AN ORDINANCE
AMENDING CHAPTER 16.04 ENTITLED "BUILDING CODE"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Chapter 16.04 entitled "Building Code" of
the Elgin Municipal Code, 1976, as amended, be and is hereby repealed.
Section 2. That Chapter 16.04 entitled "Building Code" be
and is hereby added to the Elgin Municipal Code, 1976, as amended,
"Chapter 16.04"
BUILDING CODE
16.04.010 Short Title.
The ordinance codified in this chapter shall be known and cited as
the "Building Code" and will be referred to in this chapter as
"this code".
16.04.020. Adopted.
The regulations of the 1990 edition of the BOCA National Building
Code, 11th printing, as recommended and published by the Building
Officials and Code Administrators International Inc. , published in
pamphlet form, are adopted as the regulations governing the
construction of buildings and other structures in the city with
such amendments as are hereinafter set forth in this chapter,
except as such matters as are otherwise provided for in other
ordinances or statutes, and the 1989 edition of the CABO One and
Two Family Dwelling Code as recommended and published governing the
construction of one and two-family residences and buildings
customarily accessory to the foregoing with such amendments as are
hereinafter set forth in this chapter.
16.04.030. Definitions.
A. Whenever the word "municipality" is used in this code, it
means the City of Elgin.
B. Whenever the term "code official" is used in this code, it
means the code official of the Department of Code Administration.
C. Whenever the term "department of building inspection" is used
in this code it means the Dept. of Code Administration and
Preservation of the City of Elgin.
16.04.040. Sidewalks, Approaches and Driveways - When Required.
A concrete sidewalk and driveway approach, conforming with the
specifications established in Chapter 13.04 of the Elgin Municipal
Code shall be required prior to the issuance of an occupancy permit
for any new building or structure, which is situated on a lot or
plot of ground which abuts upon any street in the City of Elgin unless
said sidewalk is specifically exempted. Driveways located on private
property must be paved with concrete or asphalt prior to the issuance
of an occupancy permit.
16.04.050. Fence Installation.
A building permit is required prior to the construction or
installation of any fence within the corporate limits of the city.
Fences shall be constructed or installed according to the
regulations established in Chapter 19 of the Elgin Municipal Code."
16.04.060. Assessor's Receipt.
No certificate of use and occupancy shall be issued until and
unless an unexecuted certificate of use and occupancy has been
filed with the township assessor or the county assessor of the
county in which the property is located and that the owner of such
property obtain from the assessor, in the form prescribed by such
official, a receipt showing that the unexecuted certificate of use
and occupancy has been filed and that his property is subject to
increased assessment, from the date of issue of the certificate on a
proportionate basis for the year in which the improvement was
completed. The owner of the property shall file such receipt with
the building official and a certified copy of the certificate, when
issued, shall be filed with the assessor."
16.04.070. Street Numbers.
A. Required: All lots, buildings and structures within
the corporate limits of the city shall be assigned a street
number in accordance with the numbering system established
by the Dept. of Code Administration and Preservation.
B. Size and Type: Street numbers shall be a minimum of (5) five
inches in height and be of a contrasting color from the
structure. Street numbers must be readily visible from the
adjoining street. Street numbers shall not be in script.
C. Location:
1. Prior to the start of construction of any structure on vacant
land, the assigned street number shall be posted in a prominent
location, visible from the adjoining street.
2. No structure shall be occupied unless the assigned street number
is mounted on the structure next to the front entrance in a
prominent location and visible from the adjoining street. If
that location is not readily visible from the adjoining street,
the number shall be placed elsewhere in close proximity to the
front entrance where it is not obstructed.
3. The street number of multiple tenant buildings with common
entrances shall be placed in a prominent location in proximity
to the adjoining street or parking area. Each tenant space shall
have the numbers or letters assigned to that unit posted on the
door of that unit."
"16.04.080 BOCA National Building Code - Article 1 Amendments.
A. Section 112.0 Permits is amended as follows:
Section 112.8 Posting of permit is deleted in its entirety.
