AN ORDINANCE
AMENDING CHAPTER 19, ENTITLED "ZONING" OF THE
ELGIN MUNICIPAL CODE, 1976, AS AMENDED
WHEREAS, written application has been made to amend the
provisions of the zoning ordinance relating to obstructions in
yards; and
WHEREAS, the Planning and Development Commission held a
public hearing concerning the proposed amendment after due
notice in the manner provided by law; and
WHEREAS, the Planning and Development Commission has
submitted its written findings and recommendation that the
requested amendment be granted; and
WHEREAS, the City Council of the City of Elgin, Illinois,
concurs in the findings and recommendations of the Planning
and Development Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1. That Chapter 19.12 entitled "Site Design" of
Title 19 of the Elgin Municipal Code, 1976, as amended, be and
is hereby further amended by amending Subsection 10 of Section
19.12.600C to read as follows:
10. Decks, patios, porches, terraces, or any
other similar impervious surface unless otherwise
provided explicitly in this section, open to the
sky, encroaching zero linear feet into the required
building setback from a street lot line and four
feet or less in "structure height" [SR]. No deck,
patio, porch, terrace, or any other similar
impervious surface shall be used as a "vehicle use
area" [SR].
Section 2. That Chapter 19.12 entitled "Site Design" of
Title 19 of the Elgin Municipal Code, 1976, as amended, be and
is hereby further amended by adding Subsection 7 of Section
19.12.600D to read as follows:
7. Decks, patios, porches, terraces, or any
other similar impervious surface unless otherwise
provided explicitly in this section, open to the
sky, encroaching zero linear feet into the required
building setback from a interior lot line and four
feet or less in structure height. No deck, patio,
porch, terrace, or any other similar impervious
surface shall be used as a "vehicle use area" [SR].
Section 3. That numbers 7 through 10 of Section
19.12.600D entitled "Side Yard" be and are hereby renumbered 8
through 11.
Section 4. That Chapter 19.12 entitled "Site Design" of
Title 19 of the Elgin Municipal Code, 1976, as amended, be and
is hereby further amended by amending Subsection 3 of Section
19.12.600E to read as follows:
3. Decks, patios, porches, terraces, or any
other similar impervious surface unless otherwise
provided explicitly in this section, open to the
sky, encroaching zero linear feet into the required
building setback from an interior lot line and four
feet or less in structure height. No deck, patio,
porch, terrace, or any other similar impervious
surface shall be used as a "vehicle use area" [SR].
Section 5. That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are
hereby repealed.
Section 6. That this ordinance shall be in full force
and effect after its passage in the manner provided by law.
