursuant to the provisions of this ordinance.
O. SUBDIVISION REGULATIONS: The PNB District involves
the subdivision of land and is subject to the
provisions of Title 18, Subdivisions, of the Elgin
Municipal Code, 1976, as amended and shall be subject
to the approved planned development plan.
P. DEVELOPMENT CONTRIBUTIONS REQUIREMENTS: The PNB
District is subject to the provisions of Title 17,
Development Impact Fees, of the Elgin Municipal Code,
1976, as amended.
Q. CHANGES TO THE PLANNED DEVELOPMENT: Changes to the
planned development shall be subject to the
requirements of Chapter 19 . 60 Planned Developments, of
the Elgin Municipal Code, 1976, as amended.
R. REVOCATION OF THE PLANNED DEVELOPMENT: If the
construction of the planned development has not
started within two years of the date of its approval,
the Development Administrator shall file an
application for a map amendment reclassifying the
subject property from a planned zoning district to the
most restrictive zoning district that is consistent
with the goals, objectives, and policies of the
official comprehensive plan, as determined by the
Development Administrator and subject to the
provisions of Chapter 19 .55, Amendments, of the Elgin
Municipal Code, 1976, as amended.
PARCEL 1B ( located on the north side of Big Timber Road, east
of North Lyle Avenue)

Municipal Code, 1976, as amended. The exclusion of
such symbol shall not exempt such word or phrase from
the applicable supplementary regulation.
C. GENERAL PROVISIONS: In the PMFR District, the use and
development of land and structures shall be subject to
the general regulations contained in Chapter 19 . 05,
General Provisions, of the Elgin Municipal Code, 1976,
as amended.
D. ZONING DISTRICTS - GENERALLY: In the PMFR District,
the use and development of land and structures shall
be subject to the provisions of Chapter 19 . 07, Zoning
Districts, of the Elgin Municipal Code, 1976, as
amended.
E. LOCATION AND SIZE OF DISTRICT:The PMFR District shall
be located on the north side of Big Timber Road, west
of North Lyle Avenue. The PMFR District is located in
substantial conformance with the official
comprehensive plan. The amount of land necessary to
constitute this PMFR District is 6 .458 acres .
F. LAND USE: In the PMFR District, the use and
development of land and structures shall be subject to
the provisions of Chapter 19 . 10, Land Use, of the
Elgin Municipal Code, 1976, as amended. The following
enumerated "land uses" shall be the only land uses
allowed as "permitted uses" (SR) in the PMFR District:

vaults, pipes, mains, and valves" (SR) (UNCL) .
MISCELLANEOUS USES DIVISION
- "Fences and walls" (SR) (UNCL) . , designed,
constructed, and located in substantial conformance
with the approved planned development plan.

- "Parking lots" , (SR) (UNCL) exclusively "accessory"
(SR) , subject to the provisions of Chapter 19 .45, Off
Street Parking, of the Elgin Municipal Code, 1976, as
amended. Parking lots shall be designed, constructed,
and located in substantial conformance with the
approved planned development plan.
- "Signs" (SR) (UNCL) , subject to the provisions of
Chapter 19 . 50, Signs, of the Elgin Municipal Code,
1976, amended, designed, constructed and located in
substantial conformance with the approved planned
development plan.
- "Refuse collection areas" (SR) , designed,
constructed and located in substantial conformance
with the approved planned development plan.
- "Accessory uses" (SR) (UNCL) to the permitted uses
allowed in the PMFR Planned Multiple Family Residence
District, subject to the provisions of Section
19 . 10 .400, Component Land Uses, of the Elgin Municipal
Code, 1976, as amended.
- "Accessory structures" (SR) (UNCL) to the permitted
uses allowed in the PMFR District, subject to the
provisions of Section 19 . 12 . 500, Accessory Structures
and Buildings, of the Elgin Municipal Code, 1976, as
amended. Accessory structures shall be designed,
tow constructed, and located in substantial conformance
with the approved planned development plan. Only
those accessory structures expressly depicted and/or
referenced on the approved planned development plan
shall be permitted.
G. SITE DESIGN In the PMFR District, the use and
development of land and structures shall be subject to
the provisions of Chapter 19 . 12, Site Design, of the
Elgin Municipal Code, 1976, as amended. In the PMFR
District, the site design shall be in substantial
conformance with the approved planned development plan.
H. OFF STREET PARKING: In the PMFR District, off street
parking shall be subject to the provisions of Chapter
19 .45, Off Street Parking, of the Elgin Municipal
Code, 1976, as amended, including but not limited to
the minimum required number of parking spaces for each
use established within the PMFR District. Off street
parking shall be designed, constructed and located in
substantial conformance with the approved planned
development plan.
I . SIGNS: In the PMFR District, signs shall be subject
to the provisions of Chapter 19 . 50, Signs, of the

K. AMENDMENTS: In the PMFR District, text and map
amendments shall be subject to the provisions of

L. VARIATIONS : In the PMFR District, no variation shall
be granted pursuant to the provisions of Chapter
19 . 70, Variations of the Elgin Municipal Code, 1976,
as amended.
M. APPEALS: Any requirement, determination or
interpretation associated with the administration and
enforcement of the provisions of this ordinance may be
appealed subject to the provisions of Chapter 19 . 75
Appeals, of the Elgin Municipal Code, 1976 , as amended.
N. SITE AND OWNERSHIP REQUIREMENTS: The site of the
planned development shall remain under unified control
pursuant to the provisions of this ordinance.
O. SUBDIVISION REGULATIONS: The PMFR District involves
the subdivision of land and is subject to the
provisions of Title 18, Subdivisions, of the Elgin
Municipal Code, 1976, as amended and shall be subject
to the approved planned development plan.
P. DEVELOPMENT CONTRIBUTIONS REQUIREMENTS: The PMFR
District is subject to the provisions of Title 17 ,
Development Impact Fees, of the Elgin Municipal Code,
1976, as amended.
Q. CHANGES TO THE PLANNED DEVELOPMENT: Changes to the
planned development shall be subject to the
requirements of Chapter 19 . 60 Planned Developments, of
the Elgin Municipal Code, 1976, as amended.
R. REVOCATION OF THE PLANNED DEVELOPMENT: If the
construction of the planned development has not
started within two years of the date of its approval,
the Development Administrator shall file an
application for a map amendment reclassifying the
subject property from a planned zoning district to the
most restrictive zoning district that is consistent
with the goals, objectives, and policies of the
official comprehensive plan, as determined by the
Development Administrator and subject to the
provisions of Chapter 19 .55, Amendments, of the Elgin
Municipal Code, 1976, as amended.