B. Section 114.0. Fees is amended as follows:
Section 114.3.1. Fee schedule: A fee for each plan
examination, building permit and inspections shall be paid in
accordance with Chapter 16.48
C. Section 115.0. Inspections is amended as follows:
Section 115.2 Inspections shall be required prior to pouring
footings, piers, and/or caissons and prior to backfilling of
foundation walls. Inspections shall be required prior to closing up
walls and final inspection upon completion of work. It is the
responsibility of the contractor to request required inspections,
giving a minimum of eight (8) working hours notice.
D. Section 122.0 Posting Structures is amended as follows:
Section 122.1 Posted use and occupancy is repealed in its entirety.
Section 122.4 Periodic inspection is repealed in its entirety.
E. Section 124.0 Board of Appeals is amended as follows:
Section 124.0 Board of Appeals is repealed in its entirety. Refer
to Chapter 3.60 of the Elgin Municipal Code."
16.04.090 BOCA National Building Code -- Article 5 Amendments.
A. Section 504.0 Unlimited Areas is amended by adding:
Section 504.1 One-story buildings: In other than Type 5
construction, the area of all buildings of Use Groups A, B, F, I-2, M
and S (not including high-hazard uses) , which do not exceed one
story or 85 feet in height, shall not be limited, provided that: the
exit facilities comply with the provisions of Article 8; the building
is equipped throughout with an automatic sprinkler system in
accordance with Section 1004.2.1; and the building is isolated as
specified in Section 504.2.
Exceptions
1. Buildings and structures of special industrial uses according
to Section 501.1.1 shall be exempt from the above height
limitations and fire separation distance requirements, and the
automatic fire suppression system shall not be provided when such
installations would be detrimental or dangerous to the specific
use and occupancy as approved by the code official. Where located
with a fire separation distance of less than 30 feet, the
exterior walls of such buildings shall be protected or
constructed to provide a fireresistance rating of not less than 2
hours.
2. Buildings and structures of Types 1 and 2 construction for
rack storage facilities which do not have access by the
public shall not be limited in height provided that such
buildings conform to the requirements of Section 504.1 and
NFPA 231C listed in Appendix A.
Section 504.1.1 School Buildings: One-story school buildings of Use
Group E of Type 2, 3A or 4 construction shall not be limited in area
when a direct exit to the outside of the building is provided from
each classroom and the building is equipped throughout with an
approved automatic sprinkler system in accordance with Section
1004.2.1. Exterior walls on all sides of such buildings shall comply
rk with Section 504.2.
Section 504.1.2 Indoor recreation buildings: Indoor participant sport
areas such as tennis courts, skating rinks, swimming pools and
equestrian clubs shall not be limited in area and shall be exempt from
the automatic fire suppression system requirements provided that the
requirements of Sections 504.1.2.1 through 504.1.2.4 are met.
Section 504.1.2.1 Exits: Direct exits to the outside are provided for
all of the occupants of the recreation area.
Section 504.1.2.2. Posting: The recreation area is conspicuously
posted as to use and occupant load.
Section 504.1.2.3. Fire protective signaling system: The building is
equipped with a fire protective signaling system.
Section 504.1.2.4 Fire Suppression: All other areas are equipped with
an automatic fire suppression system.
Section 504.2 Exterior walls: The minimum fireresistance rating of
exterior walls of one-story buildings of unlimited area shall be
determined by the use group and the fire separation distance as
specified in Table 504.2, but shall not be less than the
fireresistance rating required by Table 401 for the type of
construction.

Section 504.2.1 Opening protectives: Openings in exterior walls
required by Table 504.2 to have a fireresistance rating of 3 hours
or more shall be protected with fire assemblies having a
fireresistance rating of not less than 3 hours. Openings in
exterior walls required by Table 504.2 to have a fireresistance
rating of 2 hours shall be protected with fire assemblies having a
fireresistance rating of not less than 1 1/2 hours.
Section 504.3 Two-story Buildings: Two-story unlimited area
buildings shall be allowed in Use Group B and S, provided a minimum of
60' setback to lot line is maintained and any structure within 60'
shall also comply with unlimited area requirements, if located on the
same parcel of land and shall also be of Use Group B and S. The
FLT following restrictions shall also apply:
1. Penthouse is limited to mechanical systems only.
Example: HVAC, fire protection, elevators
2. Mezzanine option as provided elsewhere in code is
not allowed.
3. Height limitation of 55' .
Section 504.4 Subdivision of Existing Unlimited Area Buildings:
Lawfully existing unlimited area buildings divided by new lot lines
are not required to comply with the setback regulations of Table
504.2, provided all of the following requirements are met:
1. Fire separation rating at lot line dividing building shall be
of a fire grade for use as prescribed in Table 907.
2. Building prior to subdivision complied with all requirements
for unlimited area building regulations.
3. Building areas subdivided must be of the same use group. Mixed
�•. use as permitted in Section 313.0 is not allowed.
4. Any addition/alteration of any portion of a building must
comply with all requirements for an unlimited area building.
B. Section 511.0 Temporary Structures is amended as follows:
Section 511.1 General. The building official may issue a permit for
temporary construction. Such permit shall be limited as to time of
service, but such temporary construction shall not be permitted for
more than one year.
C. 512.0 Physically Handicapped and Aged is amended as follows:
Section 512.0 is deleted in its entirety.
"16.04.100 BOCA National Building Code - Article 6 Amendments
Section 624.0 Temporary Structures is amended as follows:
Section 624.1 General: The provisions of this section shall apply to
tents, membrane structures and other structures erected for a period
of less than thirty (30) days. Those erected for a longer period of
time shall comply with Section 604.0 or with all applicable sections
of this code when Section 604.0 is not applicable.
Section 624.1.1 Permit required: All temporary structures that cover
an area in excess of 120 square feet, including all connecting areas
or spaces with a common means of egress or entrance which are used
or intended to be used for the gathering together of ten or more
persons, shall not be erected, operated or maintained for any
purpose without obtaining a permit from the code official. Tents used
exclusively for recreational camping purposes shall be exempt from the
above requirements. Special permits required by this code shall be
secured from the code official.
Tents, air supported structures and other temporary structures may be
erected for a period not exceeding thirty (30) days for religious,
educational, recreational, or similar purposes. Temporary tents may be
erected for a period not exceeding fifteen (15) days for other
purposes upon written application to the building official. Said
application shall be made not later than thirty (30) days prior to
the commencement of use of said tent.
Exception: Open-sided tents are exempt from the provision of this
section.
16.04.110 BOCA National Building Code - Article 8 Amendments.

Note a: Open parking structures shall have the number of
exits prescribed in Section 809.5.
16.04.120. BOCA National Building Code - Article 9 Amendments
rib* Section 908.0 Fire Wall Openings is amended as follows:
Section 908.3.1. Hold open devices: Combination heat and smoke
actuated hold open devices shall be installed on both sides of the
wall, interconnected so that the operation of any single device
will permit the door to close. Combination smoke and heat
detectors shall be installed at the door opening and at the
ceiling in conformance with NFPA 80 listed in Appendix A unless
otherwise approved by the building official."
16.04.130. BOCA National Building Code - Article 10 Amendments
Sections 1002.1 through 1002.10 are repealed in their entirety and the
following is inserted:
Section 1002.1 Where required: Automatic fire suppression systems
shall be installed where required by this code, and in the locations
indicated in Section 1002.2 through 1002.10
Exception: Open parking garages.
Section 1002.1.1 An approved automatic sprinkler system shall be
installed throughout every building more than four (4) stories
in height or fifty (50) feet in height which include basements as
stories.

Section 1002.1.2 An approved automatic sprinkler system shall be
installed in buildings less than five (5) stories as hereafter
provided.
Section 1002.2 Use Group A-1: (Example - Theaters) Throughout all
Use Group A-1 fire areas, an approved automatic fire suppression
system shall be provided as follows:
1. Throughout the entire story or floor level where the A-1 Use
Group is located,
2. Throughout all stories and floor levels below the A-1 Use
Group, and
3. Throughout all intervening stories and floor levels between
the A-1 Use Group and the level of exit discharge of exits
that serve the Use Group A-1 fire area, including the level of
exit discharge.
Exception: Auditorium areas with the building officials approval.
Section 1002.3 Use Group A-2: (Example - Dance Halls, Night Clubs)
Where a Use Group A-2 fire area is more than 3,000 square feet in area
or is located either above or below the level of exit discharge of
exits that serve the Use Group A-2 fire area, an approved automatic
fire suppression system shall be provided as follows:
1. Throughout the entire story or floor level where the A-2
Use Group is located:
2. Throughout all stories and floor levels below the A-2 Use
Group; and
3. Throughout all intervening stories and floor levels between
the A-2 Use Group and the level of exit discharge of exits that
serve the Use Group A-2 fire area, including the level of exit
discharge.
Section 1002.4 Use Group A-3, A-4, and E: (Example - Schools,
Exhibit Halls) Where a Use Group area exceeds 5,000 square feet in
area, or is located either above or below the level of exit discharge
of exits that serve the Use Group A-3, A-4, or E fire area, an
approved automatic fire suppression system shall be provided as
follows:
1. Throughout the entire story or floor level where the A-3,
A-4, or E Use Group is located:
2. Throughout all stories and floor levels below the A-3, A-4, or
E Use Group;
3. Throughout all intervening stories and floor levels below the
A-3, A-4, or E Use Group and the level of exit discharge of
exists that serve the Use Group A-3, A-4, or E fire area,
including the level of exit discharge.
Section 1002.5 Use Group H:. An approved automatic fire
suppression system shall be provided throughout all Use Group H
fire areas.
Section 1002.6 Use Group I: An approved automatic fire suppression
system shall be provided throughout all buildings with a Use Group I
fire area.
Exceptions
1. In buildings where Use Group I-1 facilities are located at
the level of exit discharge and accommodate five (5) or less
occupant load and room or space has a direct exit to the outside.
(* Example - Group Homes, Convalescent Facilities -
Capable of self preservation)
2. In buildings where Use Group I-2 child care
facilities are located at the level of exit discharge and
accommodate five (5) children or less and room or space has a
direct exit to the outside.
(* Example - Medical care twenty-four (24) hours -
Not capable of self preservation)
Section 1002.7 Use Groups M, S, B and F: Throughout all
buildings with a Use Group M, S, B or F fire area, an approved
automatic fire suppression system shall be provided as follows:
1. Throughout all buildings with a Use Group M , S and F if more
than 7,500 square feet in area; two (2) stories if total
area of two (2) floors exceed 10,000 square feet; three (3)
stories irregardless of square footage.
2. Use Group "B": Throughout all buildings with a Use Group B, if
more than 10,000 square feet in area; two (2) stories if total
area of two (2) floors exceed 15,000 square feet; three
(3) stories irregardless of square footage.
Section 1002.8 Use Group R-1: (Example - Hotels, Motels -Use
less than thirty (30) days) An approved automatic fire
suppression system shall be provided throughout all buildings with
a Use Group R-1 fire area in accordance with Section 1004.2.1 or
1004.2.2.
Exception: Where all guest rooms have their own exit
directly to the outside at ground level.
Section 1002.9 Use Group R-2 - Other than one or two-family:
Approved he basements, storerooms (other than storeroom contained
within dwelling unit) workrooms, common hallways, and
stairways, Note: Common exits. (Example: apartments,
dormitories, boarding houses)
Section 1002.9.1 Use Group R-3 - One and two-family
attached: Townhouses/condominiums, multi-dwellings with
tow independent egress, fire separation between units two (2) hours
or the fire separation between units one (1) hour with entire
building provided with approved automatic sprinkler system.
Section 1002.10 Windowless story: An approved automatic fire
suppression system shall be provided throughout every story or
basement of all buildings where there is not provided at least one of
the following types of openings:
1. An exterior stairway that conforms to the
requirements of Section 817.0, or an outside ramp that conforms
to the requirements of Section 816.0, leading directly to grade
in each 50 lineal feet or fraction thereof of exterior wall in
the story or basement, on at least one side of the building.
2. Openings entirely above the adjoining ground level
totaling 20 square feet in each 50 lineal feet or fraction
thereof of exterior wall in the story or basement, on at
least one side of the building. Openings shall have minimum
dimensions of not less that 22 inches. Such openings shall be
accessible to the fire department from the exterior and shall
be unobstructed to allow firefighting and rescue operations
from the exterior.
Where openings in a story are provided on only one side and the
opposite wall of such story is more that 75 feet from such openings,
the story shall be equipped throughout with an automatic
sprinkler system or openings as specified herein shall be
provided on at least two sides of the exterior walls of the
story. If any portion of a basement is located more than 75 feet
from the openings required in this section, the basement shall
be equipped throughout with an automatic sprinkler system.
Exception: Buildings of Use Group R-3.
16.04.140 BOCA National Building Code - Article 27 Amendment
Article 27 Electrical Wiring, Equipment and Systems is deleted in its
entirety. Refer to Chapter 16.24 of the Municipal Code of Elgin.
16.04.150 BOCA National Building Code - Article 28 Amendment
Article 28 Plumbing Systems is deleted in its entirety. Refer to
Chapter 16.20 of the Municipal Code of Elgin.
16.04.160 CABO One & Two Family Dwelling Code - Chapter 1 Amendments
Section R-109 Permit is amended as follows:
R-109.1 Permit required. Delete the second paragraph in its
entirety.
R-109.2 Permit Fees. Permit fees shall be paid in accordance

16.04.170 CABO One & Two Family Dwelling Code - Chapter 2 Amendments
A. Section R-201 Design Criteria is amended as follows:
Table R-201.2 Climatic and Geographic Design Criteria is amended
by inserting the following under the respective headings:
Roof Live Load - lbs per sq. ft. 30 Thirty
Roof Snow Load - lbs per sq. ft. 30 Thirty
Wind Pressure - Buildings or portions thereof less than thirty
(30) feet in height - twenty-five 25 lbs. per sq. ft. Buildings
or portion thereof thirty (30) feet to forty-nine (49) feet in
height - thirty-five (35) lbs. per sq. ft.
Seismic Condition by Zone - not applicable
Subject to Damage from Weathering - Yes
Frost Line Depth -forty-two (42) inches below grade

B. Section R-209 Attached Garages is amended as follows:
Delete R-209.1, R-209.2 and R-209.3 and amend to read as follows:
R.209.1 Attached Garages.
1. Construction same as required for the dwelling.
2. Provide a six (6) inch curb at the service door and common
walls or construct garage floor six (6) inches minimum lower
than adjoining floor.
!► 3. Installation of house heating unit or other fuel burning
appliance in garage space is not permitted. Install one hour
fire-rated partition between space containing house heating
unit and garage space. Doors are not permitted common to
heater room and garage.
4. Wood frame walls and doors common to dwelling and garage:
Finish on garage side to be one-hour fire-rated construction.
Where gable-type connection is used, a one-hour fire-rated
bulkhead shall be established in the attic space directly
above and continuous from the interior one-hour fire-rated
garage wall. Where rooms occur over the garage; the ceiling,
and all walls shall be of one-hour fire-rated construction.
All joints in the ceiling to be fire blocked. Service doors
common to dwelling are to be one-hour fire-rated. Solid core
wood door, one and three quarters (1 3/4) inches, will be
considered in lieu of a fire-rated door.
5. Hot air heat duct openings shall be a minimum of four (4) feet
over floor of garage with a fusible link fire damper. Cold air
returns are not permitted.
6. Concrete floor: minimum four (4) inches of concrete on minimum
four (4) inches crushed stone, sand or gravel. The floor area
used for parking of vehicles shall be sloped to facilitate the
elk movement of liquids toward the main vehicle entry doorway.
R-209.2 Detached frame garages:
Comply with construction requirements for one-story dwellings
with the following exceptions:
1. Foundation walls and footings may not be less than forty-two
(42) inches below finish grade. Minimum foundation thickness
to be eight (8) inches. Garages constructed within four (4)
feet of residence are required to meet minimum residential
foundation requirements.
2. Grade beam construction is permitted for garages constructed
more than four feet away from the residence. Grade beam design
to be as follows: twenty inch (20") deep by twenty inch at the
top and ten inches (10") at the base with two (2) half inch
(1/2") diameter rebars continuous around the perimeter and
poured monolithically with the floor slab. Floor slab to be
minimum four inches thick with six by six number 10 welded
wire fabric throughout. Grade beam to rest on undisturbed
soil. See illustrations.
3. Studs, maximum spacing twenty-four (24) inches O.C. (16 inches
O.C. if square footage is over 400 square feet) . Doubling of
studs is not required on jambs of openings less than three
feet five inches (3'- 5") wide.
4. Wall sheathing and building paper may be omitted if corner
bracing is used. Each corner is to be braced from top outward
in two directions to a minimum of seventy-two (72) inches from
corner at sill plate, and may be applied on the inside surface
of studs. Minimum bracing size to be 1"X 4".
5. Corner post may be two 2" X 4" or one 4"x 4".
6. Top plate may be single, provided rafters occur directly over
studs and plate at corners is lapped to provide tie.
7. Rafter ties at eaves not less than 2"X 4", maximum spacing six
(6) feet O.C.
8. Concrete floor, minimum four (4) inches of concrete on minimum
four (4) inches crushed stone, sand or gravel. The floor area
used for parking of vehicles shall be sloped to facilitate the
movement of liquids toward the main vehicle entry doorway.
R-209.4 Detached masonry or masonry veneer garages:
Comply with construction requirements for one-story dwellings
with the following exception:
Combined foundation wall and footing allowed provided it
extends forty-two (42)inches below grade and the bottom is
flared to sixteen (16) inches. Wall width shall be wide enough
to support wall above but in no event less than eight (8)
inches minimum width.

BUILDING HEIGHT
"Building height" means the vertical distance measured from the established
average grade at the foundation to the highest point of the underside of
the ceiling beams, in the case of the flat roof; to the deck line of a
mansared roof; to the mean level of the underside of rafters between the
eaves and the ridge of a gable, hip, or gambrel rood. Chimneys, spires,
towers, elevator penthouses, tanks, and similar projections other than
signs shall not be included in calculating the height.

BUILDING HEIGHTS

C. Section R-210 Exits is amended to read as follows:
R-210.2 Emergency Egress Openings is amended by adding:
"Basements or cellars: Provide direct access to outside by a
door or a window having an openable area at least two (2) feet
wide and thirty (30) inches high, the sill shall be not more
than three (3) feet above floor.
16.04.180 CABO One & Two Family Dwelling Code - Chapter 3 Amendments
A. Section R-302 Materials is amended as follows:
R-302.1 Wood Foundations is deleted in its entirety.
B. Section R-303 Footings:
Delete entire section and amend to read as follows:
1. General.
a. Design for proper distribution of superimposed loads.
Minimum depth in all instances shall be forty-two (42)
inches below grade.
b. Material: Cast in place concrete.
c. Reinforce with steel bars where footings cross or bear on
filled trenches or other unstable soil.
d. Footing dimensions are based upon soils of average bearing
capacity (2,000 pounds per square foot. ) For soils of
lesser bearing capacity or where unusual loading conditions
exist, larger footings will be required. The building
official may require soil borings and/or engineer designed
footings and foundation.
2. Wall Footings.
Minimum dimensions for spread footings shall be eight (8")
inches deep by eighteen (18") inches wide except that masonry
veneer on frame and solid masonry walls shall be minimum of
ten (10") inches deep by twenty (20") inches wide.
3. Pier, Post and Column Footings.
a. Design to based on loading and soil condition. Architect or
engineer drawings may be required by the code official.
b. Decks: Minimum eight (8) inch diameter concrete pier,
forty-two (42) inches below grade.
4. Chimney Footings: Minimum thickness twelve (12) inches;
minimum projection each side, six (6) inches. Pour integral
with wall footing when chimney occurs in outside wall or
inside bearing wall.
B. Figure No. R-303 Minimum Foundation Requirements is amended by
referencing amended Section R-303 and amended Table R-304.3a for
required depths and thickness.
C. Table No.R-304.3a is amended by deleting "6" where it appears
under "Nominal Thickness (inches)".
D. Section R-304-Foundation Walls:
R-304.5 Wood Foundation Wall is deleted in its entirety.
Add R-304.6
Trench Type Foundations, (when approved) , to be minimum twelve
(12)inches thick, forty-two (42) inches minimum below grade with
continuous rebar reinforcing at top and bottom.
S. Section R-305-Foundation Drainage:
Delete R-305.1 Amend to read as follows.
Concrete or masonry foundations:
Drains shall be provided around all concrete or masonry
foundations enclosing habitable or usable spaces located below
grade. Drainage tiles or perforated pipe shall be installed at or
below the area to be protected and shall discharge by gravity or
mechanical means into an approved drainage system. The top of
open joints of drain tile and perforated pipe shall be protected
to prevent blockage. Drain tiles or perforated pipe shall be
placed on a minimum of two (2) inches of washed gravel or crushed
rock at least one sieve size larger than the tile joint opening
or perforation and covered with not less than six (6) inches of
the same material. All window area wells shall be equipped with
drains tied into footing drain system.
R-305.2 Wood foundations is deleted in its entirety.
R-306.2 Damproofing for wood foundations is deleted in its
entirety.
F. R-307 Columns is Amended as follows:
Delete R-307.2 Structural requirements is amended to read as
follows:
1. Wood columns shall be not less in nominal size than four (4)
inches by four (4) inches. Wood columns can be used only in
conjunction with wood beams.
2. Steel columns shall be not less than three (3) inch
continuous diameter standard pipe.
3. All columns shall be adequately anchored at top and bottom to
prevent lateral displacement.
16.04.190 CABO One & Two Family Dwelling Code - Chapter 4 Amendments
Figures No.R-404.9 (four illustrations) are amended by noting
that "Firecutting is required".
16.04.200 CABO One & Two Family Dwelling Code - Chapter 8 Amendments
Chapter 8 Roof Covering shall be amended as follows:
Section R-811 Reroofing: No more than three (3) layers of
roofing shall be allowed. Reroofing over wood shakes shall not be
allowed.
16.04.210 CABO One & Two Family Dwelling Code - Chapter 9 Amendments
Section R-901 General shall be amended by adding:
"Spark arresters" with a minimum of one half (1/2) inch wire mesh
or equivalent shall be required on all wood burning fireplaces
and chimneys.
16.04.220 CABO One & Two Family Dwelling: Part V (5)
Part V (5) Plumbing is deleted in its entirety. Refer to
Chapter 16.20 of the Municipal Code.
16.04.230 Building Operations.
Construction or alteration operations shall not be carried on
priorto sunrise or after sunset if accompanied by loud or
annoying noises unless approved in writing by the building
official.
Sundays 9 a.m. to 6 p.m.
16.04.240 Conflicts With Other Provisions.
In all instances where the provisions of the building codes
adopted in this chapter conflict with specific provisions of the
electrical, plumbing, heating or fire prevention codes of the
City, either as presently adopted or to be adopted or amended in
the future, the specific provisions of these individual codes
shall supersede and take precedence over the conflicting
provisions in the building code.
Section 3. That all ordinances or parts of ordinances in conflict
with the provisions of this ordinance be and are hereby repealed.
Section 4. That this ordinance shall be in full force and effect
immediately after its passage in the manner provided by law.
